ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 8TH DAY OF DECEMBER, 1978, AT 9:00 A.M. SHIRLEY AWqSTRONG CITY SECFkTTARY STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustments met on this the 13th day of December, 1978, at 5:00 P.M. with the following members present to -wit: A. J. Harper Chariman Jesse Woods Vice -Chairman Jerry Spencer Member James Buckner Member Charles Cox Member Tommy Zimmerer Member constituting a quorum with City Engineer J. R. Baddaker, and Juanita Bond, Acting Secretary. CALL TO ORDER The meeting was called to order by Chairman A. J. Harper. PUBLIC HEARING - BZA 78-6 The first order of business was for the Board of Zoning Adjustments to consider BZA 78-6 submitted by Weldon Gettys of Broyles and Gettys Custom Homes. Chairman Harper introduced Mr. Weldon Gettys (representing Broyles and Gettys Custom Homes), and Mr. William F. Bush, a property owner. It was noted that Mr. Gettys was requesting a 8'3" variance in the 25' rear yard requirement. He advised that the house plan was drawn for this particular lot. He also advised that if he was not allowed the variance requested, that he would have to detach the garage, and this would probably make the house hard to sell. Mr. Bush was ques- tioning whether or not Mr. Gettys need the variance.* After much dis- cussion, Member Jerry Spencer made a motion to postpone the case until December 20, 1978 so that further investigation could be made by the City Inspection Department as to what a detached building requirements are. Member Charlex Cox seconded the motion, and it prevailed by the following vote Ayes: Harper, Spencer, Cox, Buckner, and Zimmerer Nays: Woods PUBLIC HEARING - BZA 78-7 The next order of business was for the Board of Zoning Adjustments to consider BZA 78-7 submitted by Grapevine Properties, Inc. Mr. Harper intorduced Mr. Max Holderby of Grapevine Properties Inc., and Mr. Winston Beam. It was noted that the applicant was requesting a twelve (12) foot variance in the thirty (30) foot front yard require- ment on Lot 11, Block 1, The Vineyard, or #3 Whispering Vine. It was stated that this house had also been constructed (as a previous house located at #5 Whispering Vine which they had obtained a twelve (12) foot variance on November 16, 1978 from the Board of Zoning Adjust- ments) prior to learing of the set back error. Member Jesse Woods advised that he would be in favor of granting this variance on the basis of the reasons submitted to the Board in the November 16, 1978 meeting. Member James Buckner made a motion that the application be approved allowing the twelve (12) foot variance on Lot 11, Block 1, The Vine- yard or #3 Whispering Vine. The motion was seconded by Member Charles Cox and prevailed by the following vote: Ayes: Harper, Woods, Spencer, Cox, Buckner, and Zimmerer Nays: None PUBLIC HEARING - BZA 78-8 The next order of business was for the Board of Zoning Adjustments to consider BZA 78-8 submitted by Doug Cook of Dena Construction Company. Chairman Harper introduced Mr. Doug Cook of Dena Construction Company. The applicant was requesting a one (1) foot variance in the thirty (30) foot front yard requirement and a five (5) foot variance in the twenty- five (25) foot rear yard requirement on a house to be built at 2910 Creekwood Drive, Grapevine, Texas, or Lot 43, Block 1, Creekwood Estates. Mr. Cook stated that the house plan had been drawn to take advantage of (t the numerous trees on the lot, and would be a great factor in the sale of this house. Mr. Buckner stated that the one (1) foot front yard variance and the five (5) foot rear yard variance would not create a hardship on the surrounding neighbors. Mr. Harper was in agreement. However, it was the consensus of the other members that it would not create a hardship on the builder to obtain another house plan for this particular lot that would meet the zoning requirements. Member James Buckner made a motion to approve the variances as requested. The motion was seconded by A. J. Harper and failed by the following vote: Ayes: Buckner and Harper Nays: Woods, Cox, Spencer, and Zimmerer MINUTES The minutes of the November 29, 1978 meeting will be considered at the December 20, 1978 meeting. REPORTS AND/OR DISCUSSIONS City Engineer J. R. Baddaker discussed the problems the Building Inspec- tors were having trying to locate a circular set back line. He stated that he. -was proposing a change in the zoning ordinance to .the City Council and the Planning & Zoning Commission at the December 19, 1978 Council Meeting that would help resolve the set back problems in new subdivisions on cul-de-sacs. ADJOURNMENT There being no further business to come before the Board, Member Jesse Woods made a motion to adjourn. The motion was seconded by Member Jerry Spencer and all in attendance voted aye.
