T. (Tommy) Hardy Marcy Rat -cliff Chris Caso Doug Eberhart Joy Carroll Ar& 2111 Community Development Director Planner Assistant City Attorney Assistant Manager, Engineering Planning & Administrative Aide Chairman Ron Cook called the Planning and Zoning Commission's deliberation Session to order at approximately 10:30 PM. NERTNUTUREGIN Commissioner Rodney Smith offered the public hearing Invocation . The first item for consideration by the Planning and Zoning Commission was Zoning Application Z88-02, submitted by Mary Stone Meyers, in order to make a recommendation to the City Council. In the public hearing Mx. H.T. (Tomuy) Hardy introduced the case with a slide presentation advising that the 26,8791 acre tract, presently zoned "R-20", Single Family is located west of Parr Road, East of Druid Hills, south of the remaining unannexed Stone property and north of High Country Estates. Mr. Hardy further advised that the tract was subject to recent annexation proceedings which automatically bring property into the city zoned "R-20", Single Family, and the applicant's request is to rezone to "R-12.5". Mr. Hardy then introduced Mr. Fred Joyce, the applicant's representative, who advised that the density for High Country, Phase I was 3.07, Phase II was 2.78 and Phase III, the subject tract, will be 2.04, basically the size lots required in "R-20", with only one lot being less than 14,000 square feet. There was little discussion offered from Commissioners or council Members other than a question relative to allowing the tract to remain "R-20"; and Mr. Norman Brown of 2907 O'Dell Court, owner of ten (10) acres of adjoining property, spoke in favor of the proposed zoning, expressly the Masonry wall planned to screen the development from Parr Road. Those expressing objections to the proposed zoning change were: Mr. Jerry Brandt of 2947 Parr Road expressed desire to maintain country feeling and also objected to the large homes and that the added density would overload the roads as developed. Dr. Terry Walker noted that the tracts to the south were remaining "R-20" and preferred the Myers tract to remain the same. In the Commission's deliberation session there was discussion relative to tying deed restrictions to the zoning of the property and Commissioner Martin expressed a preference to allow Lot 1, Block 5 to remain "R-20", since lot size would conform. -e Enj o-4 aap-To uT uoT-4TppV -4aiAl-4S TT-eM PuP 3la-ed Oq4 -40 -4-eTd @Jd @L[4 S12M UOT-4-e.TapTsuoD S,UOTSSTULUOD aLf4 a0j Ul@TE -4XOU OLJI 4 IrYWHIM, ogle - -TaAUN PUP JOATTO :-4u;DsqV UTIOqbIla PUP UT4XeW sApiq q4TUIS '3 AOTLID-4V '400D SORV :a-4oA f)u-E-[TL-AOxd bumoTToj OL14 Lf4TM ia-TL-I I;DUOTSSTUUOD UlOaj PUOO@S le kq p9mo-E-p.; L14TUIS AaUpoa jaUo-[SSTulUoZ) UIO.X_4 pgjajjo SaM @DU-eU-[P-TO OL[4 JO bUTP-2aa -4S-TT-; UO pa-4-4-Fimps s -e 4sanbax aL14 @Ao-idd-e -[TounoD aLF4 qpLF4 puaim;Doa oq uOT4M V -f:)UTApd @Llq ;DpTAo-Td -4U-eDT-[dd-2 aLF4 -4-ar4 -4sanbaji oq spm saauarssTullco jo snsuasuoz) 172-Tauaf) @qL -papTAo-Td aq p-[-noT4s sdo-4: pu-e swaTqoad -4snP Ve-rqua-4od Gonpaa o-4 sp os Paxe paA-edun al F4 uo bu-UPTTnq ;DLF4 puTLpq joj paq-eub-rsap aq Pj-nOM BUTXJ72d aaAo-Edao 4-eiI4 pu-e s,qsnoLj o-4 MOTJJOAO 400JTP 04 paz)L-Td aq pTnam ub-rs -e -4pq4 pa-4ou s -em -41 -.,qTurxojd J@So-[o 9,-40,j UTNJ-ed S,-4SnOj _40 aSnP;D;zq s,pzapdsa Aq spm qi sp s,opTonj Aq paqopdui aq -4ou pTnom -4a@aqS q:apg qpq4 -buippp , Lm -Ed buT-[xed Gq4 p@SS@-TPPL- APJ-eH '-IW 'UOTSc3@S UO-r-4-e.XaC[T-[@P SUOTSSTUILUOD OL[4 UI 1,40P.14 aLT4 jo -4iDa_j OOZ Lrq4Tm Aq.Tadoad paA-[oAu-i uoT4oE)Cqo jo s -i@ -4 -4o -j aajLr4 GLLL -pz)ppL- aq pTnom qu-e-m-e-4sou s,pzxtdsa uio-Tj p@Dua-cjadxa Ap-e@j[Tp asoqq, 0-4 TL-uOT-4TPPP suE)-Eqoxd BuT.[jpd pue OSTOU -[-eUOT-4Tpp-e k[-[-eTqua-4od -4-2q4 aaam SUOT-4z)aCqo asoLn '-400-1-4S q4JQt,4 SOF J'O uOs-TO-44Pd TTON Pue -40a.1-4S UTTJUP-Td -4sPd JO s-4uOPTs@-T AJOTTTLI uO'd Pu -e UaTITI P.0 :uioa_; uo-p-rsoddo f:)uTssaadxa sLc@qqa-[ paoz)@-T aq4 oqu-r p --ax ljjnH -ePuTrI "UP-40aDas A-4-rz) -4UaZ4ST-[C[124S@ STq JO JPOJ @Lr4 UT saDpds @jC[PjT-eA7e UIO-Tj BUTapd -4@aaqs-_;jo P;Daa-j-;o 014M a -TO -4s amqTuana ss@ro quaDpEp-e aL14 jo ssOT-o -[ITa pu-e ..xaumo A-4jadoad BuT-Toqqf:)Tau L- -T;D-[Tq1- PTOJPHPue ,A-epT-[IPH Aqqa jo uos-la-eD paa !P@am@-IqurU T06Z jc) OuOOrI P-IxeW T-esodoad aq4 jo aoA-e_oad ;Dso -sjauOTSSTUIuoZ) Kq POSSnDSTP OSTP SeM S4T4bTT poo -[_4 jo asn puL- smTqo-Td 95-euTPap TPTquaqod ?up 'bUTU@aJ3S ia-4sdwnp -Toj sue -Ed --saaeds T-eUOT-4TPP-2 apTAo-Td PTnOD sPOT-TOd PILIpurop MOT -TTaq4 -4-e SaT-4aadoad bu-[.xoqqf)T@u -TaLI40 --4orj bu-nped -4snod @ q p@q-Tosq-2 N 0'4 (ST) uaa-4jT_; LpTm 'as-cwaad uo papTAo-Td Oq PTnOm sao-eds buT31.Tpd (Z) -Tno_;-L4u@#4 -4Pq4 PLIe POlJu-eTd @o-uuas -4uL-.TnL-4saj jo adlq aq4 passnDs-ip JOLRJnJ OLVA OPTz)nrI OT-"eD 'J1W PaDnp0a-4U-F U@boa 4u@sa-Td o-4 -4uaudoTOA9P f5UT-4STX:,z) 011-4 uuO-;uOz) 0-4 -4u@u4snCpv bUTUOZ _40 PJ-e(Da @Ljq UIO-T_; S@DUPTXeA -IGIRO PU-e UOTSS-FIMO:) bUTUOZ Pue BuuuL-Td Oq4 'uOaJ aoup-capA Buujapd P iD.XTnb,-:),T -[-[TM "Pa4OU SPM 4 . It was also noted that the developer is awaiting detention pond criteria which is scheduled for the May 17, 1988, meeting. Mr. Eberhart then then advised that the perifial street fees would be due at the time the building permit is issued. There being no further discussion, Commissioner Smith made a motion to recommend that the City Council approve the plat; and Larry Atchley seconded the motion. It prevailed by the following vote: Ayes: Cook, Engholm, Martin, Atchley and Smith Nays: None Absent: Oliver and Meyer