The Planning and Zoning commission of the City of Grapevine, Texas,
met in Joint Public Hearing with the City Council, on this the 24th
day of March, 1992, in the city Council Chambers, Room #205, 307
West Dallas Road, Grapevine, Texas, with the following members
present to wit:

Mayor, William D. Tate called the joint meeting to order at 7:30
P.M., and Chairman, Ron Cook called the Commission's session to
order at 9:50 P.M.
INVOCATION
Commission Member, Larry Oliver offered the Invocation.
JOINT PUBLIC HEARING
ZONE CHANGE APPLICATION Z92-01 SUBMITTED BY MR. MATTHEW GOODWIN
First on the Agenda for the Commission to consider and make
recommendation to the City Council was the request to rezone 6.38
acres from R-20 Single -Family District Regulations to R-12.5
Single -Family District Regulations.
In the public hearing, Planner, Marcy Ratcliff advised that the
property is located at 3210 Parr Lane, east of Parr Park, north of
the O'Dell Subdivision,, west of Western Oaks Subdivision and
contains 6.38 acres. The property has 369 feet of frontage on Parr
Lane. Ms. Ratcliff then introduced Mr. Matthew Goodwin. Mr.
Goodwin asked that the Council approve the zoning application.
Mayor Tate invited guests to speak. The following citizens were
against Zoning Application Z92-01:
1. Mr. Randall Bynam, 3807 Shady Meadow Drive.
2. Mr. John Dowery, 3806 Shady Meadow Drive.
3. Mr. Joe Ewasik, 3804 Shady Meadow Drive.
The home owners comments consisted of future problems with
drainage, property values, and the fact that no plans had been
submitted.
Mr. Goodwin again spoke stating that all 16 lots would be custom
homes in the R-12.5 zoning, the smallest lot would be 15,000 sq.
ft. He said he is now working with staff to reduce the drainage
concerns. In response to Council's questions, Mr. Goodwin stated
that Deed Restrictions would be no problem.
With no other questions from the Commission or council, no guests
to speak and no letters or petitions, the public hearing was then
closed.
In the Commission's deliberation session/ following a brief
discussion/ Commission Member Curtis Young's motion and Darlene
Freed's second was to recommend the City Council table Z92-01 until
the April 21st, 1992 Planning and Zoning meeting, asking that Mr.
Goodwin come back in with a plat detailing lot sizes, with the
prevailing vote as follows.

CONDITIONAL USE APPLICATION CU92-02, SUMBITTED BY,MODERNAGE, INC.,
FOR GRADY,S AMERICAN GRILL
Next for the Commission to consider and make a recommendation to
the City Council was Conditional Use Application CU92-02, submitted
by Modernage, Inc., for Grady's American Grill.
In the Public Hearing, Planner Marcy Ratcliff advised that
Modernage, Inc., for Grady's American Grill is requesting to add
2.52 acres to the existing 13.51 acre Planned Commercial Center for
a total of 16.03 acres. Also the applicant is requesting to locate

a restaurant (Grady's American Grill) on Lot 5R-B2A east of
Romano's and share parking with Lot 5R-B2B to the east and the
ability to store, sale and serve on -premise consumption of
alcoholic beverages (beer, wine and mixed drinks) and a 40 foot
pole sign with a sign cabinet containing 197.69 square feet of
gross surface area. The applicant is also requesting a waiver to
Section 47.E.2. in accordance with Section 47.F. This amendment to
the site plan will abandon the right-of-way of South Ball Street
from the southern limits of the Bellaire Addition to the state
Highway 114 West Frontage Road, but access through to State Highway
114 West will be maintained by an easement through the parking lot.
The property is currently zoned Highway Commercial with a
conditional use permit for a Planned Commercial Center for all of
Block 1 of the Hayley Addition. Lot 5R-B2A and 5R-B2B are
currently undeveloped and designated as future use.
Planner, Marcy Ratcliff introduced Ms. Kim Woodard, of Modernage
Inc. Ms. Woodard stated that the restaurant would be very upscale
and would serve prime -rib, steaks and fish and would have the usual
restaurant bar area. She stated that lighting would be implemented
with no spill over and the fence would be compatible with what is
already built. The abandonment of Ball Street is necessary in
order to have more parking for the restaurant area, and stated if
the parking is approved there would be 128 more spaces than is
required by the City.
At this point , Mayor Tate invited any guests to speak for or
against CU92-02.
Mr. Hulan D. Baker of 1502 Bellaire Dr. spoke in opposition to
closing off Ball Street. He stated that Ball Street gives easy
access to St. Highway 114 and that 376 cars use it daily as a
regular street.
Mr. Richard Dix, of 1508 Bellaire, also in opposition of closing
Ball Street stated it would limit the access to St. Highway 114,
and would increase traffic and parking in the neighborhood.
Mr. Jim Peyton of 440 W. Highway 114 stated that he has seen an
increase in area traffic, and seen many jobs implemented because of
the increase in area businesses (Hayley Addition), and does not
oppose the closing of Ball Street.
Mr. John Evans, property owner, approves of the Conditional Use
application.
Mrs. Peggy Baker, of 1502 Bellaire stated there is a great deal of
use by commercial business on Ball Street, such as the power and
light trucks, police cars, water department etc.

