HomeMy WebLinkAboutItem 19 - Westport & Stone Myers Pkwy MEMO TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: BRUNO RUMBELOW, CITY MANAGER MEETING DATE: SEPEMBER 19, 2017 SUBJECT: WESTPORT PARKWAY AND STONE MYERS PARKWAY TRAFFIC SIGNAL REIMBURSEMENT RECOMMENDATION: City Council consider adopting an appropriation ordinance to fund the traffic signal at Westport Parkway and Stone Myers Parkway, authorizing staff to take any necessary action. FUNDING SOURCE: Funds are available in the Streets Capital Project Fund Balance account. BACKGROUND: Ms. Lisa Rose, Board President of The Gatehouse contacted City Staff regarding the installation of a traffic signal at the intersection of Westport Parkway and Stone Myers Parkway. City Traffic Engineering staff observed the operation of the intersection and determined that the intersection meets the necessary traffic warrants to justify a signal but funding wasn't available at that time. In order to expedite the installation of the signal, on March 7, 2017 City Council approved a City/Owner Agreement with The Gatehouse to provide interim funding in the amount of $150,000.00 for the design and construction of the signal. Representatives of The Gatehouse deposited $150,000 with the City on March 30, 2017. Signal installation is currently taking place and it should be operational by the end of September, 2017. Funding was included in the FY18 Streets Capital Projects account in order to reimburse The Gatehouse for the signal. Staff recommends approval. RESOLUTION NO. 2017-079 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS APPROVING AN AGREEMENT FOR THE REIMBURSEMENT OF THE WESTPORT PARKWAY AND STONE MYERS SIGNAL ADVANCE FROM THE GATEHOUSE; AUTHORIZING EXPENDITURES FOR THE PERFORMANCE OF SAID WORK; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine and The Gatehouse entered into a City/Owner Agreement on March 7, 2017 for The Gatehouse to advance the City $150,000.00 to expedite the design and construction of the traffic signal at Westport Parkway and Stone Myers Parkway; and WHEREAS, representatives of The Gatehouse posted $150,000.00 with the City on March 30, 2017; and WHEREAS, funding has been identified in the Capital Streets Projects fund balance and is available to refund $150,000.00 to The Gatehouse; and WHEREAS, all legal prerequisites for the adoption of this resolution have been met, including but not limited to the Local Government Code and the Open Meetings Act; and WHEREAS, the City Council hereby declares that the approval of this resolution is in the best interest of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council of the City of Grapevine hereby approves the reimbursement of the $150,000.00 posted for the traffic signal installation at Westport Parkway and Stone Myers Parkway to representatives of The Gatehouse, and authorizes the City Manager, or his designee, to execute any documents necessary to proceed. Section 3. That this resolution shall take effect from and after the date of its passage. Boyle, Jr. City Attorney Resolution No. 2017-079 2 ORDINANCE NO. 2017-061 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, REVISING THE ADOPTED CAPITAL IMPROVEMENTS BUDGET FOR THE FISCAL YEAR ENDING IN 2017; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine desires to maintain its Traffic Signal Network with regular maintenance, repairs and updates as necessary; and WHEREAS, the City of Grapevine and The Gatehouse entered into a City/Owner Agreement on March 7, 2017 for The Gatehouse to advance the City $150,000.00 to expedite the design and construction of the traffic signal at Westport Parkway and Stone Myers Parkway; and WHEREAS, representatives of The Gatehouse posted $150,000.00 with the City on March 30, 2017; and WHEREAS, funding has been identified in the Capitol Streets Projects fund balance and is available to refund $150,000.00 to The Gatehouse; and WHEREAS, funding for the reimbursement of the funding advance from The Gatehouse for the design and construction of the signal at the intersection of Westport Parkway and Stone Myers Parkway and a project contingency is not currently included in the Fiscal Year 2016 -2017 Capital Improvements Plan Budget; and WHEREAS, all constitutional and statutory prerequisites for the approval of this ordinance have been met, including but not limited to the Open Meetings Act; and WHEREAS, the City Council deems the adoption of this ordinance to be in the best interests of the health, safety, and welfare of the public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated hereinabove are found to be true and correct and are incorporated herein by reference as if copied in their entirety. Section 2. That the City Council hereby authorizes an amount of$150,000.00 be appropriated in the Capitol Streets Projects Fund for amended design phase services, construction costs, and contingencies associated with the Westport Parkway and Stone Myers Parkway traffic signal. Section 3. That a copy of the revised Fiscal Year 2016-2017 Capital Improvements Plan budget document shall be kept on file in the office of the City Secretary and on the City of Grapevine website. Section 4. That the terms and provisions of this ordinance shall be deemed to be severable, and that if the validity of any section, subsection,word, sentence or phrase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 5. That the fact that the present ordinances and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare which requires that this ordinance shall take effect immediately from and after its passage and it is accordingly so ordained.
