HomeMy WebLinkAbout1976-03-22MINUTES OF ZONING BOARD OF ADJUSTMENTS MEETING Monday, March 22, 1976 Present: Kaker, Deacon, Cox Absent: Wright, Harper, Taylor Acting Chairman Harold Kaker called the meeting to order at 7:35 P.M. He explained that Mrs. Ruth Cox was applying for an amendment to the Zoning Ordinance, wanting to place a four foot fence on her property line. Joe Lipscomb, Building Official, explained that this was a corner lot and that the ordinance prohibited a fence of any size in the front yard of this corner lot. Mrs. Ruth Cox, owner of the property, stated that she wanted the fence for her own protection. She explained that an apartment house was located across the street and that the residents would turn around in her yard and was constantly bothering her to use her phone. She also stated that she couldn't keep a dog or a cat because they would be stolen. Mr. Larry Evans, proposed builder of the fence, stated that there were other fences in the area that were on the property line and were more than three feet in heighth. He further stated that they were requesting to construct a four foot, cyclone fence around her property. Member Charles Cox inquired about the traffic in this area. Mrs. Cox explained that the traffic was quite heavy during the summer months. Joe Lipscomb stated that the cityrs view was to help Mrs. Cox in some way to feel secure. He then pointed out that there were other fences in this area exceeding the three foot front yard limitation. Harold Kaker stated that to his knowledge there were no corner lots in this area that had fences. There was a concern of the members present that they may be setting a precedent in the case of fences on corner lots' -In this addition as ivell as other additions within the city. Charles Cox stated that he felt no precedent would be set because of the special circumstances surrounding this request meaning the apartments. It was the general concensus that the members 'should not act on this application until the other members could be present and that all members should make an effort to look at this property. Charles Cox made a motion to recess the hearing until Tuesday, March 23, 1976 at 6:30 P.M. Floyd Deacon seconded the motion. All Ayes. PASSED AND APPROVED this the _ day of , 1976. Ken eth R.
