RESTRICTIONS
First for the Commission to consider and make recommendation to City Council was
zone change application Z17-04, relative to the "release of deed restrictions" for
property formerly referred to as the H/A Grapevine Joint Venture.
In August of 1995 as part of a large multi -tract rezoning request in the northeastern
corner of Grapevine bounded generally by State Highway 121, F.M 2499 and the city
limit lines of the Town of Flower Mound and the City of Coppell, approximately 220
undeveloped acres were rezoned to "R -MF -1" and "R -MF -2" Multifamily District, "CC"
Community Commercial District, and "BP" Business Park District. Deed restrictions
were included as part of the zoning request to limit the total number of multifamily units
that could be built within the prescribed area, provide for noise reduction and require
central air conditioning within any multifamily structures. A "Master Utilities" agreement
was also included establishing a cost sharing relationship between the property
owner(s) and the city relative to utility construction/improvements within the defined
area.
With the city's purchase of the 185 acres and the most recent purchase of the James
Tract, the attached deed restrictions are no longer necessary and all infrastructure
improvements relative to the original agreement have been made.
In the Commission's regular session, Monica Hotelling moved to approve zone change
application Z17-04. Jimmy Fechter seconded the motion, which prevailed by the
following vote:
Ayes: Oliver, Wilson, Hotelling, Fechter, Martin and Luers
