The subject property is located at 2900 Genesis Way ' and is proposed to be platted as Lot 1, Block 1, The 1 Hall-Johnson sti,s =11 a Trade Group. The property contains approximately m 16.3 acres and has 513 feet of frontage along LJ--__9 ° Enchanted Way and 600 feet of frontage along a Glade Rd. — m —� Genesis Way. F c REQUESTED ZONE CHANGE AND COMMENTS: The applicant is requesting a zone change to rezone 16.3 acres from "CC" Community Commercial District to "BP" Business Park District for an office/warehouse/manufacturing development. It is the applicant's intent to develop a 316,994 square foot building for a single purpose user that plans, develops, and manufactures trade show material for individuals and businesses. Approximately 40,000 square feet of the building will be devoted to office related uses, and an additional 40,000 square feet will be devoted to developing and manufacturing processes. The remaining 236,994 square feet of the structure will be used primarily for warehousing. Based on these uses, approximately 298 parking spaces are required and the applicant has provided 329 spaces. PRESENT ZONING AND USE: The property is currently zoned "CC" Community Commercial District and is undeveloped. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding properties were zoned from "I-1" Light Industrial District to "PID" Planned Industrial District during the 1984 City Rezoning. The subject property as well as the properties to the north, south, east, and west were subsequently rezoned in 1996 (Z96-02, Z96-15) to "CC" Community Commercial District. The property to the west has received several conditional use permits for a planned commercial center developed with several limited service hotels. The City Council approved at their June 17, 2014 meeting a conditional use permit (CU14-25) for a 13,250 square foot building that will be utilized primarily as a wedding and events center along with on-premise alcohol beverage sales. Further to the south at Council's August 21, 2012 meeting a conditional use permit (CU12-25) was approved for a 7,600 square foot indoor shooting range. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "CC" Community Commercial District—vacant SOUTH: "CC" Community Commercial District—Water Oaks Event Center EAST: "CC" Community Commercial District—vacant WEST: "CC" Community Commercial District—vacant property and several limited service hotels; Hampton Inn, Comfort Suites AIRPORT IMPACT: The subject tract is located within "Zone B" Middle Zone of Effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" Map. In "Zone B" the following uses may be considered only if sound treatment is included in building design: multifamily apartments, motels, office buildings, movie theaters, restaurants, personal and business services. Single family residential and sound sensitive uses such as schools and churches should avoid this zone. The applicant's proposal is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Commercial land use. The applicant's request is not in compliance with the Master Plan. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed two thousand dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8.
