This report was performed in general accordance with the executed authorization to perform asbestos survey services dated October 26, 2016. Summary of Findings The results of the laboratory analysis determined none of the tested suspect asbestos containing building material contained greater than 1% asbestos — the threshold level of state and federal regulatory compliance. The following suspect asbestos containing building material identified within the scope of the survey and not tested, as the material was not accessible without breaking the mirrors, is assumed to contain greater than 1% asbestos —the threshold state and federal regulatory compliance. A Supplemental Asbestos Survey is planned in the future, during renovation, that will test the adhesive: • Mirror adhesive (Fitness Center 900sf) Asbestos containing material containing greater than 1% asbestos may only be disturbed or removed by properly licensed and trained asbestos abatement contractors or other regulated processes. Project Scope The survey includes the interior floors, walls, and ceilings of Survey Area A — Spa / Fitness Renovation Area within the building as denoted by the Site Layout and Material locations Diagram within this report. The survey does not include the remainder of the facility. Facility Description The multi-level building includes exterior masonry walls, metal frame windows and doors, interior framed walls, and a flat roof on a concrete slab foundation. Survey Area A — Spa / Fitness Renovation Area The floor system includes carpet, resilient, and ceramic flooring. The floor is penetrated for plumbing systems. The interior wall system includes frame construction, fiberglass insulation, gypsum panel, texturing compound, wall tile, wall covering, fiberglass reinforced panels, wall covering, and wall base. The ceiling system includes frame construction, gypsum panel, texturing compound, paint, and lay -in acoustical ceiling panels dropped in a metal grid. The roof deck area includes metal wood construction with metal wood decking. The HVAC system includes flex and metal ducting with fiberglass insulation and standard metal registers and plenums with no observable suspect thermal insulation or wraps. The plumbing system has no observable suspect thermal insulation or wraps. Field Inspection Asbestos Inspectors, Inc. conducted an Asbestos Survey of the above referenced property. The survey was conducted by Stuart McBurnett DSHS licensed Asbestos Management Planner (license number 205494). The survey included observation of the space and collection of bulk samples of suspected asbestos containing building materials (ACBM), which could be impacted by renovation and/or demolition activities. Load bearing wall demolition or asbestos abatement activities cannot commence until ten (10) working days after notification is provided to the Texas Department of State Health Services Asbestos Division. The bulk samples were collected in a manner which reduced the potential for fiber release and exposure. The bulk samples were placed in secure containers and appropriate chain -of -custody protocols were initiated at this time. The bulk samples were transported to EMSL Analytical Inc Crisp Analytical Laboratory for laboratory analysis. EMSL Analytical Inc Crisp Analytical Laboratory is licensed and authorized by the DSHS as an asbestos laboratory and is accredited by the National Voluntary Laboratory Accreditation Program (NVLAP) and the American Industrial Hygiene Association (AIHA) for selected test methods for bulk asbestos fiber analysis (PLM) and airborne fiber analysis (TEM). Regulated asbestos -containing material (RACM) - (a) Friable asbestos material, (b) Category I nonfriable ACM that has become friable, (c) Category I nonfriable ACM that will be or has been subjected to sanding, grinding, cutting, or abrading, or (d) Category II nonfriable ACM that has a high probability of becoming or has become crumbled, pulverized, or reduced to powder by the forces expected to act on the material in the course of demolition or renovation operations regulated by this subpart. Alternatives for Treatment of Asbestos Containing Materials A public building owner has the following regulated options for the removal or the management of ACBM asbestos inspectors 214-520-2897 • fax 214-520-0287 • www.asbestosinspectors.com • P.O. Box 195014 • Dallas TX 75219 found in their building: • Removal (abatement) —This option is the most permanent solution for the treatment of ACBM. It involves the use of regulated methods in the removal and disposal of the ACBM. Removal requires the use of a state licensed Asbestos Contractor under the control of a licensed Asbestos Consultant with appropriate air monitoring and project management or other federally regulated process. With the exception of certain Category I and II asbestos containing roofing materials and floor tile, all asbestos containing materials must be removed prior to renovation or demolition that would result in a disturbance. Removal of Roofing Materials — When a rotating blade roof cutter or equipment that similarly damages the roofing material is used to remove Category I or II non -friable asbestos -containing roofing material, the removal of 5,580sf or more of asbestos -containing roofing material will create at least 160sf of RACM and is subject to the National Emission Standards for Hazardous Air Pollutants (NESHAP) 40 Code of Federal Regulations (CFR) Part 61, Subpart M, 61.145(a). If the material removed in this manner is less than 5,580sf then the removal is not subject to the NESHAP, except that notification is always required for demolitions. When the removal of Category I or II non -friable asbestos -containing roofing material or other exterior materials is at least 160sf and the removal methods will crumble, pulverize, reduce to powder, or contaminate with other RACM, the removal is subject to the NESHAP and TAPHR. When the removal of Category I or 11 non -friable asbestos -containing roofing material or other exterior materials is less than 160sf or 2601f then the removal is not subject to NESHAP or TAPHR. However, notification is always required for demolition project. • Removal of Vinyl Floor Tile - The floor tile and mastics may be removed by a state licensed Asbestos Abatement Contractor or by a qualified contractor using the Resilient Floor Covering Institute's (RFCI) Recommended Work Practices for Removal of Resilient Floor Covering (issued by the Resilient Floor Covering Institute, 401 East Jefferson Street, Suite 102, Rockville MD 20850) http://www.rfci.com/int_ARF-Techinfo.htm. This method involves careful removal of the floor tiles and use of specialized solvents to remove the mastics from the concrete sub floor. All removed materials and solvents would be transported and disposed of in an appropriate asbestos landfill. If the floor tile does not contain greater than 1% asbestos, then it can be removed and treated as non -asbestos containing building material. However, the mastics will continue to be treated as asbestos containing building material for removal purposes. The RFCI method is slower and more labor intensive method than the contained abatement method. However, no barrier containment, negative air pressure filtration, or air monitoring is required, thus saving setup costs and other professional services. If done incorrectly, the RFCI method would have to be halted and a decontamination and non-RFCI state -licensed asbestos abatement begun. • Management - According to state regulation, the ACBM does not have to be removed as long as the asbestos inspectors 214-520-2897 • fax 214-520-0287 • www.asbestosinspectors.com • P.O. Box 195014 • Dallas TX 75219 ACBM is undisturbed and undamaged. For instance, the ACBM may not be subject to drilling or suffer erosion. It may be also be possible to cover the ACBM with another material without disturbing the ACBM, and to allow planned renovations to go forward without an asbestos abatement. • Management - Operations and Maintenance Program - An Operations and Maintenance (O&M) Plan may be written describing appropriate actions for surveillance and management of asbestos -containing material, including a manual that records the O&M activities in the public building as long as the asbestos remains in place. The 0&M Plan identifies the location of ACBM, recommends maintenance methodologies to avoid disturbing the ACBM, and chronologically logs all ACBM-related maintenance activities. Estimated costs for developing an Operations and Maintenance Plan have not been determined and are not considered within the scope of this assignment, however please contact us for additional information regarding this issue. • Management - Encapsulation — This option is a temporary solution which utilizes specialized bonding products that seal the ACBM to prevent asbestos fiber release. The encapsulated ACBM is best suited to stable, undamaged, and unexposed conditions. An Operations and Maintenance (O&M) Plan documenting periodic inspections will ensure the ACBM has suffered no further damage or deterioration. • Management - Enclosure — This option is a temporary solution in which involves surrounding the ACBM with an airtight sealed containment barrier to prevent asbestos fiber release. An Operations and Maintenance (0&M) Plan documenting periodic inspections will ensure the ACBM has suffered no further damage or deterioration. General Recommendations Please consider that any current or future renovation activity may require an Operations and Maintenance Plan to assist in ensuring that no new asbestos containing building materials are introduced into the building, thus facilitating future commercial permitting requirements. It is recommended that property owners, occupants, employees or maintenance workers are notified of the presence, location and condition of the ACM, if present, and the need to avoid the disturbance of these materials, and the potential health hazards relating to asbestos. Limitations Asbestos Survey reports are based on field investigations and analysis of selected samples that were assumed representative of the material within the structure. Parties: Asbestos Inspectors, Inc. (AI) refers to the firm performing the Scope of Services described herein and detailed in the attached Al Proposal. "Client" refers to the person or business entity ordering the Scope of Services to be performed by Al. if the Client is ordering work on the behalf of another entity, Client represents and warrants that it is the duly authorized agent of the party that will benefit from the work. Client shall communicate these General Terms and Conditions to any third party to whom Client transmits any part of Al's work. Client agrees to indemnify, defend and hold Al, its officers, employees and agents harmless from any and all claims, suits, losses, costs and expenses, including but not limited to, court costs and reasonable attorney's fees in the event that all such reviews, tests, and inspections are not so performed or AI's recommendations are not so followed except to the extent that such failure is the result of the negligence, willful or wanton act, or omission of Al, its officers, agents or employees. 