HomeMy WebLinkAbout1992-04-29STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Planning and Zoning Commission Workshop Meeting of the City of Grapevine, Texas, met Wednesday evening, April 29th, 1992, at 6:30 p.m., in the Conference Room #204, Police Building, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Ron Cook Larry Oliver Ery Meyer Curtis Young Darlene Freed Steve Stamos Sharron Spencer Chairman Vice chairman Member Member Member Member City Council Representative constituting a quorum, with one member! Cathy Martin absent, and the following City Staff: H.T. (Tommy) Hardy Director Greg Wheeler Building Marcy Ratcliff Planner Ray Collins Planner Carol Baron Secretary Jerry Hodge Director Stan Laster Assistant CALL TO—RDER: of Community Development Official of Public Works Director of Public Works After dinner, Chairman, Ron Cook called the meeting to order at 7:00 p.m., and asked Steve Stamos to offer the Invocation. Chairman, Ron Cook asked for a motion to declare an emergency meeting prior to the Planning and Zoning Workshop. Motion by Larry Oliver, and a second by Curtis Young, to declare an emergency, with the following vote prevailing: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin A. AMENDMENTS TO THE THOROUGHFARE PLAN: First on the Agenda for the Commission to consider was connecting Heritage Avenue to William D. Tate Avenue (State Highway 121), north of Big Bear Creek, and to consider eliminating the portion of Mustang Drive from the east frontage road of William D. Tate Avenue (State Highway 121) to North Airfield Drive. 1 Commission Members, asked if Parr Lane could be connected to Heritage Avenue in the future. Director of Public Works, Jerry Hodge stated, yes it could be connected in the future, after some other projects were finished and if enough funds were left. Commission Members stated it would help decrease the amount of traffic going through the neighborhood. Mr. Hodge stated when the last portion of Heritage Avenue across Big Bear Creek is completed it would probably be by the City through a bond election. Mr. Hodge stated someday Heritage will be built but he does not have a time frame of when that might be. As for connecting Heritage Avenue to William D. Tate, Mr. Hodge stated he could not say until the Master Drainage Plan was completed. The Master Drainage Plan and its recommendations will be a determining factor if this possible through the flood plain of Big Bear Creek. Commission Members asked why the Thoroughfare Plan was not being followed in relation to dedication requirements for Mustang Drive located at the rear of J.A. Green's property. Mr. Hodge stated the Thoroughfare Plan was being followed; however in the case of J.A. Green's conditional use request, the dedication was not required because the property has been platted for several years and replatting the property was not a requirement of the application. The peripheral street fees are collected after a property is platted and the construction plans are approved. The property owner is responsible for paying the peripheral fees. Director of Community Development, Tommy Hardy stated the extension of Mustang Drive into the airport property may be difficult because the airport's development plan may not include the proposed thoroughfare. B. DEFINITION OF A BASEMENT: The definition of basement as defined in the Zoning Ordinance is in conflict with the definition in the Uniform Building Code. Staff proposes to use the definitions used by the Uniform Building Code. Building Official, Greg Wheeler stated he came across the conflicting definitions of a basement, when reviewing a building permit for a three level dwelling. Mr. Wheeler further stated the Zoning Ordinance does allow a basement with a two story dwelling if the basement and stories meet the definitions as printed in Section 12 of the Zoning Ordinance. The two definitions for basement and story are currently in conflict with each other because of two reasons: 1. The definition for a basement is incorrectly worded, F whereas the portion below grade has to be less than the portion above grade; and, 2. The definition for a story does not make a clear distinction between a basement and story. Staff recommends using the definitions for basement, story and story, first, as printed in the Grapevine Building Code, Chapter 4, Definitions and Abbreviations. After a brief discussion, a motion by Curtis Young, and a second by Larry Oliver was to recommend that City Council approve the suggested amendments, with the prevailing vote as follows: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin C. AMENDMENTS TO SECTION 29, HOTEL CORPORATE OFFICE• Planner, Marcy Ratcliff stated Staff proposes amending the section to allow convenience stores with gasoline sales and off -premise consumption of alcoholic beverage sales as a conditional use and the ability to request on -premise consumption of alcoholic beverage sales a conditional use. Ms. Ratcliff recommended that the following be added to Section 29, Hotel Corporate Office District Ordinances: 5. Convenience Stores, including gasoline sales, prepared food carry -out service with alcoholic beverage sales for off -premise consumption of beer only, provided a special permit is issued in accordance with Section 42.B of the Ordinance. 