HomeMy WebLinkAbout1989-11-07STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in Special Joint Public Hearing Session (tabled from October 17, 1989), on this the 7th day of November, 1989, at 7:30 PM in the City Council Chambers, Municipal Court Room, #205, 307 West Dallas Road, with the following Ccmmissioners present, to wit: Ron Cook Larry Oliver Larry Atchley Ervin Meyer Robert Hinson constituting a quorum, with Cathy not yet appointed a new member to resigned. In attendance were the Chairman Vice Chairman Member Member Member Martin absent. The City Council had replace John Price, who had recently following members of the City Staff: H.T.(Tommy)Hardy Director of Community Development Marcy Ratcliff Planner Greg Wheeler Assistant Building Official Joy Carroll Planning/Administrative Aide Adrienne Leonard Assistant City Attorney Robert Price Technical Review Engineer Mayor Tate called the public hearing portion of the meeting to order at 7:30 PM; and Planning and Zoning Commission Chairman Ron Cooked called the Commission's session to order at 8:15 PM, to consider the following items: ITEM #1 ZONING APPLICATION 89-10-JAVATEX CORPORATION Mr. H.T.(Tcmmy)Hardy advised that Zoning Application 89-10 was filed by Javatex Corporation requesting rezoning of 39.9297 acres from "R-3.5", Two -Family District Regulations to "R-7.51', Single -Family District Regulations. Mr. Hardy stated that the tract is located north of the "V" of State Highway 114 frontage road where it intersects with Northwest Highway, west of the Scaggs Center and east of the Southlake boundary. Then Mr. Don Hertzog displayed a zoning exhibit even though a concept plan is not required with low-density single-family rezoning requests. He further noted that letters from the Texas Highway Department had indicated approval for an entry street to the subdivision from State Highway 114. There being no questions or discussion from the Council or commission, Mayor Tate invited guests present to speak. Mr. Charles Brannon of 6934 Robin Pow, Dallas, Texas, representing property to the southwest of the subject tract requested that a street be stubbed out to his property because the Javatex proposal would land -lock his acreage from the Grapevine portion with the majority of the property being in Grapevine rather than Southlake. Councilwoman Sharron Spencer requested that the Commissioners investigate a solution for the Brannon "R-3.5", Duplex tract's access to Park Blvd. which would not access a single-family neighborhood. There being no further Council or Commission discussion or deliberation and no further guests wishing to speak, Mayor Tate asked if there had been letters or petitions submitted. City Secretary Linda Huff said that none had been received. The public hearing was then closed. In the Commission's deliberation session, the discussion and deliberation concerned Mr. Brannon's request to establish an access to his "R-3.5" property adjacent to the Javatex tract. Mr. Brannon was assured by Commissioners and Staff that access would be provided by future development north of the subject tract. P&Z Minutes -11-7-89 Page 2 There being no further discussion, Vice Chairman Larry Oliver made to motion to recommend the City Council approve Z89-10, as requested. Commissioner Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Cook, Oliver, Meyer, Atchley and Hinson Nays: None Absent: Martin ITEM #2 CONDITIONAL USE APPLICATION 89-14, %AFFLE HOUSE, INC. Mr. Hardy then introduced Conditional Use Application 89-14, filed by Waffle House, Inc. for the purpose of amending the Hayley Addition Planned CoTmiercial Site Plan to add the Waffle House Restaurant and a forty foot (40') pole sign. The 13.514 acre tract zoned "HC", Highway Commercial, is Lot 3R3, Block 1, Hayley Addition and is on the northeast corner of State Highway 114 and the William D. Tate intersection. Grapevine Comprehensive Zoning OrdinanceSections Mr. Jimmy Stone, Real Estate Representative for Waffle House Restaurants from Sunlakes Arizona noted that the proposed 24 -Hour restaurant would seat 41 people, and no alcoholic beverages would be sold. It was noted that the 40 foot pole sign had been approved contingent upon Council's approval of the conditional use request. There were no questions from the Coom-ission or Council, no correspondence to report and no guests wishing to speak, so Mayor Tate declared that the public hearing be closed. In the Commission's deliberation session, Marcy Ratcliff, Planner, advised that only two lots remained to be developed in the Hayley Addition if Waffle House's Conditional Use 89-14 is approve. There being no discussion or deliberation, Commissioner Larry Atchley's motion and Commissioner Robert's Hinson second was to recommend the City Council approve the request contingent upon approval of the relative zoning ordinance amendments, with the prevailing vote as follows: Ayes: Cook, Oliver, Meyer, Atchley and Hinson Nays: None Absent: Martin ITEM #3 PROPOSED AM[NDVOqTS TO GRAPEVINE COMPREHENSIVE ZONING ORDINANCE 