SUBJECT: AMENDMENT TO INTERLOCAL ASSISTANCE AGREEMENT
FOR GRAPEVINE LAKE ACCOUNTING PLAN
RECOMMENDATION
City Council consider approving an amendment to the Interlocal Assistance Agreement
for Grapevine Lake Accounting Plan with the City of Dallas and Dallas County Park
Cities Municipal Utility District, authorizing staff to execute said contract, and take any
necessary action.
FUNDING
Funds are available from the 2017 Utility Fund Budget, account 200-44540-530-1,
Professional Services.
BACKGROUND
The City of Grapevine entered into the referenced agreement in 2003 with the City of
Dallas and Dallas County Park Cities Municipal Utility District to develop and maintain an
Accounting Plan for Grapevine Lake to monitor usage of each of the three rights holders
on the lake relative to their respective volume rights.
The City of Grapevine contracts for the accounting services and bills each of the three
rights holders 1/3 of the monthly costs which currently averages $174.00 per month per
rights holder.

This agreement has continued with two year renewal periods since that time.

The proposed amendment to the agreement modifies the two year renewal periods to 10
year renewal periods. It also modifies the written cancellation notification period from 30
days to 12 months.
All parties have agreed to the renewal period adjustment and the cancellation notice
adjustment.

AMENDMENT TO INTERLOCAL ASSISTANCE AGREEMENT FOR
LAKE GRAPEVINE ACCOUNTING PLAN
This Amendment is entered into by and between the City of Grapevine, Texas, the City
of Dallas, Texas, and Dallas County Park Cities Municipal Utility District, all being
either municipal corporations, or some other political subdivision chartered or established
by the Constitution of the State of Texas, hereinafter referred to as the "parties", and each
acting through their duly authorized elected or appointed representatives.
This Amendment amends the Interlocal Agreement of Lake Grapevine Accounting Plan
entered into as of July 1, 2013 (the "Agreement"). The parties wish to renew
and amend
the Agreement relative to its term.
The Parties believe this Amendment is in the best interest of the Parties and this
Amendment has been approved by the governing bodies of the Parties.
NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL PROMISES
AND CONSIDERATION PROVIDED FOER HEREIN, THE RECEIPT AND
SUFFICIENCY OF WHICH ARE HEREBY CONFIRMED, THE PARTIES
HERETO AGREE TO THE FOLLOWING:
1. The above findings are found to be true and correct and are incorporated herein by
reference as if copied in their entirety.
2. Section 2 of the Agreement is amended in its entirety and replaced as follows:
Term. This Agreement shall be for a term of 10 years commencing on February 1, 2017,
and ending on January 31, 2027, and may be extended thereafter for up to four (4)
additional ten (10) year periods by mutual consent of the Parties through action by their
governing bodies.
3. Section 5 of the Agreement is hereby amended in its entirety and replaced as
follows:
Cancellation. Any Party shall have the right to terminate this Agreement by giving
written notice to the other party at least twelve (12) months prior to such termination. All
payments by the Parties shall continue until the cancellation date is reached unless a
mutual agreement to the contrary is reached.
4. This Amendment supersedes and shall be controlling over all other interlocal
agreements.