With no other questions from the Commission or Council, no other
guests to speak and no letters or petitions, the public hearing was
then closed.
In the Commission's deliberation session, the Commission members
discussed saving the trees on the north east part of the property,
(if they are even on the property.) Members also discussed
extending the 6 ft. fence along the northern property line of Lot
5R-B2B. A motion by Commission member Curtis Young, and a second
by Steve Stamos to recommend the City Council approve Conditional
Use CU92-02, with the stipulation that the 6 ft. fence be extended
to the end of lot 5RB2B and save any trees that are on the lot, and
to waive the specific requirements of Grapevine Comprehensive
Zoning Ordinance 82-73 Section 47e.2. pursuant to Section 47F.,
with the prevailing vote as follows:

REPLAT OF LOTS 5R-B2A AND 5R-B2B
THE HALEY ADDITION THE 1 AND LOTS 1R BLOCK 2 OF
Next for the Commission to consider and make recommendation to the
City Council was the Replat of Lots 5R-B2A and 5R-B2B, Block 1 and
Lots 1R, Block 2 of the Haley Addition.
In the Public Hearing, Senior Civil Engineer Larry Frassinelli
stated that the subject 4.737 acre property located on the east and
west side of South Ball Street adjacent to the north frontage road
of State Highway 114 is zoned 11HC11 Highway Commercial and is being
replatted to subdivide the two existing lots and a portion of the
South Ball Street right-of-way into three commercial lots. Grady's
American Grill will be located on Lot 5R-B2A, Block 1. The western
half of Lot 5R-B2B, Block 1 will be partially developed to provide
shared parking and circulation for Grady's American Grill.
Mr. Frassinelli then introduced Ms. Kim Woodard of Modernage, Inc.
Ms. Woodard spoke requesting that the replat of Lots 5R-B2A and 5R-
B2B, Block 1, Lot 1, Block 2 of the Hayley Addition be approved.
After discussion concerning the proposed parking lot and the
abandonment of South Ball Street, Mayor Tate invited guests to
comment. With no guests to speak and no letters or petitions, the
public hearing was then closed.
In the commission's deliberation session, following a brief
discussion, Commission Member Darlene Freed's motion and Curtis
Young's second was to recommend the City Council approve the replat
of Lots 5R-B2A and 5R-B2B,, Block 1 and Lot 1R, Block 2 of the
Hayley Addition.

CONDITIONAL USE APPLICATION CU92-03, SUBMITTED BY J.A. GREEN OF
TEXAS, INC.
Next the Commission was to consider, and make a recommendation to
the City Council, relative to Conditional Use Application CU92-03.
In the Public Hearing, Planner, Marcy Ratcliff stated the applicant
is requesting to amend the approved CU91-06. The proposed site
plan amendments include adding two freight forwarding warehouses to
an approved development and a request for a waiver to Section
47.E.2. in accordance with Section 47.F. The two proposed
buildings numbers 5 and 6 contain 48,000 square feet each. Each
building requires 50 parking spaces. The site requires a total of
205 parking spaces and 212 parking spaces are provided. Currently
the property is developed with one freight forwarding warehouse and
one is under construction. This proposal will complete the
development of the property.
Ms. Ratcliff then introduced Mr. Jerry Dawe, of J.A. Green of Texas
Inc. Mr. Dawe asked for approval of Conditional Use Application
CU92-03. With no questions from the Commission or Council, no
guests to speak and no letters or petitions, the public hearing was
then closed.
In the commission's deliberation session. following a brief
discussion, Commission member, Ery Meyer's notion and Curtis
Young's second was to recommend the City Council approve the
request for Conditional Use Application 92-03 and waive the
specific requirements of Grapevine Comprehensive Zoning ordinance
82-73, Section 47.E.2. pursuant to Section 47.F, with the
prevailing vote as follows:

REPLAT OF LOT 3R-1, BLOCK 8 OF THE W.C. LUCAS ADDITION, FILED BY
MS. SHERI EDGIL
Next for the Commission to consider and make a recommendation to
the City Council was the Replat of Lot 3R-1, Block 8 of the W.C.
Lucas Addition.
Senior Civil Engineer, Larry Frassinelli stated, the subject .49
acre tract is located on the east side of Dove Road, north of
Northwest Highway and is zoned 11HC11 Highway Commercial District.
Mr. Frassineiii introduced Michael & Sherri Edgel to answer any
questions.

APPROVAL OF MINUTES OF THE PLANNING AND ZONING MEETING OF FEBRUARY
18, 1992.
A motion by Ervin Meyer and a second by Curtis Young, was to
approve the minutes of the February 18, 1992, meeting with the
prevailing vote as follows:
Ayes: Cook, Meyer, Young, Freed, Stamos,
Nayes: None
Abstain: Oliver
Absent: Martin
ADJOURNMENT•
With no further business for the Commission to consider, a motion
by Larry Oliver and second by Curtis Young was to adjourn the
meeting at 11:30 P.M., with the prevailing vote as follows:
