Purpose of Request:
The request (BZA26-10) is for the following variances and special exceptions to the Grapevine
Comprehensive Zoning Ordinance 82 -73: Section 43.E.3, Nonconforming Uses and Structures,
which allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a
nonconforming use, specifically to allow an existing residential dwelling to remain as developed.
The applicant is requesting variances to the following Subsections of Section 15., “R-7.5”, Single-
Family District Regulations: 15.F.2., Lot Size; 15.G.4., Width of Lot; and 15.G.5., Depth of Lot.
The applicant is also requesting special exceptions to the following Subsections of Section 15., “R -
7.5”, Single-Family District Regulations: 15.F.5., Maximum Impervious Surface Area ; 15.G.1.,
Depth of Front Yard ; 15.G.2., Depth of Rear Yard; and 15.G.3., Width of Side Yard on Each
Side.

PROJECT DESCRIPTION: BZA26 -10; 314 South Church Street - platted as Block 11, Lot 1A,
City of Grapevine . Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use. Submitted BZA
application for various special exceptions to Section 1 5 ., “R -7.5”, Single -Family District Regulations to
allow the existing dwelling to remain as developed with an increase in the maximum impervious coverage, a
reduction in the rear yard setback, and a reduction in front yard setback. BZA application also for various
variances to Section 15., “R-7.5”, Single -Family District Regulations “R-7.5”, Single -Family District
Regulations to allow a reduction in the minimum lot size, a reduction in the minimum lot depth, and a
reduction in the minimum lot width.
PLANNING SERVICES
Dimensional Control Site Plan – Sheet SP-1
• New Number the sheets in the lower right hand corner 1 of 3/site plan , 2of
3/floor plan and 3 of 3/elevations.
• New Remove the 5,050 sq. ft. from the title block and remove the electrical
legend. Up size the BZA requests, the site data table and the vicinity map.
• New provide a graphic and numeric scale.
• Label the 30 ft. front yard setback from the property line adjacent to South

• The purpose of BZA26-10 is for the following variance and special exception

2. Variance to Subsection G.4 to allow a lot width of 60 ft.
3. Variance to Subsection G.5 to allow a lot depth of 89 ft.
4. Special exception to Subsection F.5 to allow a maximum impervious
surface area of 3,651 sq. ft. or 68.2 %.
5. Special exception to Subsection G.1 to allow a 14 ft. encroachment into
the required 30 ft. front yard setback.
6. Special exception to Subsection G.2, to allow a 6.5 ft. encroachment into
the required 25 ft. rear yard setback.
7. Special exception to Subsection G.5, to allow a 1.5 ft. encroachment into
the required side yard 6 ft. side yard setback adjacent to the north
property line.
• To make the site plan more legible, increase the site plan and text size, and
reorient some of the text to match the north orientation of the site plan.

BACKGROUND INFORMATION:
The subject site is a portion of a previously platted 29,700 square-foot (0.6818-acre) lot
located within the Original Town of Grapevine Addition. The lot was originally platted in
1913, prior to the adoption of the city's first zoning ordinance in 1955, and was later
developed with a single-family dwelling in 1975. Although the residence was constructed in
1975, the lot was later split by deed in 2004, resulting in a non-conforming remainder,
described as the south 60 feet and the east 90.8 feet of Block 11, Lot 1A of the Original
Town of Grapevine Addition. The site was rezoned from “R-3”, Multiple-Family Dwelling
District to “R-TH”, Townhouse District in the 1984 City-wide Rezoning. Then in 2007
through a city-initiated rezone, Z2007-07/MP07-01, from “R-TH”, Townhouse District to “R-
7.5”, Single-Family District.
In May of 2025, City staff became aware of alterations to the single-family dwelling without
the required permits at which time staff informed the property owner that permits were
required. A building permit for the alterations has since been submitted to convert the
garage to additional living space. Through the requests, the applicant seeks to resolve the
nonconforming use by requesting variances and special exceptions to Zoning Ordinance
(82-73).
The application was submitted by Kevin Murrilo on behalf of the property owner.
REQUEST:
The applicant intends to renovate the interior of the existing 2,025 square foot residential
dwelling, and is requesting the following variances (Case No. BZA26-10A) from the
Grapevine Comprehensive Zoning Ordinance No. 82-73, for the subject site:
Subsection 15.F.2., Lot Size of Section 15 “R-7.5”, Single Family District, which requires a
minimum lot area of 7,500 square feet. The applicant is requesting a variance to allow a
minimum lot area of 5,353 square feet.
Subsection 15.G.4., Minimum Lot Width of Section 15 “R-7.5”, Single Family District,
which requires a minimum lot width of 65 feet. The applicant is requesting a variance to
allow a minimum lot width of 60 feet.

