MINUTES OF BOARD OF ZONING ADJUSTMENTS
APRIL 18, 1977
PRESENT A. J. Harper, Conrad Heede, Jesse Woods,
James Buckner, and Jerry Spencer
CITY STAFF MEMBERS : Joe Lipscomb, Shirley Armstrong
Chairman A. J. Harper called the meeting to order.
The first order of business was for the Board of Zoning Adjustments
to consider BZA Application 77-3 submitted by Mr. Dennis Roberts.
The Chairman introduced the guests, Mr. Dennis Roberts, applicant,
and Mr. L. B. Buford, neighboring property owner.
It was explained that Mr. Roberts was requesting an eighteen foot
rear yard setback variance relative to the construction of an
apartment complex.
The City Secretary reported that she had received telephone calls
from several neighboring property owners, (Mrs. Kennedy, Mrs. Tate,
Mrs. Wiley, and Jake Greener), all indicating that they had no
objections to the requested variance. Mr. & Mrs. Tom Presley
advised the City Secretary that they opposed the request because
of conditions that could be created by the construction of apart-
ments, such as traffic problems. They also indicated that they
felt the building would be too close to the property line on the
north. Mr. L. B. Buford, adjacent property owner to the west,
indicated that he had no objections as long as the apartments would
be fifteen feet from his property line.
After a lengthy discussion among board members, Member Jerry Spencer
made a motion to approve the requested 18 foot rear yard variance
on the north, and included the restriction that the west side of the
apartment complex must be fifteen feet from the property line. The
motion was seconded by Member Jesse Woods and prevailed by the
following vote:
Ayes: Harper, Woods, Heede, Spencer, & Buckner
Nays: None
The next order of business was consideration of the minutes of April
12, 1977. Member Conrad Heede made a motion to approve the minutes
as published. Member Jerry Spencer seconded the motion and it
prevailed by the following vote:
Ayes: Harper, Woods, Heede, Spencer, & Buckner
Nays: None
The next order of business was for the Board of Zoning Adjustments
to consider Council recommendations concerning Board appointments.
Board members agreed that those recommendations should be determined
b the Chairman rather than being discussed in the
Y g presence of all
board members. There was no formal action taken.
The next item was miscellaneous reports and discussions. The City
Secretary stated that she had been asked to seek tenative feelings
of the board regarding a variance requested on property located
along the railroad, at the N. E. corner of Dallas Road and Main
- Street. After little discussion, it was the general consensus that
enough information was not available to make an accurate judgement.
No action was taken.
There being no further business to come before the Board of Zoning
Adjustments, Member Jesse Woods made a motion to adjourn the meeting.
The motion was seconded by Member Jerry Spencer and all present
voted aye.
