ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSIOA?, THE BOARD OF ZONING ADJUSTMENTS MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 28TH DAY OF SEPTEMBER, 1979 AT 3:00 P. M. Shir ey Arst ong City Secretary STATE OF TEXAS X COUNTY OF TARRANT X CITY OF GRAPEVINE X The Board of Zoning Adjustments of the City of Grapevine met on this the 4th day of October, 1979 at 7:00 P.M. with the following persons present to -wit: A. J. Harper Chairman James Buckner Vice Chairman Jerry Spencer Member Charles Cox Member Gerald Thompson Member Shirley Armstrong Secretary constituting a quorum with Member Jesse Woods absent. CALL TO ORDER The meeting was called to order by Chairman A. J. Harper. OATH OF OFFICE TO GERALD THOMPSON The City Secretary recited the Oath of Office to new member Gerald Thompson and he was duly sworn to serve. BZA 79-10 - Roy Stewart The next order of business was for the Board of Zoning Adjust- ments to consider BZA Application 79-10 submitted by Mr. Roy Stewart. Chairman Harper administered the Oath of Truth to the applicant. He then explained that Mr. Stewart was requesting a nine foot rear yard variance at 1889 Cimmarron Court, or Lot 45, Block 2 of La Paloma Estates. ' Mr. Stewart explained the irregular shape of the lot and noted that no matter the house plan, a variance would most likely be required. The City Secretary then read the following letter into the record: October 1, 1979 City of Grapevine P.O. Drawer 1547 Grapevine, Texas 76051 Subject: Zoning Adjustment Application No. 79-10 Ref: City of Grapevine letter DTD Sept 21, 1979 Dear Ms. Armstrong, Please be advised that I have absolutely no object - tions to the granting of a variance to Mr. Roy Stewart per the subject application. However, I would like to state that the request for a variance would have been totally unnecessary had the Land Developer that platted the area and the Zoning Board that approved it not been so very greedy by trying to squeeze 6 lots on a cul-de- sac that at most could accomodate 5 homes. Also, in discussing the request with my neighbors, I found that I was the only property owner within 200' radius that received the referenced letter. As of this date there are home owners in this area that are more affected by this request than I, namely the residents of the homes on. Lots 44,46 & 47. Therefore, I feel that this request be delayed until such time as all residents are informed of this matter. Yours truly, George W. Schluter 1873 Cimarron Court Grapevine, Texas 76051 Mrs. Armstrong advised that the Tax Office had not provided all of the street addresses because the property owners had not contacted their office to record the newly assigned house numbers. She noted however, that upon receipt of Mr. Schluter's letter, proper addresses were obtained from the Building Inspection Department and those property owners affected were notified. Mr. William Robinson, adjacent property owner to the East advised that he had recently invested a great deal of money in planting a yard. He requested that Mr. Stewart build a six foot fence along the 92'12" property line between the two pieces of property, prior to beginning construction of the house, for the purpose of protecting his yard from damage by construction workers and vehicles. Mr. Stewart stated that he preferred to put up the fence after construction, but that he would be willing to cooperate with Mr. Robinson and do as he requested. Board Member, Gerald Thompson commented that he did not feel Mr. Stewart should be required to provide the fence and -'bear the burden of the entire cost. Mr. Robinson advised that he would not assist in the payment -of the fence. Mr. Stewart then stated that he would be in agreement to build the requested fence during construction. Member Jerry Spencer then made a motion to approve the nine foot (9') rear yard variance as requested with the understanding that Mr. Stewart would build a six foot fence along the 92'12" property line during the course of construction on the property in question. The motion was seconded by Member James Buckner and prevailed by the following vote: Ayes Harper, Buckner, Spencer, Thompson and Cox Nays None Absent: Jesse Woods CONSIDERATION OF THE MINUTES The next order of business was consideration of the Minutes of September 6, 1979. Member Jerry Spencer made a motion to waive the reading of the Minutes and approve them as printed. The motion was seconded by Member Jerry Spencer and prevailed by the following vote: Ayes Harper, Buckner, Spencer, Thompson and Cox Nays None Absent: Jesse Woods ADJOURNMENT There being no further business to come before the Board, Member James Buckner made a motion to adjourn. The motion was seconded by Member Jerry Spencer and all in attendance voted aye. t PASSED & APPROVED ON THIS THE 97" -'day of 1979. ,1 +
