HomeMy WebLinkAboutItem 20 - Police Tahoe MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: JUNE 20, 2017 SUBJECT: APPROVAL OF A RESOLUTION AND APPROPRIATION ORDINANCE FOR THE PURCHASE OF A POLICE TAHOE RECOMMENDATION: City Council to consider approval of a resolution for the purchase of a police Tahoe from Caldwell Country through an interlocal agreement with The Local Government Purchasing Cooperative (BuyBoard), and adoption of an appropriation ordinance for the funding of the purchase. FUNDING SOURCE: Funding for this purchase comes from insurance proceeds received from One Beacon resulting from the total loss of an existing vehicle. Upon approval of the attached appropriation ordinance, funding will be available in account 325-48910-209-01-170001 in an amount not to exceed $33,236. BACKGROUND: This purchase is to replace a 2016 police pursuit Tahoe that was totaled in an accident on May 5, 2017 with a new 2017 PPV Tahoe. Insurance funds will replace the vehicle. All emergency equipment was salvaged and will be installed on the new vehicle. This purchase will be made in accordance with an existing interlocal agreement with The Local Government Purchasing Cooperative (BuyBoard) as allowed by Texas Local Government Code, Chapter 271 and Texas Government Code, Chapter 791. Bids were taken by the Cooperative and a contract was awarded to Caldwell Country. The Fleet Services and Purchasing staff reviewed the contract for departmental specification compliance and pricing and determined that the contract would best meet the needs of the City. Staff recommends approval. 1 PH/BS 1 i RESOLUTION NO. 2017-062 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AUTHORIZING THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE TO PURCHASE A POLICE TAHOE THROUGH AN ESTABLISHED INTERLOCAL AGREEMENT AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas is a local government in the State of Texas and as such is empowered by the Texas Local Government Code, Chapter 271 and Texas Government Code, Chapter 791 to enter into an interlocal agreement with other qualified agencies in the State of Texas; and WHEREAS, The Local Government Purchasing Cooperative (BuyBoard) is a qualified purchasing cooperative program as authorized by Texas Local Government Code, Chapter 271 and Texas Government Code, Chapter 791; and WHEREAS, the City of Grapevine, Texas has established an interlocal agreement with The Local Government Purchasing Cooperative (BuyBoard) and wishes to utilize established contracts meeting all State of Texas bidding requirements; and WHEREAS, The Local Government Purchasing Cooperative (BuyBoard) has an established contract no. 521-16, Vehicles, Heavy Duty Trucks, Police Motorcycles, Parts, and Service Labor with Caldwell Country; and WHEREAS, the City of Grapevine, Texas has a need to replace a police Tahoe; and WHEREAS, all constitutional and statutory prerequisites for the approval of this resolution have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this resolution to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council of the City of Grapevine authorizes the purchase of a police Tahoe from Caldwell Country through an interlocal agreement with The Local Government Purchasing Cooperative (BuyBoard) for an amount not to exceed $32,715.00. Section 3. That the City Manager or his designee is authorized to take all steps necessary to consummate the purchase of said police Tahoe. Section 4. Boyle, Jr. City Attorney I I Resolution No. 2017-062 2 I ORDINANCE NO. 2017-039 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, APPROPRIATING $33,236 FROM THE CAPITAL EQUIPMENT/MACHINERY PURCHASE FUND; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas has a need to replace a police Tahoe; and WHEREAS, funding for the purchase of the Tahoe is not currently included in the Capital Equipment/Machinery Purchase Fund, and WHEREAS, the City of Grapevine, Texas received insurance proceeds in the amount of$33,236 resulting from the total loss of a police vehicle involved in an accident; and WHEREAS, all constitutional and statutory prerequisites for the approval of this resolution have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this ordinance to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this ordinance are true and correct and are hereby incorporated into the body of this ordinance as if copied in their entirety. Section 2. That the City Council hereby authorizes the purchase of a new Police Tahoe utilizing the funds received from insurance proceeds. Section 3. That the City Council appropriates $33,236.00 to the Capital Equipment/Machinery Purchase Fund. Section 4. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection, word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 5. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, 4 and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