PRELIMINARY PIAT OF HIGH COUNTRY, PHASE III Next the commission was to consider the preliminary plat of High Country., Phase III, to make a recommendation to the City Council. The "R-12.5" zoning and subject plat being the same tract, the 26.88 acres north of the present High Country II Subdivison and west of Parr Road, there was little further discussion prior to a motion being offered from Commissioner Atchley, followed by a second from Commissioner Smith, with the prevailing vote as follows: Ayes: Cook, Engholm, Martin, Atchley & Smith Nays: None Absent: Oliver & Meyer Next the Commission was to consider the Final Plat of Stonegate, Phase I, in order to make a recommendation to the City Council. Mr. Eberhart advised that no problems had been encountered, and that Lots 14 and 15 of Block 1 are included in the rezoning request for Stonegate, Phase II. Should the rezoning not be approved, neither may be plat be approved. There being no deliberation and little discussion, then Rodney Smith made a motion to recommend that the City Council approve the final plat of Stonegate, Phase I. Cathy Martin offered a second which prevailed by the following vote: Ayes: Cook, Engholm, Martin, Atchley and Smith Nays: None Absent: Oliver & Meyer PRELIMINARY AND FINAL PIAT OF STaiEGATE ADDITION, PHASE II The next item for the Commission's consideration was the preliminary and final plat of Stonegate Addition, Phase II. The approval of the subject request, Mr. Eberhart advised, is contingent upon the zoning approval.- and engineering has no objection to approval of both plats at the same time. There being no discussion, a motion from Rodney Smith and second from Larry Atchley was to approve the preliminary plat as requested, with the prevailing vote as follows: Ayes: Cook, Engholm, Martin, Atchley & Smith Nays: None Absent: Oliver & Meyer Then Cathy Martin offered a motion to table the final plat of Stonegate, Phase II, with a second from Peggy Engholm, and the prevailing vote as follows: Ayes: Cook, Engholm, Martin, Atchley & Smith Nays: None Absent: Oliver & Meyer XUVAMM - S :,Lsauv IVHD may_ -_ ,ter *886T '7,VW dO XVG IILLT MU SIRL NO 'SVXRL '24IAadVd9 dO LUZ) MU aO NOISSII*W DNINOZ CNV DNINMVrId 9U AR CEAOdddV GW CEHSSVd *Wd SV:TT AT@-4auTxo-Tddp -4'e paumloEpe @q pTnoqs buT-4@au aq4 -4-2qq p;D-T-e-[D@p u@q4 TPLD 'UOTTe.XaPTSUOD S,UOTSSTMOZ) aLF4 -TO_; ss@uTsTiq aaq4m. _4 OU E)UTaq @IOLLL IRMSTOW-11 ,uqoLIf)ua .&B&Dd PU-e UT4JPW IsD Oq TTTM BUTPU9-4-4-e S-TaUOTSSTaul.M -886T 'E APW o-4 OC TT-Tdv uioaj pT@Ll aq o-4 o-,uo-4uV u-eS uT j[euTuDS uO-L-4P-r-)DssV f)u-TuLmTcl leuOT-4-em aq-4 -Toj sue -Ed paux-rjuoo possnDsTp 'aE)uueTd 'JJT-lz)4Pd ADa%i 1101,14 PRI 1454 lot'. flu.11*714- Q rrmki I* + @B -el 886T '61 TTJdV saqnu-EW uo-Ess.aiuoD buTuoZ pu-e buTuue-[d
