following case:

The Board approved the following request

CALL TO ORDER
Chairman Holt called the Public Hearing Session of the Board of Zoning Adjustment to
order at approximately 6:15 P.M.
FRANKLIN STREET
The first item for the Board of Zoning Adjustment to consider was BZA16-01 submitted
by Rick Blazek for property located at 234 East Franklin Street, platted as Lot 2C & 3A,
Block 31, City of Grapevine.
Section 15.G.4., "R-7.5" Single Family District, Area Regulations, requires a
minimum lot width of ninety-five (95) feet. The applicant requested a variance of
twenty-nine feet (29') allowing a lot width of sixty six -feet (66') for an existing lot.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming
use. The applicant requested a special exception allowing the existing residential
structure to remain as developed along with an expansion as shown on the plot plan.
Mr. Triplett explained that Staff found special conditions existed for the requested
special exception and variances. Specifically, the subject site was originally platted in
1913 predating the City's first zoning ordinance adopted in 1955. Developed property
and right-of-way existed to the west and east respectively, eliminating the possibility to
expand the site to meet the width requirements. The existing dwelling was built in 1925
predating the City's first zoning ordinance adopted in 1955.
Mr. Triplett stated that on June 1, 2015 the Board of Zoning Adjustment had approved a
special exception and variance of thirty five -feet (35') allowing a lot width of 60 -feet (60')
on the subject site. As a result of a recent form board survey dated December 15, 2015
of the subject site, the width of the property had increased approximately six -feet (6)
from 60 -feet to 66.88 -feet, necessitating a new special exception and variance request.
Mr. Triplett went on to explain that on April 22, 2015 Historic Preservation Commission
approved a Certificate of Appropriateness to construct an addition, bedroom, porch and
covered terrace as well as a second story addition containing a bedroom, den and an
attached single car garage and a single car covered carport at the rear of the property.
With no questions for Mr. Triplett, Josh Archer, representing property owner Rick Blazek
of 8233 Mid Cities Boulevard #A, North Richland Hills, Texas, took the Oath of Truth; he
requested favorable consideration of the request and offered to answer any questions of
the Board.
Chairman Holt asked what would be done with the curb cut on Franklin Street once the
approach was constructed on Smith Street. He stated that it was undecided at this time,
possibly gravel, but no concrete that would affect the impervious coverage.
Ron Stambaugh clarified, that any future changes to the parking area in front of the
house relative to it being gravel would have to be approved by the Historic Preservation
Commission.
Chairman Holt announced that one (1) letter of approval had been received.
With no further questions for Mr. Archer and no additional speakers, Robert Rainwater
made a motion to close the public hearing. George Dalton seconded the motion which
prevailed by the following vote:

Ken White made a motion that a special condition existed for the requested special
exception and variance. Specifically, the subject site was originally platted in 1913

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following variance and
special exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for property
located at 234 East Franklin Street, platted as Lot 2C & 3A, Block 31, City of Grapevine
Addition as follows:
Section 15.G.4., "R-7.5" Single Family District, Area Regulations, requires a minimum
lot width of ninety-five (95) feet.
The applicant is requesting a variance of twenty nine -feet (29') and if approved by the
Board would allow a lot width of sixty six -feet (66') for an existing lot.
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.

SPECIAL CONDITION:
Staff finds that special conditions exist for the requested variance and special exception.
Specifically, the subject site was originally platted in 1913 predating the City's first zoning
ordinance adopted in 1955. The existing dwelling was built in 1925 predating the City's
first zoning ordinance adopted in 1955. Developed property and right-of-way exist to the
west and east respectively, eliminating the possibility to expand the site to meet the width
requirements.
BACKGROUND INFORMATION:
On June 1, 2015 the Board of Zoning Adjustment approved a special exception and
variance on the subject site. The Board approved a variance of thirty five -feet (35')
allowing a lot width of 60 -feet (60') for an existing lot. As a result of a recent (12-15-2015)

form board survey of the subject site, the width of the property has increased
approximately six -feet (6) from 60 -feet to 66.88 -feet, necessitating a new special exception
and variance request.
A Certificate of Appropriateness was approved by the Historic Preservation Commission on
April 22, 2015 to construct a new addition to the existing dwelling to include a new porch on
the east front end of the house, a new bedroom and covered terrace, a new two story
addition containing a bedroom and den and a new attached single car garage and single
car covered carport at the rear of the property. It is the applicant's intent to expand the
existing residence into a two story 3,294 square foot dwelling and attach by a covered
breezeway a new 499 square foot garage south of the dwelling in the rear yard. The
application was submitted by property owner Rick Blazek.

of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
1. Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:
In the event of damage or destruction of a nonconforming structure to the

5. Maximum Impervious Area: The combined area occupied by all buildings,
structures, off-street parking and paved areas shall not exceed sixty (60)
percent of the total lot area.
6. Minimum Floor Area: The minimum square footage of a dwelling unit shall
be not less than twelve hundred (1,200) square feet of floor area.
G. AREA REGULATIONS:
The following minimum standards shall be required:
1. Depth of front yard, feet — 30
A minimum of fifty (50) percent of the area of the lot within the required front
yard setback shall be a landscaped area.

4. Width of lot, feet - 65
Except reverse frontage lots shall be a minimum of ninety-five (95) feet in

6. DISTANCE BETWEEN BUILDINGS: The minimum distance between
principal or accessory buildings on adjacent lots shall be not less than twelve
(12) feet.
7. Only one single-family detached dwelling shall be permitted on each lot or lot
of record, as the case may be.

The following maximum height regulations shall be observed:
1. Height of principal structure, two (2) stories not to exceed thirty-five (35) feet.
2. Height of accessory structure, one (1) story not to exceed sixteen (16) feet.

On Monday evening, February 1, 2016 at 6:15 P.M. in the City Council Chambers, 2nd
Floor, 200 South Main Street, Grapevine, Texas, the Board of Zoning Adjustment of the
City of Grapevine will hold a public hearing to consider the following items:
Case Number/Name: BZA16-01
Applicant: Rick Blazek
Location: 234 East Franklin Street, Lots 2C & 3A, Block 31, City of
Grapevine
Current Zoning: "R-7.5" Single Family District
Proposal: The request is for the following variance and special exception
to the Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.4., "R-7.5" Single
Family District, Area Regulations requires a minimum lot width of 95 -feet for a reverse
frontage lot. The applicant is requesting a variance of twenty nine -feet (29') to this
requirement and if approved by the Board would allow a lot width of 66 -feet for an existing
lot. Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The
applicant is requesting a special exception to allow the existing residential structure to
remain as developed along with an expansion as shown on the plot plan.
After all parties have been given an opportunity to speak, the public hearing will be
closed and the Commission will deliberate the pending matters. Please contact the