82-73, SECTIONS 12, DEFINITIONS, C0MM(JNITY COMMERCIAL, 31, "LI", LI= INDUSTRIAL, 48, CONDITIONAL USES, 49, SPECIAL USES, 53, IANDSCAPTNG REGULATIONS, AND 60, SIGN STANDARDS The next item for the Commissioners to consider and make a recommendation to the City Council was the proposed amendments to Grapevine Comprehensive Zoning OrdinanceSections 48, 49, 53 and 60. Mr® To Hardy advised that the purposes for amending the subject sections were as follows: Section 12, Definitions - to define the term, "reverse frontage" Section 25, "CC", Cosa munit ' v Commercial --(1) to set the minimum lot width and depth at 120 feet to provide flexibility in achieving the 30,000 square foot minimum lot size; and (2) allow outdoor commercial amusements such as golf driving ranges, miniature golf and archery as a conditional use T " Section 31, 'I_UI, Light Industrial - (2) to clarify the purpose, permitted, accessory conditional and limitation of uses relative to storage; and (2) amend the distance dumpsters are set back from residentially zoned districts. P&Z Minutes -11-7-89 Page 3 Section 48, Conditional Uses and Section 49, Special Uses - to eliminate the detailed landscape plan as a required part of the conditional or special use permit which is authorized by City Council. Instead Staff would have the ability to approve the detailed landscape plan through the site plan application. The plan would still be required to be submitted in conjunction with the conditional or special use application but would not be a part of the zoning request. The proposed amendments would eliminate the need for public hearings for minor items such as revising landscape placement or materials. Section 49, Special Uses - The proposed amendment would allow bed and breakfast owner -occupied facilities in "R-7.5," "R-12.5," "R-20," "R-5.011 and "R-TH, 11 zoning districts and bed and breakfast owner -occupied facilities in the "CBD" Zoning District as special uses. Section 53, Landscaping - to reduce the planter island size from 10' X 20' to 9' X 18' which is the minimum dimensions for a standard parking space. Section 60, Sign Standards - to allow flexibility for sign cabinet width and height dimensions for pole signs allowed as a conditional use in planned commercial centers to eliminate the minimum width and depth requirement, and allow the maximum square footage of 288 square feet to regulate the width and length. With no questions from Commissioners, and the only concern expressed from Council being allowing bed and breakfast facilities to be in "any" residential district. A alternate suggestion was to delineate an established residential area and restrict bed and breakfast facilities to only central residential areas adjacent to the "CBD." There was no one wishing to speak; and the City Secretary had no correspondence to report, so the public hearing was closed. In the Commission's deliberation session, Marcy Ratcliff outlined the amendments as proposed; and Commissioners discussed the individual amendments. Then the amendments were considered in one vote with the exception of Section 49, Special Use Permits relative to allowing bed and breakfast facilities. Commissioner Ery Meyer made a motion to approve the amendments as proposed to Grapevine Comprehensive Zoning Ordinance 82-73, Sections 12, 25, 31, 48, 53 and 60. Commissioner Robert Hinson seconded the motion which prevailed by the following vote: Ayes: Cook, Oliver, Meyer, Atchley and Hinson Nays: None Absent: Martin Then Commissioner Robert Hinson made a motion to recommend the City Council approve the proposed amendments to Section 49, including the bed and breakfast facilities without limiting residential bed and breakfast facilities to Central Grapevine. Commissioner Larry Atchley seconded the motion which prevailed by the following vote: Ayes: Cook, Meyer, Atchley and Hinson Nays: Oliver Absent: Martin MISCELLANEOUS DISCUSSION AND/OR REPORTS In response to Chairman Cook's request for any discussion or reports, Marcy Ratcliff noted that all five Commissioners present were needed for a quorum November 21, 1989, due to Commissioner Martin's absence and John Price's resignation. Joy Carroll briefly discussed the American Planning Commission Conference held in October in Lubbock. Then Commissioner's voiced consensus was to instruct Staff to schedule a workshop November 21, 1989, at 7 PM prior to the 7:30 public hearing. The purpose of the workshop is to review proposed amendments P&Z Minutes -11-7-89 Page 4 for that evening relative to Dallas Fort Worth International Airport Ifistrict and the Governmntal Use Zoning District. It was requested that new changes to Section 38 be starred. With no fi)-rther business to consider, Comissioner Robert Hinson's motion and Ery Meyer's second was to adjourn the meting at 9 PM, with the prevailing vote as follows: Ayes: Cook, Oliver, Meyer, Atchley and Hinson Nays: None Absent: Martin PASSED AND APPROVED BY THE PLANNING AND ZONING COMISSION OF THE CITY OF GRAPEVINE, TEXAS, ON THIS THE 19TH DAY OF DECEMBER, 1989.
