On Tuesday evening, May 16, 2017 at 7:30 P.M. in the City Council Chambers, 2nd Floor,
200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning
Commission of the City of Grapevine will hold a public hearing to consider the following items:
CU17-07 —Shipley Donuts — submitted by M J Wright & Associates far property located at
604 East Northwest Highway and platted as Lot 8, Block 1, Wall Street Township. The
applicant is requesting to a conditional use permit to allow outdoor speakers and drive
through service in conjunction with a restaurant. The property is currently zoned "HU
Highway Commercial District and is owned by Wall Street Township.
CU17-08 — Bricks & Minifigs — submitted by Scott Zachary for property located at 2030
West Glade Road #220 and platted as Lot 8R, Block 1, Mulberry Square. The applicant is
requesting a conditional use permit to amend the previously approved site plan for a
planned commercial center, specifically to allow for retail sales of secondhand goods in an
enclosed building where the size of the space exceeds 3,000 square feet in area. The
property is zoned "CC" Community Commercial District and is owned by JAHCO Vineyard
LLC.
HL17-01 - 523 East Texas Street — submitted by Copper Street Homes for property
located at 523 East Texas Street and platted as Lot 6, Block 104, College Heights. The
applicant is requesting designation as a historical landmark sub -district. Such sub -district
may include buildings, land, areas, or districts of historical, architectural, archaeological or
cultural importance or value that merit protection, enhancement, and preservation in the
interest of the culture, prosperity, education, and welfare of the people. The property is
zoned R-7.5 Single Family District and is owned by LEM Rental Properties LLC.
AM17-01 - AMENDMENTS TO COMPREHENSIVE ZONING ORDINANCE 82-73 - The
City Council and the Commission will consider amendments and changes to the
Comprehensive Zoning Ordinance, No. 82-73, same being Appendix D of the Code of
Ordinances as follows: Section 60, Sign Regulations relative to converted digital billboards
and any other additions, deletions, or changes to various sections, articles and provisions
contained in said Ordinance No. 82-73.

APPLICANT: Copper Street Homes
PROPERTY LOCATION AND SIZE:
The subject property is located at 523 East Texas
Street and platted as Lot 6, Block 104, College
Heights Addition.
REQUESTED HISTORIC LANDMARK SUBDISTRICT AND COMMENTS:
The applicant is requesting a Historic Landmark Subdistrict designation for property located
at 523 East Texas Street and platted as Lot 6 Block 104 College Heights Addition
The Historic Preservation Commission, at their March 22, 2017 meeting, adopted the
preservation criteria for the subject property. CA17-12 was approved March 22, 2017 to
demolish the existing structure and construct a new residence as per the attached plans.
The house was built in 1945. The house is not a contributing structure to Grapevine's
College Heights Addition.
In 1945, Mr. Arthur Bennett (A.B.) Allen acquired this property from Mrs. Mann Tice, a
rental property owner of a number of homes on this block. He owned this property on
Texas Street for eight years after which he sold it to Mrs. Bertie Foster. "Grapevine's Most
Unforgettable Characters" book records that A. B. and his daughter lived in a house on
West Franklin Street; it is not likely they resided here. In 1948, when the Grapevine Dam
and Reservoir were being constructed, A. B. purchased three houses and had them moved
from the lake area into Grapevine where he restored them and used them as rental
properties along with other properties he had purchased.
A.B. was the last Grapevine Nightwatchman and the first unofficial chief of police. In 1960,
he married Laura Thomas, the City's first police and fire dispatcher. A.B. was active in the
Volunteer Fire Department and the Lions Club. In later years, he served as Court Judge in
Grapevine. He lived a modest lifestyle, met many challenges, was civic minded and an
entrepreneur. A. B. Allen died at age 84 in 1978.
The house has been heavily altered over time and it is difficult to ascertain its original
appearance or style of design. It appears to have been a small house and shed structure
that were later combined into one building with additions added. It has various types of
foundations under the one barn -like roof. The current condition of the house is one of
extreme structural failure. The floor system of the house has collapsed and failed with up
to 12 inches of variation of the floor height. Some roof trusses appear to have collapsed.
The structure does not appear to have sufficient integrity to be lifted or moved. The house
is located 4'-9" from the exterior wall of the neighboring structure to the west.
PRESENT ZONING AND USE:
The property is currently zoned "R-7.5" Single Family Residential and is currently a
residential structure.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject property and the surrounding properties to the north, south, east, and west
were zoned "R-1" Single Family District prior to the 1984 City Rezoning.

