TRIPLETT JR, PLANNER II SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA15-06 2905 MUSTANG DRIVE MEETING DATE: MONDAY, AUGUST 3, 2015 RECOMMENDATION: Staff recommends the Board of Zoning Adjustment approve the following special exception to Grapevine Comprehensive Zoning Ordinance 82-73 for property located at 2905 Mustang Drive, platted as Lot 1 A, Block 1, Mustang Addition as follows: Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to approve the remodeling and/or enlargement of a nonconforming use. The applicant is requesting a special exception to allow the existing apartment complex to remain as developed and to recreate 18 apartment units in an existing apartment complex as shown on the plot plan. SPECIAL CONDITION: Staff finds that a special condition exists for the special exception requested. Specifically, the apartment complex, when developed in the mid -1970's, was in complete compliance with the zoning ordinance (Ord. 70-10) in effect at that time. Units (18) previously accounted for were conjoined to create a larger living unit that was in demand in subsequent years. The demand for these larger living spaces has diminished and the applicant is proposing to "unmerge" them bringing back the total unit count that was approved when the complex was originally developed. The original site plan for the apartment complex developed in the mid -1970's is unavailable. An assumption is made that since the rezoning of the property was approved by city council and it was subsequently permitted and constructed that it met all the requirements of the ordinance in place at that time. When originally developed, 246 units were constructed. In later years 18 of those units were joined together to create larger living units bringing the total unit count down to 228 units. This request specifically centers on the applicant's proposal to unmerge those previously conjoined units bringing the total unit count back to the original 246 units. In an effort to reduce the level of non -conformity OAKAU015\Cases\BZA 15-06.4 relative to the current zoning ordinance, the applicant has addressed those areas that were physically possible to address—specifically the addition of landscaped islands throughout the parking area (which were not required relative to Ord. 70-10) and the inclusion of more property to be utilized for additional parking. This specific area located near the southeast corner of the site contains 56 parking spaces -36 spaces were required (2 spaces per unit) for the newly recreated units. No "new" construction is being proposed other than the creation of the parking area. The unit count will not increase beyond what was originally developed (246 units).
