HomeMy WebLinkAboutItem 07 - Nolen and Industrial TO: HONORABLE MAYOR, CITY COUNCIL MEMBERS, AND THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER ERICA MAROHNIC, DIRECTOR, PLANNING SERVICES MEETING DATE: MAY 19, 2026 SUBJECT: CONSIDER AMENDMENTS TO ORDINANCE NO. 87-11 BEING MAP 2: LAND USE PLAN OF THE COMPREHENSIVE MASTER PLAN (FUTURE LAND USE MAP) FOR APPROXIMATELY 73.3 ACRES LOCATED ALONG PORTIONS OF INDUSTRIAL BOULEVARD AND NOLEN DRIVE, CHANGING THE FUTURE LAND USE DESIGNATION FROM COMMERCIAL (CO) TO INDUSTRIAL (IN). (MP26-01) BACKGROUND: The City of Grapevine's Planning and Zoning Commission, during its meeting on March 17, 2026, reviewed a conditional use request (CU25-51) for a construction trade office with outside storage of two box trucks and two vans. The Commission requested that staff bring back a proposed amendment to the City's future land use map for further consideration. This amendment is to reconcile the existing land use designations for properties along portions of Nolen Drive and Industrial Boulevard, which are zoned "LI", Light Industrial District and located immediately west of the existing Wal-Mart Super Center. The amendment specifically targets approximately 73.3 acres along Industrial Boulevard and Nolen Drive, changing the future land use designation from Commercial (CO) to Industrial (IN). These properties are currently zoned for light industrial use and are already developed for industrial activities. However, the Map 2: Land Use Plan of the Comprehensive Master Plan designates them as Commercial (CO), which does not match the current zoning or the area's development character. This amendment's purpose is to align the Comprehensive Master Plan with the existing zoning and the established industrial nature of the area, by ensuring consistency between the Comprehensive Master Plan and existing zoning, reflects the industrial character of the area, provides clarity for future development and redevelopment, and minimizes potential conflicts during zoning reviews. Overall, MP26-01 serves as a policy guideline for future land use decisions, rather than authorizing specific developments. MP26-01.4 1 ORDINANCE NO. 2026-039 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, ADOPTING AMENDMENTS TO ORDINANCE NO. 87-11 BEING MAP 2: LAND USE PLAN OF THE COMPREHENSIVE MASTER PLAN,THE CITY'S FUTURE LAND USE MAP; PRESERVING ALL OTHER PORTIONS OF THE COMPREHENSIVE MASTER PLAN; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A FINE OF UP TO $2,000.00; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine is a home-rule municipality authorized to adopt and enforce ordinances necessary to protect heath, life, and property to preserve good government and the security of its inhabitants; and WHEREAS, the City of Grapevine has adopted a comprehensive Zoning Ordinance to regulate the location and use of buildings and land in full accordance with Chapter 211 of the Local Government Code; and WHEREAS, the City Council of the City of Grapevine, Texas has adopted a Comprehensive Plan, including Map 2: Land Use Plan (Future Land Use Map (FLUM)), to guide the orderly growth, development, and redevelopment of land within the City; and WHEREAS, the Future Land Use Map currently designates approximately 73.3 acres of land generally located along portions of Industrial Boulevard and Nolan Drive as Commercial (CO); and WHEREAS, the subject area is presently developed with uses that are predominantly industrial in character, including warehouse, distribution, flex office, and related light industrial operations; and WHEREAS, the existing development pattern, site configurations, access, and infrastructure within the subject area are more consistent with the intent and purpose of an Industrial future land use designation than with a Commercial (CO) designation; and WHEREAS, the current Commercial (CO) designation does not accurately reflect the established and ongoing land use pattern in the area and may create inconsistency between the Comprehensive Master Plan and existing zoning classifications; and WHEREAS, amending the Map 2: Land Use Plan (Future Land Use Map) designation from Commercial (CO) to Industrial (IN) will better align the Comprehensive Master Plan with the existing "LI", Light Industrial District zoning district and the uses currently operating within the subject area; and WHEREAS, the proposed amendment will promote clarity and consistency in long- range planning, zoning administration, and future development or redevelopment of the area; and WHEREAS, the proposed amendment is consistent with the goals and policies of the Comprehensive Master Plan to support compatible land use patterns, and direct appropriate non-residential development to areas with adequate infrastructure and access; and WHEREAS, the City of Grapevine previously adopted a Future Land Use Map and Comprehensive Plan with the adoption of Ordinance No. 87-11; and WHEREAS, the City of Grapevine is authorized by law to adopt the provisions contained herein; and WHEREAS, the City desires to implement those rules and regulations that protect health, life, and property and that preserve good government, order, and security of the City and its inhabitants; and WHEREAS, all statutory and constitutional requirements for the passage of this ordinance have been met, including but not limited to the Open Meetings Act and Chapter 211 of the Local Government Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated herein above are found to be true and correct and are incorporated herein by reference as if copied in their entirety Section 2. That the City Council hereby adopts an amended Map 2. Land Use Plan (Future Land Use Map) of the Comprehensive Master Plan for the area described as attached hereto as Exhibit "A" (which exhibit is incorporated herein by reference). Exhibit "A" amends this specific area of the former Future Land Use Map. Section 3. All future requests for zoning changes must be adopted in accordance with the revised Future Land Use Map pursuant to Section 211.004 of the Local Government Code, except as follows: For any legally compliant, existing land use which is not in accordance with the new Future Land Use Map, the owner(s) can apply for development permits (other than a change in zoning category) and make application for Conditional Use Permit(s) pursuant to the former Future Land Use Map. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall stay in full force and effect. Ordinance No. 2026-039 2 MP26-01 Section 5. The fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained. Section 6. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00) for each offense. Each day on which a reported violation is committed will be deemed a separate offense. Section 7. All ordinances or any parts thereof in conflict with the terms of this ordinance shall be and hereby are deemed repealed and of no force or effect.