4. Scheduling of Service: The services set forth in the Proposal will be accomplished in a timely, workmanlike and professional manner by Al personnel or authorized subcontractors. If Al is required to delay commencement of work or if, upon undertaking work, AI is required to halt work due to changes in the scope of services, interruptions in other aspects of the Project, or other causes beyond the reasonable control of Al additional charges may be applicable and payable by the Client. S. Access to the Property: Client will provide Al with access to the work site to perform the services. Al shall take reasonable measures to minimize damage to the site and any improvements as the result of its work; however, Al has not included in its fee the cost of restoration of damage which may occur during the course of its work. 6. Damage to Existing Man -Made Objects: Unless AI assumes in writing the responsibility of locating subsurface or latent conditions, Client agrees to indemnify and save Al harmless from all claims, suits, losses, cost and expenses, including reasonable attorney's fees as a result of personal injury, death or property damage occurring with respect to AI's performance of its work and arising from subsurface or latent conditions, or damage to subsurface or latent objects, structures, lines or conduits where the actual presence and location thereof was not revealed to Al by the Client. 7. Confidentiality: If during the Project, Al and its employees obtain, directly or indirectly, secret and confidential information considered proprietary by Client, Al agrees, on behalf of itself and its employees, to maintain the confidentiality of information formally designated as proprietary by the Client unless directed by Client in writing to disclose the information to others. 8. Responsibility: AI's work shall not include determining or implementing the means, methods, techniques, sequences or procedures of construction. Al will not be responsible for evaluating, reporting or affecting job conditions relative to the health, safety or welfare of any persons other than its own employees. Sample Disposal: Unless otherwise agreed, test specimens or samples may be disposed of immediately upon completion of the test. All drilling samples or specimens will be disposed of sixty (60) days after submission of AI's report. All archeological samples will be returned to the Client for permanent curation following submittal of AI's final report. 10. Payment: Client shall pay upon receipt of the report unless other arrangements have been agreed upon in writing. Client agrees to pay Al's cost of collection of all amounts due and unpaid after sixty (60) days, including court costs and reasonable attorney's fees. Remedies available to Al for collection of amounts due, including mechanic's liens, shall not be limited to any contractual provision or other agreement that is not specifically made a part of this Agreement. 11. Termination: This Agreement may be terminated by either party upon five (5) business days' prior written notice. In the event of termination, Al shall be compensated by Client for all services performed up to and including the termination date, including reimbursable expenses, and for the completion of such services and records as are necessary to place AI's files in order and/or protect its professional reputation. 12. Warranty: AI's services will be performed, its findings obtained, and its reports prepared in accordance with the Proposal which has been mutually agreed upon as well as these General Terms and Conditions. In performing its professional services, Al will strive to perform services under these General Terms and Conditions in a manner consistent with the level of care and skill ordinarily exercised by members of the profession currently practicing in the same locality under similar conditions. This warranty is in lieu of all other warranties, either express or implied. Should Al, or any of its professional employees, be found to have been negligent in the performance of professional services or to have breached the express warranty made herein, Client and all third parties claiming through Client agree that the maximum aggregate liability of Al and its employees shall be limited to $50,000.00 or the amount of the fee paid to AI for professional services with respect to the Project, whichever amount is less. In the event Client does not agree to restrict professional liability to $50,000.00 or to the total amount of the fee paid to Al with respect to the Project, whichever is less, Client agrees to pay for the actual cost of the additional desired insurance coverage, if such insurance is available. 13. Insurance and Indemnity: Al agrees to carry the following liability insurance: Statutory Workers' Compensation and Employers' Liability, Comprehensive General Liability, and Professional Environmental Consultant's Liability. Al will furnish certificates of insurance upon request. To the extent of the coverage limits maintained by Al and subject to the exclusions therein and the amount of the claims paid by such insurance, Al agrees to indemnify and hold Client harmless from all losses, claims, demands, causes of action, and suits arising out of the willful or negligent acts of Al, its officers, agents, employees, or subcontractors, in performing professional services at the worksite. If Client specifically requires additional insurance coverage, Al will obtain the specific insurance coverage (if procurable) at Client's expense. Al does not indemnify the Client for damage arising out of Client's independent use of Al data, advice, recommendations and reports. 14. Agreement to Arbitrate: All disputes related directly or indirectly to any aspect of this contract, work related to this contract, or to any matter in this contractual relationship, shall be arbitrated pursuant to and by the American Arbitration Association in Dallas, Texas. 15. Priority of Documents: These General Terms and Conditions, together with the Proposal Acceptance Notification and associated documents, shall control over any conflicting provisions with purchase orders, work orders, letters of intent, or other similar documents. 16. Applicable Law: These General Terms and Conditions shall be governed by and construed according to the laws of the State of Texas.
