SUBJECT: CHURCH STREET RIGHT OF WAY ABANDONMENT AT 218 WEST
WORTH STREET
RECOMMENDATION: City Council consider adopting an ordinance abandoning 2,350 square
feet of Church Street Right of Way, on property described as Lot 3, Block
A, Original Town of Grapevine, located at 218 West Worth Street,
authorizing the City Manager to execute a Quit Claim Deed to the abutting
property owner, and taking any necessary action.
FUNDING SOURCE: NA
BACKGROUND: The owner of Lot 3, Block A, Original Town of Grapevine, Vol. 309 PG 71-
74 D.R.T.C.T., has requested the City to abandon a 2,350 square feet of
Church Street right of way. This right of way is at the northeast corner of
West Worth and South Church Street and will not be required for any
future expansion of Church Street. The abandoned right of way will be
retained as an access, drainage and utility easement.
Discussion of this abandonment with City Council occurred during the
December 2, 2025 Executive Session.
Staff recommends approval.

TO THE MAYOR AND CITY COUNCIL OF THE CITY OF GRAPEVINE:
The undersigned hereby makes application for the abandonment of that portion of the above
right-of-way particularly described in Exhibit A, attached. In support of this application, the
undersigned represents and warrants the following:
1. The undersigned will hold the City of Grapevine harmless, and indemnify it against all
suits, costs, expenses and damages that may arise or grow out of such abandonment.
2. Attached, marked Exhibit A, is one sealed metes and bound description of the area
sought to be abandoned, prepared by a Licensed Public Surveyor.
3. Attached, marked Exhibit B, is a copy of a plat or detailed sketch of that portion of the
public right-of-way/easement sought to be abandoned and the surrounding area to the
nearest streets in all directions, showing the abutting lots and block, and the
subdivision in which the above described right-of-way/easement is situated, together
with the record owners of such lots.
4. Attached, marked Exhibit C, is the consent of all public utilities to the abandonment.
5. Attached, marked Exhibit D, is the consent of the City of Grapevine staff to the
abandonment.

ORDINANCE NO. 2026-023
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING THE
CITY OF GRAPEVINE'S RIGHTS IN A SEGMENT OF SOUTH
CHURCH STREET RIGHT OF WAY IN THE CITY OF
GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the property owner of Lot 3, Block A Original Town of Grapevine,
Vol.309 PG 71-74 D.R.T.C.T. has requested that the City of Grapevine abandon a 2,350
square foot parcel of South Church Street right-of-way as herein after described in Exhibit
"A" and Exhibit"B", be abandoned and vacated subject to the retention of easement rights
as provided for herein; and
WHEREAS, the right of way will be incorporated into the area of Lot 3, Block A
Original Town of Grapevine, Vol.309 PG 71-74 D.R.T.C.T. by plat as an access, drainage
and utility easement and is not needed for public street use and will not be needed in the
future for public street use; and
WHEREAS, abandoning and vacating the said right of way for street use will relieve
the City of Grapevine, Texas from the cost and expense of maintaining said property.
WHEREAS, all constitutional and statutory prerequisites for the approval of this
ordinance have been met, including but not limited to the Open Meetings Act and Chapter
211 of the Local Government Code; and
WHEREAS, the City Council deems the adoption of this ordinance to be in the best
interests of the health, safety, and welfare of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated in the preamble of this ordinance are true and
correct and are hereby incorporated into the body of this ordinance as if copied in their
entirety.
Section 2. That the City of Grapevine's rights in the 2,350 square foot parcel of
South Church Street right-of-way described in Exhibit"A" and Exhibit"B", attached hereto
and incorporated herein for all purposes, is hereby abandoned and vacated for City for
street use and the same is hereby abandoned and vacated for street use but the City
specifically reserves an access, drainage, and utility easement which will encumber said
right of way.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase
shall be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such access easement creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires
that this ordinance shall take effect immediately from and after its passage and it is
accordingly so ordained.

WHEREAS The City of Grapevine is the owner of a 0.054 acre [2,350 square feet] tract of land situated in the William
Dooley Survey, Abstract No. 422, City of Grapevine, Tarrant County, Texas, and a portion of Church Street at the
northeasterly intersection of east right—of—way line of Church Street (a variable width right—of—way) with the north
right—of—way line of W. Worth Street (a 40 foot right—of—way), same being adjacent to the west line of Lot 3, Block
A, Original Town of Grapevine, an addition to the City of Grapevine, Tarrant County, Texas, according to the plat
thereof recorded in Volume 309, Page 71-74, Deed Records, Tarrant County, Texas, and being more particularly
described as follows:
BEGINNING at a 1/2 inch iron rod found with red plastic cap stamped "Peiser & Mankin Surv" (previously set) for the
northeast intersection of said Church Street and said W. Worth Street, same being the southwest comer of said Lot 3,
Block A;
THENCE South 89 deg. 14 min. 22 sec. West, through said Church Street, and along the westerly projection of the
north right—of—way line of said W. Worth Street, a distance of 19.92 feet to a 1/2 inch iron rod found for the
southwest corner of the herein described tract, same being approximately 13 feet east of the east curbline of said
Church Street;
THENCE North 00 deg. 29 min. 13 sec. East, continuing through the interior of said Church Street, a distance of
