HomeMy WebLinkAboutZ2017-04MEMO TO: HONORABLE MAYOR, CITY COUNCIL MEMBERS AND MEMBERS OF THE PLANNING AND ZONING COMMISSION FROM: BRUNO RUMBELOW, CITY MANAGER SCOTT WILLIAMS, DEVELOPMENT SERVICES DIRECTOR e-1 MEETING DATE: JUNE 20, 2017 SUBJECT: ZONING CHANGE Z17-04—RELEASE OF DEED RESTRICTIONS RECOMMENDATION: Staff recommends the Planning and Zoning Commission and the City Council consider the attached ordinance relative to the "release of deed restrictions" for property formerly referred to as the H/A Grapevine Joint Venture and take any other action necessary. BACKGROUND INFORMATION: In August of 1995 as part of a large multi -tract rezoning request in the northeastern corner of Grapevine bounded generally by State Highway 121, F.M 2499 and the city limit lines of the Town of Flower Mound and the City of Coppell, approximately 220 undeveloped acres were rezoned to "R -MF -1" and "R -MF -2" Multifamily District, "CC" Community Commercial District, and "BP" Business Park District. Deed restrictions were included as part of the zoning request to limit the total number of multifamily units that could be built within the prescribed area, provide for noise reduction and require central air conditioning within any multifamily structures. A "Master Utilities" agreement was also included establishing a cost sharing relationship between the property owner(s) and the city relative to utility construction/improvements within the defined area. With the city's purchase of the 185 acres and the most recent purchase of the James Tract, the attached deed restrictions are no longer necessary and all infrastructure improvements relative to the original agreement have been made. See the attached ordinance that will rescind (release) the deed restrictions as described. O:\ZCU\2017\Z17-04.4.docZ17-04.4 6/12/2017 3:01:13 PM RELEASE OF DEED RESTRICTIONS STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTIES OF DALLAS And TARRANT THIS RELEASE OF DEED RESTRICTIONS is effective as of the 20th day of June, 2017, and is made by the CITY OF GRAPEVINE, TEXAS and permanently and completely removes the prior Deed Restrictions set for in the document entitled "Deed Restrictions" dated on the 151' day of August 1995 and filed in the Tarrant County, Texas deed records at volume 12071 page 0974 (hereinafter "Deed Restrictions"), for the property situated in Dallas and Tarrant Counties as recorded in Volume 94124, Page 2000 of the Deed Records of Dallas County, Texas. Recitals A. Whereas, the Deed Restrictions provided for certain restrictions, to wit: B. Whereas, the restrictions listed in the Deed Restrictions are as follows: "1. The Maximum number of multiple family dwelling units on the Property shall be limited to 2,007 dwelling units. 2. Central air conditioning shall be used in the construction of the units. 3, The building shell shall provide a noise level reduction (NLR) of at least 25 dBA. 4. A noise consultant reasonably acceptable to Owner and City shall be employed by Owner to certify that the plans for construction of the dwelling units meets the foregoing NLR standard. 5. The City and the owner agree to construct H/A Grapevine Master Utilities Project (the "Utilities Project") in accordance with the plans and specifications prepared by Kimley-Horn and Associates, Inc. dated August 1, 1995 approved by the City. The Owner agrees to place the sum of $500,000 in a special account established by the City to offset a portion of the City's participation in construction of the Utilities Project. The timing of such deposit as well as the details of the cost sharing provision of the owner and the City to construct the Utilities Project are contained in a separate Contract and Agreement between the parties. The funds placed in the account shall be used solely to pay for the cost of construction said Utilities Project." C. Whereas, said restrictions, as set forth in the Deed Restrictions document were and are for the sole and exclusive benefit of the City of Grapevine, Texas and the City of Grapevine, Texas has the sole and exclusive ability to enforce said restrictions. D. Whereas, the Deed Restrictions provide the sole and exclusive method for altering, amending or terminating the restrictions and sets forth those requirements as follows: "These restrictions shall not be altered, amended or terminated without a public hearing before the City Plan Commission and the City Council of the City of Grapevine. Notice of such public hearing shall be given as would be required by law for a zoning change on the property described herein. The City Manager, or designee, through authorization by majority vote of the City Council of the City of Grapevine, Texas, and H/A Grapevine Joint Venture, its successors or assigns must sign a document to be filed in the Deed Records of Tarrant County, Texas approving the amendment or termination of these Deed Restrictions." Whereas, a "Release of Obligations Under Deed Restrictions and Letter Agreement" ("Release") was filed in the Tarrant County, Texas Deed Records at Volume 0014834 Page 00386, said Release providing that all requirements and obligations under paragraph 5 of the Restrictions had been satisfied. F. Whereas, the City of Grapevine held public hearings before the City Plan Commission (also referred to as the Planning and Zoning Commission) and the City Council on June 20, 2017, after providing notice for said public hearings as would be required by law for a zoning change on the property. G. Whereas, after said hearings, the City Council of the City of Grapevine voted to terminate restrictions 1-4 set forth above, and ordered that this Deed of Release be filed in the Deed Records of Tarrant County, Texas providing full notice of the complete termination and removal of restrictions 1-4 as set forth above. NOW, THEREFORE: SECTION ONE: That all of the above is found to be true and correct. SECTION TWO: That the City of Grapevine has full complete authority to alter, Amend, or terminate the restrictions in the manner set forth in the Deed Restrictions document, and that the City of Grapevine followed said procedures and the City Council voted to remove restrictions 1-4 as set forth above. SECTION THREE: That said restrictions 1-4 are hereby terminated, removed, and released, and that this release pertains to all the real property affected by the Restrictions and as more fully described in Exhibit "A-1" attached hereto and incorporated herein for all purposes. Notice of such public hearings shall be given as would be required by law for a zoning change on the property described herein. The City Manager, or designee, through authorization by majority vote of the City Council of the City of Grapevine, Texas, and HIA Grapevine Joint Venture, its successors or assigns must sign a document to be filed in the Deed Records of Tarrant County, Texas, approving the amendment or termination of these Deed Restrictions. The restrictions contained herein are not in any manner intended to restrict the right of the City Council of the City of Grapevine to exercise its legislative duties and powers insofar as zoning of the property is concerned. These restrictions inure to the benefit of the City of Grapevine, and the City of Grapevine does hereby reserve the right to prosecute, at law and in equity, against the person violating or attempting to violate such restrictions, either to prevent him from so doing and to correct such violation and for further remedy, the City of Grapevine may withhold the Certificate of Occupancy necessary for the lawful use of the property until such restrictions described herein are fully complied with.
