Tate called the Joint Public Hearing to order at 7:30 P.M. Ron Cook, called the Planning & Zoning Commission to order at 9:10 P.M. INVOCATION: Commission Member Marvin Balvin offered the invocation. JOINT PUBLIC HEARING: CONDITIONAL USE APPLICATION 92-19 SUBMITTED BY PRIZM ARCHITECTS INC.: First on the Agenda for the Commission to consider, and make a recommendation to the City 0 Council was Conditional Use Application 92-19, submitted by Prizm Architects, Ltd. for Wendy's International, Inc. In the public hearing, City Planner, Marcy Ratcliff, stated the applicant is requesting a Conditional Use Permit to amend the approved site plan by adding a second drive through window to the existing Wendy's Restaurant located at 1323 William D. Tate Avenue. The applicant is also requesting a waiver to Section 47.E.2, in accordance with Section 47.F. The addition of the drive through window will contain 42 square feet. Marcy Ratcliff introduced Richard Munoz to address any questions from the chamber. Mayor Tate asked if any guests were present to address the case. With no response, the public hearing was closed. In the Commission's deliberation session a motion by Darlene Freed, and a second by Curtis Young was to recommend approval of Conditional Use 92-19 as submitted with the waiver to specific requirements of Section 47.E.2. pursuant to Section 47.F of Ordinance 52-73 as amended, with the prevailing vote as follows: Ayes: Cook, Oliver, Nays: None Abstain: Martin Young, Balvin, Stamos,_f CONDITIONAL ... • O. TGI • DO Next on the agenda for the Commission to consider, and make a recommendation to the City Council was Conditional Use Application 92-20, submitted by James Mason for TGI Friday's Restaurant for property located at 1041 State Highway 114 West and requested to be platted as Lot 2R, Block 1, The CrossRoads of DFW Addition. City Planner, Marcy Ratcliff, advised the applicant's request was to amend the approved Planned Commercial Center Master Plan to develop a restaurant with possession, storage, and retail sales of on premise consumption of alcoholic beverages (beer, wine, and mixed beverages), and a 40 foot pole sign. The applicant is also requesting a waiver to Section 47.E.2 in accordance with Section 47.F. Marcy Ratcliff introduced Ulys Lane with Weir & Associates representing CrossRoads Joint Venture to address questions from the Chamber regarding shared parking with proposed new businesses and traffic movement to CrossRoads Drive. Larry Frassinelli, Senior Civil Engineer for The City of Grapevine, presented the replat request of lots 2R and 3, Block 1, The CrossRoads of DFW to develop a TGI Friday's Restaurant. Mayor Tate called for comments from guests. With no questions or guests response, for CU92- 20 and replat of Lots 2R & 3, Block 1, The CrossRoads of DFW Addition the public hearing was closed. 2 In the Commission's deliberation session, discussion ensued over the need for a concept plan for Planned Commercial Development. The applicant was requested to present a conceptual drawing of the development at the workshop meeting scheduled January 26, 1993. Commission Member Marvin Balvin made the motion, with a second by Larry Oliver, to recommend approval of the Conditional Use 92-20 with the waiver to specific requirements of Section 47.E.2. pursuant to Section 47.F. of Ordinance 82-73, as amended, with the prevailing vote as follows: Ayes: Cook, Oliver, Young, Balvin, Stamos, Freed Nays: None Abstain: Martin Curtis Young made the motion, with a second by Cathy Martin, to approve the replat of Lots 2R and 3, The CrossRoads of DFW with a prevailing vote of: Ayes: Cook, Oliver, Martin, Young, Balvin, Stamos, Freed Nays: None CONDITIONAL USE APPLICATION 92-21 SUBMITTED BY J. C. JONES Next for the Commission to consider and make a recommendation to the City Council was Conditional Use Application 92-21 submitted by J. C. Jones for property located at 2300 McPherson