following request:
Section 43.E.3, Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The Board approved a special exception allowing the existing apartment complex to remain
as developed and recreate 18 apartment units in an existing apartment complex as shown on
the plot plan.

The Board denied the following request

use. The Board denied a special exception that would have allowed the existing
residential structure to remain as developed as shown on the plot plan.

RECOMMENDATION:
Staff recommends the Board of Zoning Adjustment approve the following special
exception to Grapevine Comprehensive Zoning Ordinance 82-73 for property located at
2905 Mustang Drive, platted as Lot 1 A, Block 1, Mustang Addition as follows:
Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning
Adjustment to approve the remodeling and/or enlargement of a nonconforming use.
The applicant is requesting a special exception to allow the existing apartment complex to
remain as developed and to recreate 18 apartment units in an existing apartment complex
as shown on the plot plan.
SPECIAL CONDITION:
Staff finds that a special condition exists for the special exception requested. Specifically,
the apartment complex, when developed in the mid -1970's, was in complete compliance
with the zoning ordinance (Ord. 70-10) in effect at that time. Units (18) previously
accounted for were conjoined to create a larger living unit that was in demand in
subsequent years. The demand for these larger living spaces has diminished and the
applicant is proposing to "unmerge" them bringing back the total unit count that was
approved when the complex was originally developed.
The original site plan for the apartment complex developed in the mid -1970's is
unavailable. An assumption is made that since the rezoning of the property was approved
by city council and it was subsequently permitted and constructed that it met all the
requirements of the ordinance in place at that time. When originally developed, 246 units
were constructed. In later years 18 of those units were joined together to create larger
living units bringing the total unit count down to 228 units. This request specifically centers
on the applicant's proposal to unmerge those previously conjoined units bringing the total
unit count back to the original 246 units. In an effort to reduce the level of non -conformity

relative to the current zoning ordinance, the applicant has addressed those areas that were
physically possible to address—specifically the addition of landscaped islands throughout
the parking area (which were not required relative to Ord. 70-10) and the inclusion of more
property to be utilized for additional parking. This specific area located near the southeast
corner of the site contains 56 parking spaces -36 spaces were required (2 spaces per unit)
for the newly recreated units. No "new" construction is being proposed other than the
creation of the parking area. The unit count will not increase beyond what was originally
developed (246 units).
The application was submitted by the Chris Clark, representing Courtyards at Mustang
Apartments.

terminated by the Board of Adjustment in accordance with provisions
of Section 67A of this Ordinance.
E. CHANGING NONCONFORMING USES:
1. Any nonconforming use may be changed to a conforming use, and once
such change is made, the use shall not thereafter be changed back to a
nonconforming use.
2. The Board of Adjustment may grant a change of use from one
nonconforming use to another nonconforming use provided such change is
to a use permitted in a zoning district where the original nonconforming use
would be permitted, or provided that such change is to a use permitted in a
more restrictive classification. However, such change of use and occupancy
shall not tend to prolong the life of a nonconforming use. Upon review of the
facts in accordance with Section 67A, the Board of Adjustment may establish
a specific period of time for the return of the occupancy to a conforming use.
3. The Board of Adjustment may approve the remodeling or enlargement of a
nonconforming use when such an enlargement would not tend to prolong the
life of the nonconforming use. Upon review of the facts, the Board of
Adjustment may establish a specific period of time for the return of the
occupancy to a conforming use.
F. LIMITATIONS ON CHANGING NONCONFORMING USES: No nonconforming use
shall be changed to another nonconforming use, which requires more off-street
parking spaces or off-street loading space than the original nonconforming use,
unless additional off-street parking and loading space is provided so as to comply
with the requirements of Sections 55 and 56.
The number of dwelling units or rooms in a nonconforming residential use shall not
be increased so as to exceed the number of dwelling units or rooms existing on the
effective date of this Ordinance.
No nonconforming use may be expanded or increased beyond the lot or tract upon
which such nonconforming use is located as of the effective date of this ordinance
except to provide off-street loading or off-street parking space upon approval of the
Board of Adjustment.
All nonconforming uses being expanded under the provisions of this Ordinance shall
comply with the other applicable provisions of this Ordinance.
G. TERMINATION OF NONCONFORMING STRUCTURES:
