The Building Board of Appeals for the City of Grapevine, Texas, met on Monday
evening, March 11, 2013, at 6 :00 P.M. in the Planning and Zoning Conference Room,
2nd Floor, 200 South Main Street, Grapevine, Texas, for a Briefing Session with the
following members present to wit:

constituting a quorum with Members Paul Biesiadny and Russell Kidd absent. Also

CALL TO ORDER
Chairman Joe Lipscomb called the Briefing Session of the Building Board of Appeals to
order at approximately 6:00 P.M.
NEW BUSINESS
Scott Williams briefed the Building Board of Appeals regarding the item scheduled to be
heard in the regular public hearing.
ADJOURNMENT
With no further discussion, the meeting was adjourned at approximately 6:10 P.M.

The Building Board of Appeals for the City of Grapevine, Texas, met in regular session,
Monday evening, March 11, 2013, at 6:15 p.m., in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas with the following members present:

CALL TO ORDER
Chairman, Joe Lipscomb called the Public Hearing to order at approximately 6:15 p.m.
PUBLIC HEARIN
BUILDING BOARD OF APPEALS TO CONSIDER BUILDING BOARD OF APPEALS
CASE BBA13 -01, KAREN RENE TOWELL.
The Building Board of Appeals considered BBA13 -01 submitted by property owner
Karen Rene' Towell for property located at 512 West Hudgins Street, legally described
as Lot 7, Block 1, Grapevine Towhouse Addition. The request was to Grapevine Code
of Ordinances, Chapter 7, Article IV, Fences:
Section 7 -127, Fences, Front Yard Requirements, requires fences constructed in
a required or established front yard to be 36 inches or less in height, and have at
least 50 percent through vision.
Scott Williams explained that Staff recommended the Building Board of Appeals
approve the applicant's request for approval of a six -foot (6') tall wood fence within the
required and established front yard as shown on the site plan.
Mr. Williams explained that Staff found a special condition existed for the request.
Specifically, the unusual orientation of the front yard was such that it appeared as, and
functioned as, a rear yard.
He stated that the main entry into the townhome subdivision was actually a private
access drive, and not a public access easement. Therefore to obtain frontage on a
public street the properties were each platted as a "flag lot" with a narrow strip of land
that connected with Hudgins Street. By definition this created the "front yard ".
However, for all intents and purposes (at least for the lots on the west side of the private
drive) this front yard appeared as, and functioned as, a rear yard.
He further stated that the fence would not extend the full extent of the applicant's rear
property line. The request for the six -foot (6) tall fence only extended approximately
one half the depth of the yard, replacing the fence in its current location.
With no questions for Mr. Williams, Karen Rene' Towell of 512 West Hudgins Street,
Grapevine, Texas, took the Oath of Truth; she gave a brief presentation, provided
photos to the Board and requested favorable consideration of her request and offered
to answer any questions of the Board.
With no further questions for Mr. Williams or Ms. Towell, Mr. John Glover, of 514 West
Hudgins Street, Ms. Mary Hoffmann of 508 W. Hudgins Street, and Ms. Beate Eggerton
of 516 West Hudgins Street. Mr. Glover addressed the Board for the group, he stated
their concerns and requested the Board respect the opinion of the majority and deny
the variance requested.
Ms. Hoffman stated that they had spent a lot of time and money cultivating the open
area behind their homes. Since West Hudgins Street would eventually be extended
they had hoped that as a group they would come to a mutual understanding whether or
not to fence in the entire area, but had wanted to postpone that decision until the road
had actually been constructed.
Ms. Eggerton stated she has been a realtor in the area since 1989; she was involved
with the original owner in the selling of several of the units. She explained that the deck
at Mr. and Mrs. Hoffman property had been constructed by the builder. Ms. Eggerton
stated that she felt that Ms. Towell knew what she was getting; nothing had been added
to any of the properties since Ms. Towell had purchased her property. She further
stated that any changes to the property had always been discussed by the nine (9)
property owners and was disappointed that Ms. Towell did not want to follow along with
the group's sentiment.
Jerrold Sklar asked if they had discussed with Ms. Towel what options the group would
be open to. Ms. Eggerton stated that Ms. Towell had not communicated with them, she
had been communicating with Mr. John Matson, acting secretary for the group; he was
responsible for financial issues, organized the mowing and maintenance of the
property. Mr. Glover stated that since the previous meeting any attempts to
communicate with Ms. Towell had been met with hostility and detrimental e- mails.
With no further questions for Ms. Towell, and no additional speakers, Hal Hardister
made a motion to close the public hearing. Jerrold Sklar seconded the motion which
prevailed by the following vote:
Ayes: Lipscomb, Sklar, Hallman, Hardister, Young
Nays: None
Absent: Biesiadny, Kidd

Clint Hallman made a motion that a special condition existed. Specifically, the unusual
orientation of the front yard was such that it appeared as, and functioned as, a rear
yard. Hal Hardister seconded the motion which prevailed by the following vote:
Ayes: Lipscomb, Hallman, Hardister, Young
Nays: Sklar
Absent: Biesiadny, Kidd
Clint Hallman made a motion to approve the variance to Section 7 -127, Fences, Front
Yard Requirements, allowing the construction of a six -foot (6') tall wood fence not to
exceed the setback of the existing fence location within the required and established
front yard as shown on the site plan. Rex Young seconded the motion which prevailed
by the following vote:
Ayes: Lipscomb, Hallman, Hardister, Young
Nays: Sklar
Absent: Biesiadny, Kidd
MINUTES
Next for the Board to consider was the minutes of the February 11, 2013 Briefing
Session and Public Hearing.
Jerrold Sklar made a motion to accept the minutes of the February 11, 2013 Briefing
Session and Public Hearing. Rex Young seconded the motion which prevailed by the
following vote:
Ayes: Lipscomb, Sklar, Hallman, Hardister, Young
Nays: None
Absent: Biesiadny, Kidd
ADJOURNMENT
With no further discussion, Jerrold Sklar made a motion to adjourn. Rex Young
seconded the motion, which prevailed by the following vote:
Ayes: Lipscomb, Sklar, Hallman, Hardister, Young
Nays: None
Absent: Biesiadny, Kidd
The meeting was adjourned at approximately 6:35 p.m.