6. Alcoholic beverages, provided a special permit is issued in accordance with Section 42.B. of this Ordinance. The Commission Members stated that the suggestion to add the above numbers five and six to Section 29, Hotel Corporate Office District were logical. A motion by Curtis Young, and a second by Darlene Freed was to recommend the City Council approve the additions as written, and set for public hearing, with the prevailing vote as follows: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin D. AMENDMENTS TO SECTION 56, OFF-STREET PARKING REGULATIONS: Planner, Marcy Ratcliff stated that after surveying other area cities requirements regarding off-street parking, Staff has devised 3 another possible way to calculate off-street parking based on the number of persons that can occupy a building. Currently parking for restaurants is calculated by the number of seats available. The regulations do not require any spaces for waiting areas or kitchen areas. Planner, Marcy Ratcliff noted the survey of other area cities requirements regarding off-street parking for restaurants and medical offices vary greatly. Staff, in response to comments about parking requirements at a previous meeting, devised another way possible to calculate off-street parking based on the number of persons that can occupy a building. This method of calculating parking would be more representative of the restaurant's need for parking spaces. Ms. Ratcliff stated that changing the parking spaces to "per person" instead of "per seat" for large restaurants would not effect the smaller restaurants such as Wendys, since they don't typically have a large waiting area. Ms. Ratcliff noted the Grapevine parking requirements for medical offices was somewhat stricter than other cities. But the requirements in place were a result of problems the City had incurred where previously not enough parking had been required. There was discussion among the Commission Members and there was a consensus that the parking requirements for medical offices were sufficient. The Commission discussed the overall parking requirements for the City of Grapevine. Building Official, Greg Wheeler suggested the following: Eating or drinking establishment 1 per 3 persons no service to auto. (maximum occupant load for a building) Curtis Young made the motion to approve the amendments to Section 56, Off -Street Parking Regulations as per Greg's formula, with a second by Steve Stamos and ask Staff to set a public hearing, with the prevailing vote as follows: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin E. OPEN SPACE FEES RELEVANT TO SMALL LOT DEVELOPMENTS* Planner, Marcy Ratcliff advised that Staff proposes to amend Section 51 to eliminate the timing problem of collecting open space 4 fees on small lot developments. Section 51.E. Open Spaces, establishes the minimum park size as well as cash lieu of any park dedication with the development of residential properties in Grapevine. Section 51.E. also establishes the time schedule for the payment of cash in lieu of. The present schedule required that all cash in lieu of be paid before the City approves any construction plans for work authorized by Appendix E. Appendix E is a construction requirement of the City of Grapevine such as streets, water lines, sewer lines, drainage and such. Staff has recommended that the Planning and Zoning Commission consider an amendment to Section 51.E that would provide a payment schedule for small subdivisions that do not require construction plans under Appendix E Construction Requirements. It is staff's recommendation that whenever subdivisions are filed which do not require construction plans that the open space fee be due at the time of acceptance of the plat. The Commission, noted the change would not impact their financing, but would help the City. With a motion by Darlene Freed and a second by Ery Meyer, the Commission approved the Amendment and voted to recommend Staff set a public hearing for the Amendments for Section 51.E., for Requirements for Open Space and Recreational Areas, which would read as follows: or when construction plans are not required by Appendix E., payment shall be due at the time the plats are accepted for filing. with the prevailing vote as follows: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin F. AMENDMENTS TO SECTION 28 CENTRAL BUSINESS DISTRICT: Staff proposed language to amend the CBD District to allow auto repair as a conditional use and allow accessory studios for the production of arts and crafts, furniture, and heritage arts. The amendments to Section 28, Central Business District, would read as follows: B.4. Studios for the production of art, crafts, furniture, and heritage arts which are handmade or handcrafted that do not exceed 20% of the floor area of a retail use. C.3. Automotive repair garages, within a completely enclosed building. Salvage and/or wrecking yards are prohibited. All storage areas must be surfaced and screening shall be provided in accordance with Section 58 and Section 50. 5 The Commission Members asked that they be notified of the meetings one month in advance. With no further discussion, a motion by Curtis Young, a second by Steve Stamos was to recommend Staff set for Public Hearing the amendments to the Planning and Zoning Commission Bylaws, with the following vote: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin City Council Representative, Sharron Spencer recommended the following amendment: (b) it is the intent of the Commission to consider no more than six (6) zoning cases per meeting. With no further discussion, a motion by Larry Oliver, a second by Darlene Freed was to recommend staff add the Amendment to the Bylaws, and set as an agenda item for approval by City Council, with the following vote: Ayes: Cook, Oliver, Meyer, Freed, Stamos and Young Nayes: None Absent: Martin Planner, Marcy Ratcliff reminded the Commission Members of the Planning and Zoning Workshop of the Texas Midwest Chapter of the American Planning Association, at the Brookside Convention Center, scheduled for June 29th, 1992. Ms. Sharron Spencer has agreed to be a panelist at the workshop and encouraged all the Members to attend.
