Planning and Zoning Commission to conduct a briefing session to discuss all items scheduled on tonight's agenda. No action will be taken. Each item will be considered during the Regular Session which immediately follows the Joint Public Hearings. JOINT MEETING WITH CITY COUNCIL: 7:30 p.m. - City Council Chambers 2. Invocation and Pledge of Allegiance: Vice Chairman BJ Wilson JOINT PUBLIC HEARING 3. Zoning Application Z17-04 — City Council and Planning and Zoning Commission to conduct a public hearing relative to the Release of Deed Restrictions on property situated in Dallas and Tarrant Counties Texas, as evidenced by a Deed dated June 24, 1994, and recorded in Volume 94124, Page 2000 in the Deed Records of Dallas County Texas. (City 185 acres). 4. Conditional Use Permit CU17-12 (Doughlicious) — City Council and Planning and Zoning Commission to conduct a public hearing relative to an application submitted by Courtney Sanders requesting a conditional use permit to allow a delicatessen (ready to eat cookie dough) in the Central Business District. The subject property is located at 129 South Main Street #140 and is currently zoning "CBD" Central Business District. 5. Historic Landmark District HL17-02 (518 Estill Street) — City Council and Planning and Zoning Commission to conduct a public hearing relative to an application submitted by Kevin and Rebecca Goss requesting designation as a historical landmark sub-district. The subject property is zoned "R-7.5" Single Family District. Chairman Oliver announced the Planning and Zoning Commission would conduct a work session relative to the following cases: Z17-04 RELEASE OF DEED RESTRICTION CU17-12 DOUGHLICIOUS H117-02 518 ESTILL STREET Chairman Oliver closed the Briefing Session at 7:10 p.m. 062017 1 PLANNING & ZONING COMMISSION JUNE 20, 2017 JOINT PUBLIC HEARINGS Mayor Tate called the meeting to order at 7:33 p.m. in the City Council Chambers. Items 3-5 of the Joint Public Hearings were held in the City Council Chambers. The Planning and Zoning Commission recessed to the Planning and Zoning Conference Room, Second Floor to consider published agenda items. PLANNING AND ZONING COMMISSION REGULAR SESSION Chairman Oliver called the Planning and Zoning Commission regular session to order at 7:42 p.m. ITEM 6. ZONE CHANGE APPLICATION Z17-04, RELEASE OF DEED RESTRICTIONS First for the Commission to consider and make recommendation to City Council was zone change application Z17-04, relative to the "release of deed restrictions" for property formerly referred to as the H/A Grapevine Joint Venture. In August of 1995 as part of a large multi -tract rezoning request in the northeastern corner of Grapevine bounded generally by State Highway 121, F.M 2499 and the city limit lines of the Town of Flower Mound and the City of Coppell, approximately 220 undeveloped acres were rezoned to "R -MF -1" and "R -MF -2" Multifamily District, "CC" Community Commercial District, and "BP" Business Park District. Deed restrictions were included as part of the zoning request to limit the total number of multifamily units that could be built within the prescribed area, provide for noise reduction and require central air conditioning within any multifamily structures. A "Master Utilities" agreement was also included establishing a cost sharing relationship between the property owner(s) and the city relative to utility construction/improvements within the defined area. With the city's purchase of the 185 acres and the most recent purchase of the James Tract, the attached deed restrictions are no longer necessary and all infrastructure improvements relative to the original agreement have been made. In the Commission's regular session, Monica Hotelling moved to approve zone change application Z17-04. Jimmy Fechter seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Fechter, Martin and Luers Nays: Tiggelaar 062017 2 PLANNING & ZONING COMMISSION JUNE 20, 2017 ITEM 7. CONDITIONAL USE APPLICATION CU17-12 DOUGHLICIOUS Next for the Commission to consider and make recommendation to City Council was conditional use application CU17-12 submitted by Courtney Sanders for property located at 129 South Main Street #140 and platted as Lot 1, Block 1, Hazlewood Commercial Building. The applicant was requesting a conditional use permit to allow a delicatessen (ready to eat) in the Central Business District. The applicant proposed to establish Doughlicious, a 931 square foot delicatessen for the preparation and retail sales of edible, ready to eat cookie dough on the subject site. In the Commission's regular session, Dennis Luers moved to approve conditional use application CU17-12. Gary Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Fechter, Martin, Tiggelaar and Luers Nays: None ITEM 6. HISTORIC LANDMARK SUBDISTRICT HL17-02 518 ESTILL STREET Next for the Commission to consider and make recommendation to City Council was historic landmark subdistrict HL17-02 for property located at 518 Estill Street and platted as Lot 6, Block 102, College Heights. The applicant is requesting designation as a historical landmark sub -district. Such sub -district may include buildings, land, areas, or districts of historical, architectural, archaeological or cultural importance or value that merit protection, enhancement, and preservation in the interest of the culture, prosperity, education, and welfare of the people. In the Commission's regular session, Monica Hotelling moved to approve historic landmark subdistrict HL17-02. Jimmy Fechter seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Fechter, Martin, Tiggelaar and Luers Nays: None ITEM 15. CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the May 16, 2017, Planning and Zoning Meeting. Dennis Luers moved to approve the Gary Martin, 2017 minutes. B J Wilson seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Martin, Nays: None Abstain: Hotelling and Fechter Tiggelaar and Luers 3 PLANNING & ZONING COMMISSION JUNE 20, 2017 ADJOURNMENT With no further business to discuss, Jimmy Fechter moved to adjourn the meeting at 7:44 p.m. Monica Hotelling seconded the motion which prevailed by the following vote: Ayes: Oliver, Wilson, Hotelling, Fechter, Martin, Tiggelaar and Luers Nays: None PASSED AND APPROVED BY THE PLANNING AND ZONING COMMISSION OF THE CITY OF GRAPEVINE, TEXAS ON THIS THE 18TH DAY OF JULY, 2017.
