MINUTES OF THE BOARD OF ZONING ADJUSTMENTS
JULY 18, 1977 4:00 P.M.
PRESENT A. J. Harper, James Buckner, Jesse Woods,
Jerry Spencer, Charlie Cox, Jim Swinney,
Don Butler and Howard McGirt
CITY STAFF MEMBERS : Joe Lipscomb
Board Chairman Harper opened the meeting and took as the first
order of business the consideration of the minutes of May 18, 1977
meeting.
Jesse Woods made a motion to approve the minutes as printed. The
motion was seconded by Jerry Spencer.
Ayes: Harper, Buckner, Woods, Spencer, Cox
Nays: None
The next order of business was application BZA77-5 submitted by
Mr. Jim Swinney. Mr. Swinney addressed the Board and explained
that he was requesting a 2413" front yard set back which would
be a variance of 519" to save a large tree at the rear of the
house. He stated that he had received a plat of the subdivision
which indicated a 251 front yard set back and had plans drawn
accordingly.
Discussion by the Board followed concerning the danger of a tree
falling on the roof of the proposed house and the possibility of
redesigning the house.
A motion was made by Jerry Spencer to disapprove the application.
The motion died for a lack of a second.
James Buckner made a motion to approve application BZA77-5. The
motion was seconded by Charlie Cox.
Ayes: Woods, Buckner, Cox, Harper
Nays: Spencer
The next order of business was application BZA77-6 submitted by
Mr. Don Butler. Mr. Butler explained that the foundation had
been set in the wrong place by mistake and it had been discovered
by the surveyors on completion of the house. He stated he was
seeking a variance of 4111" on the front yard setback and 4'9" on
the side yard setback.
The Board discussed the issue and stated that they did not intend
to approve every application submitted by a builder claiming an
honest mistake, but this case appeared to be an obvious mistake in
view of the lot size and distances to the north and east property
lines.
Jesse Woods made a motion to approve application BZA77-6. The
motion was seconded by James Buckner.
Ayes: Harper, Woods, Buckner, Spencer, Cox
Nays: None
There being no further business the meeting was adjourned.
