Floor, 200 South Main Street, Grapevine, Texas, the City Council and Planning and Zoning

Proposal: The applicant is requesting a conditional use permit to amend
the previously approved site plan for an aquarium with on -premise alcohol beverage sales
in conjunction with a restaurant specifically to modify the layout of the proposed aquarium
which includes reorienting the structure, modifying the building elevations and eliminating
the elevated walkover. A copy of the site plan is on file at the Department of Development

You received this notice because you are a property owner within 200 feet of the subject tract
of land as shown by the most recent City -approved tax rolls. If you can not or do not wish
to attend the hearing, the attached form is provided for your convenience.
If owners of more than 20% of the property within 200 feet of the subject tract object to the
case, a 3/4 vote of the City Council is required to approve the request. To be considered a
part of the area property owners that object, the attached form, or a written response must
be returned to the Department of Development Services no later than 5:00 p.m. on the day

PROPERTY LOCATION AND SIZE:
The subject property is located at 422 South Dooley
Street and is platted as Lot 7 and the East 35 feet of
Lot 8, Block 33, City of Grapevine. The addition
contains .379 acres and has approximately 120 feet
of frontage along South Dooley Street and 150 feet
of frontage along East Franklin Street.
REQUESTED HISTORIC LANDMARK SUBDISTRICT AND COMMENTS:
The applicant is requesting a Historic Landmark Subdistrict designation for the property
addressed at 422 South Dooley Street and platted as Lot 7 and the East 35 feet of Lot 8
Block 33, City of Grapevine, to be known as the D.E. Box House.
The Historic Preservation Commission at their February 23, 2005 meeting adopted the
preservation criteria for the D.E. Box House. Preservation criteria for this proposed district
addressing such issues as setbacks, driveways, parking, exterior finishes and other
architectural embellishments were established by the Historic Preservation Commission to
preserve the historic integrity of the property. See the attached preservation criteria.
PRESENT ZONING AND USE:
The property is currently zoned "R-7.5" Single Family District and is developed as a single

HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding properties to the north, south, east, and west were zoned "R-
1" Single Family Residential District prior to the 1984 City Rezoning.
SURROUNDING ZONING AND EXISTING LAND USE:
NORTH: "R-7.5" Single Family District—single family residences
SOUTH: "R-7.5" Single Family District—single family residences
EAST: "R-7.5" Single Family District—single family residences
WEST: "R-7.5" Single Family District—single family residences
The subject tract is located within "Zone A" Zone of Minimal Effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. Few
activities will be affected by aircraft sounds in "Zone A" except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The applicant's proposal
is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Low Density Residential land use.
The applicant's proposal is in compliance with the Master Plan.

KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT
THAT pursuant to Ordinance No. 91-73, 91-77 and 97-80, which is codified as Appendix
G, § 1-13 of the Code of Ordinances for the City of Grapevine, being the Section of the Zoning
Ordinance controlling the alteration and change of Historic Landmarks within the City of
Grapevine, Texas and in compliance with TEXAS LOCAL GOV'T CODE § 315.006(h) which
provides that each municipality shall record in the real property records of the County Clerk's
office of each county in which the municipality is located, a verified written instrument setting forth
each historic structure or property that is located in the municipality and county. Notice is hereby
given that the City of Grapevine, a Home Rule Municipal Corporation, has designated this
property a Historic Landmark, the exterior of which such properties, may not be changed, altered,
restored, removed, or demolished without making an application to the Historic Preservation
Commission for a Certificate of Appropriateness and such a certificate being granted.
THAT this provides notice to all men of the above restrictions placed on the property
described below as a result of a Historical Landmark designation by the City of Grapevine. This
restriction shall run with the land.
Furthermore, it should be noted that pursuant to TEXAS LOCAL GOV'T CODE §
315.006(i) upon the recording and indexing of this Certificate TEXAS LOCAL GOV'T CODE §
315.006(a) -(g) become applicable. In that light, all persons take note that:

RECOMMENDATION:
Staff recommends the Historic Preservation Commission approve the request for Historic
Landmark Designation in accordance with the Grapevine Historic Preservation Ordinance
91-73 (Appendix G — Grapevine Code of Ordinances), as amended, for property addressed
at 422 S. Dooley Street, Lot 7 and E35' 8, Block 33, City of Grapevine.
BACKGROUND INFORMATION:
The D. E. Box House, at the northwest corner of the intersection at South Dooley Street
and Franklin Street is a 2752 square foot residence built by John Dougherty for D. E. and
Ruth Box in 1920. The home is a high quality two-story folk house with hints of craftsman
detailing. It is similar in styling to one-story bungalows seen throughout Grapevine and built
between 1910-1930.
The house is significant to Grapevine due to its both its design and the Box family history
connected with it.
DESIGN GUIDELINES:
Staff has prepared a set of design guidelines for use in reviewing future alterations to this
property. The guidelines are attached to the HL application for your review. Regarding a
proposed color palette, Staff recommends adopting the Sherwin William's Preservation
Palette, Pittsburgh Paints Historic Colors, Do It Best Quality Paints American Restoration
Exterior Colors, Benjamin Moore Historic Colors and Valspar's American Tradition Historic
Colors (exterior only).
