They have asked for a drainage study as well which we completed but found that the roof to the west may be contributing. Our engineering base drawing is being developed as well. We have scheduled additional topographic survey and will let you know when we need access to the interior of the building. The Surveyor is also performing a boundary survey and has ordered title research to discover any easements, utilities, or anything else that could be a problem for the owner. Clint, does the owner have her title commitment from purchase of the property? This could speed things along on this front. I am getting started on re -tracing the steps that you took with the permitting process. 1. Can you confirm that April 24 was in 2017? Silly as it may sound, I have to be as accurate as possible. 2. This step in the process was worked as intended. 6. As I read the city record on mygov; I stopped by to tell the contractor to stop work without a permit. At this point, the contractor went to city hall and made application. Later that day as I was processing C/o applications; I noted your C/o application was for a resale shop. At this point, I called you and we met at the new location and reviewed the zoning regulations. As the discussion continued; it was discussed that you could occupy the 9000 sq ft structure if you obtained a conditional use permit. But it was also discussed that the process could take up to 45 days. Next, as we were talking, I asked if KIGB sold antiques, furniture, tables, etc. to which it was replied yes. Then, we came to the conclusion that you could occupy the 2875 sq ft suite #100 with the resale shop, and occupy the remainder of the building with the retail sales in suite #200. All the while, applying for the CU, going through the process and timeline and keeping your business operating until a determination was made by P&Z and CC. We discussed that, in order for you to occupy the entire building and completely remove the demising wall, the conditional use permit would need approval from P&Z and CC. Staff at my level only enforce the city zoning ordinances. Staff cannot grant variances. That requires the governing bodies of the municipality to do so. The Site Plan Review Committee at their December 17, 2003 meeting approved a conditional use permit (CU03-49) that simply reconsidered the previous amendments associated with CU02-06 that had expired with no action taken. No other changes were proposed. City Council at the September 06, 2011 meeting approved Conditional Use Request CU11-21 (Ord.2011-50) to allow for outdoor dining for 80 patrons. With this inventory mix and the aesthetic investments, we've received overwhelmingly positive community and customer feedback.