The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.

Staff recommends the Historic Preservation Commission approve the proposed Historic
Landmark Subdistrict overlay to the Grapevine Historic Preservation Ordinance 91-73
(Appendix G — Grapevine Code of Ordinances), as amended for following properties
addressed as:
1. 523 East Texas Street, legally described as Block 104, Lot 6, College Heights Addition
BACKGROUND:
On February 6, 2017, applicant Neal Cooper submitted an application for Historic Landmark
overlay #HL17-01, for property located at 523 East Texas Street, City of Grapevine. The
house was built in 1945. The house is not a contributing structure to Grapevine's College
Heights Addition.
In 1945, Mr. Arthur Bennett (A.B.) Allen acquired this property from Mrs. Mann Tice, a rental
property owner of a number of homes on this block. He owned this property on Texas Street
for eight years after which he sold it to Mrs. Bertie Foster. "Grapevine's Most Unforgettable
Characters" book records that A. B. and his daughter lived in a house on West Franklin
Street; it is not likely they resided here. In 1948, when the Grapevine Dam and Reservoir
were being constructed, A. B. purchased three houses and had them moved from the lake
area into Grapevine where he restored them and used them as rental properties along with
other properties he had purchased.
A.B. was the last Grapevine Nightwatchman and the first unofficial chief of police. In 1960,
he married Laura Thomas, the City's first police and fire dispatcher. A.B. was active in the
Volunteer Fire Department and the Lions Club. In later years, he served as Court Judge in
Grapevine. He lived a modest lifestyle, met many challenges, was civic minded and an
entrepreneur. A. B. Allen died at age 84 in 1978.
The house has been heavily altered over time and it is difficult to ascertain its original
appearance or style of design. It appears to have been a small house and shed structure
that were later combined into one building with additions added. It has various types of
foundations under the one barn -like roof. The current condition of the house is one of
extreme structural failure. The floor system of the house has collapsed and failed with up to

12 inches of variation of the floor height. Some roof trusses appear to have collapsed. The
structure does not appear to have sufficient integrity to be lifted or moved. The house is
located 4'-9" from the exterior wall of the neighboring structure to the west.
Staff recommends approval of the Historic Overlay #HL17-01 to record the history of the
property and to allow the Historic Preservation Commission to have input in the future
development of the property. A set of the proposed design guidelines for the property are
attached.

Preservation Commission approval for Historic Landmark Overlay #HL17-01 for the

Heights Addition, Grapevine, Texas.
An application was filed for the Commission to hold a public hearing relative to a request
for Certificate of Appropriateness #CA17-12 for demolition and new construction for the
property at 523 East Texas Street.
A public hearing regarding this application will be held by the Historic Preservation
Commission on Wednesday, March 22, 2017 at 6:00 PM, in the Grapevine City Hall,
2nd Floor Council Chambers, 200 South Main Street, Grapevine, Texas 76051.
Appendix G, Section 7.(C) of the Grapevine City Code requires that the Commission shall
deny, approve, or approve with conditions any Certificate of Appropriateness application
within 30 days of receipt of a completed application, determining whether the proposed
work is consistent with the regulations contained in this ordinance, in all applicable
ordinances, and in the zoning ordinance designating the Historic Landmark Districts. Upon
posted notice, and notification by regular mail at least five (5) days in advance to the
immediately adjacent property owners as that ownership appears on the last approved tax
roll, the Commission shall conduct a public hearing on the application, at which time an
opportunity is provided for proponents and opponents of the application to present their
views.
If you cannot or do not wish to attend the public hearing, the attached form is