Subsection 15.G.5., Minimum Lot Depth of Section 15 “R-7.5”, Single Family District,
which requires a minimum lot depth of 100 feet. The applicant is requesting a variance to
allow a minimum lot depth of 89.20 feet along the north property line and minimum lot
depth of 89.28 feet along the south property line.
The following special exceptions are requested:
Subsection 15.F.5., Maximum Impervious Surface Area of Section 15 “R-7.5”, Single
Family District, which requires a combined area by all structures and paved areas not to
exceed 60% of the total lot area. The combined surface area of all improvements may not
exceed 60% or 3,211 square feet of the lot area. The proposed surface area is 68% or
3,651 square feet.
Subsection 15.G.1., Depth of Front yard of Section 15 “R-7.5”, Single Family District,
which requires a front yard depth of 30 feet. The existing residential structure is
approximately 16 feet from the east property line and encroaches approximately 14-feet
into the required front yard setback.
Subsection 15.G.2., Depth of Rear yard of Section 15 “R-7.5”, Single Family District,
which requires a rear yard depth of 25 feet. The existing residential structure is
approximately 22.5 feet from the west property line and encroaches approximately 2.50-
feet into the required rear yard setback.
Subsection 15.G.3., Depth of Side yard of Section 15 “R-7.5”, Single Family District,
which requires a side yard depth of 6 feet. The existing residential structure is
approximately 4.5 feet from the north property line and encroaches approximately 1.50-feet
into the required side yard setback.
ATYPICAL CONDITIONS:
Staff finds that atypical conditions exist for the requested variances (BZA26-10A) on this
property. Specifically, the subject property was platted in 1913 prior to the adoption of the
city's first zoning ordinance in 1955, and was subsequently developed with a single-family
dwelling in 1975. prior to the rezoning of the property in the 1984 City-wide Rezoning from
“R-3”, Multiple-Family Dwelling District to “R-TH”, Townhouse District. Then in 2007 through
a city-initiated rezone, Z2007-07/MP07-01, from “R-TH” Townhouse District to “R-7.5”,
Single-Family District. In 2012, the lot was split by deed by a previous owner, resulting in
the current configuration. Currently and as proposed, the site is not compliant with Zoning
Ordinance (82-73) relative to the following areas:
• Subsection 15.F.2., Lot Size of Section 15 “R-7.5”, Single Family District, which
requires a minimum lot area of 7,500 square feet. The lot exists today with a lot area
of 5,353 square feet.
• Subsection 15.G.4., Minimum Lot Width of Section 15 “R-7.5”, Single Family District,
which requires a minimum lot width of 65 feet. The lot exists today with a width of 60
feet.
• Subsection 15.G.5., Minimum Lot Depth of Section 15 “R-7.5”, Single Family District,
which requires a minimum lot depth of 100 feet . The lot exists with a lot depth of

89.20 feet along the north property line and a lot depth of 89.28 feet along the south
property line.
The requested special exceptions (BZA26-10B) on this property are a result of the same
circumstances outlined under the variance requests. Currently and as proposed, the site is
not compliant with Zoning Ordinance (82-73) relative to the following areas:
• Subsection 15.F.5., Maximum Impervious Surface Area of Section 15 “R-7.5”, Single
Family District, which requires the combined surface area of all improvements not
exceed 60% of the lot area;
• Subsection 15.G.1., Depth of Front yard of Section 15 “R-7.5”, Single Family District,
which requires a front yard depth of 30 feet;
• Subsection 15.G.2., Depth of Rear yard of Section 15 “R-7.5”, Single Family District,
which requires a rear yard depth of 25 feet; and
• Subsection 15.G.3., Depth of Side yard of Section 15 “R-7.5”, Single Family District,
which requires a side yard depth of 6 feet.
RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment:
Approve (BZA26-10A) variances to the Grapevine Comprehensive Zoning Ordinance 82-
73: Subsection 15.F.2., Lot Size of 5,353 square feet, Subsection 15.G.4., Minimum Lot
Width of 60 feet, and Subsection 15.G.5., Minimum Lot Depth of lot depth of 89.20 feet
along the north property line and a lot depth of 89.28 feet along the south property line as
shown on the plot plan.
Approve (BZA26-10B) special exceptions to the Grapevine Comprehensive Zoning
Ordinance 82-73: Subsection 15.F.5., Maximum Impervious Surface Area of 3,651 square
feet, Subsection 15.G.1., Depth of Front yard of 14-feet, Subsection 15.G.2., Depth of Rear