Drive and to be platted as Lot 1, Block 1, Clairemont Place. In the public hearing, City Planner, Marcy Ratcliff, advised the applicant is requesting a Conditional Use permit to allow a personal care facility (a non-medical facility) in a "R -MF -2" Multifamily District that will accommodate up to 20 persons who require daily living assistance. The applicant is also requesting a waiver to Section 47.E.2. in accordance with Section 47.F. Mr. J. C. Jones, of Clairemont Residential Care Corp., was introduced to address questions from the Chamber in regard to parking and outside lighting adjacent to Austin Oaks Subdivision. Mayor Tate called for comments from guests. Mr David Barnhouse passed on any comments. Mr. J. R. Zengler expressed concerns regarding the use of this facility for drug rehabilitation. Mr. J. D. Elser spoke against the facility being allowed next to Single Family Residential. With no further questions and no letters or petitions, the public hearing was closed. In the Commission's deliberation session, there were questions regarding the parking along the western portion of the property next to Austin Oaks Subdivision in relationship to outdoor lighting and site drainage toward the parking lot area. Curtis Young made a motion, with a second by Marvin Balvin, to recommend approval of Conditional Use 92-21 with a waiver to specific requirements of Section 47.E.2. pursuant to Section 47.F. of Ordinance No. 82-73, as amended. The prevailing vote was as follows: 3 Ayes: Nays: Abstain: Cook, Oliver, Young, Balvin, Stamos and Freed None Martin CONDITIONAL USE APPLICATION 92-22, SUBMITTED BY CHICK-FIL-A RESTAURANTS / REPLAT OF LOTS 3R & 4, BLOCK 1, TATE STREET PLAZA: Next for the Commission to consider and make recommendation to the City Council, was the Conditional Use request to allow a Planned Commercial Center in conjunction with a restaurant with a drive through window for a Chick-Fil-A Restaurant for property located at 1241 W. D. Tate Avenue and requested to be replatted as Lot 3R, Block 1, Tate Street Plaza Addition. Also the applicant is requesting a waiver to Section 47.E.2. in accordance with Section 47.F. Civil Engineer, Larry Frassinelli, presented the replat of Lots 3R and 4, Block 1, Chick-Fil-A Addition. Marcy Ratcliff introduced Ron Sprinkle to address any questions regarding the new restaurant. Mayor Tate asked if any guests were present and wished to speak to the issue. City Secretary, Linda Huff read a letter of approval from Deborah Hyatt. With no guests to speak the hearing was closed. Marvin Balvin made a motion, with a second by Curtis Young, to approve the request with a waiver to specific requirements of Section 47.E.2. pursuant to Section 47.F. of Ordinance No. $2.73, as amended, with the prevailing vote as follows: Ayes: Cook, Oliver, Nays: None Abstain: Martin Young, Balvin,• and Freed Larry Oliver made a motion, with a second by Steve Stamos, to approve the replat of Chick-Fil- A, with the prevailing vote as follows: Ayes: Cook, Oliver, Nays: None Abstain: Martin Young, Balvin, Stamos and Freed ZONING CASE 92-09 AND CONDITIONAL USE REQUEST CU92-23 CENCOR REALTY/TARGET STORES/LUBY'S CAFETERIA / REPLAT OF LOTS 1 & 2, BLOCK 1, TOWNE CENTER ADDITION FOR TARGET STORES AND LOTS 1R2 & 3R1, BLOCK 1, TOWNE CENTER ADDITION FOR LUBY'S CAFETERIA. 4 Next for the Commission to consider was the request to rezone the property containing 57.9165 acres from Planned Commerce Development to Community Commercial. Also, the applicant is requesting a Conditional Use to allow a Planned Commercial Center Designation on the 57.9165 acre tract and on Lots 1-R-2 (future retail) and 3-R-1 (Luby's Cafeteria) allowing for future retail area in conjunction with a Luby's Cafeteria, and a Target Retail Store. The Conditional Use request contains a total of 62.4663 acres. The applicant is also requesting a 40 foot pole sign containing 288 square feet. In addition, the applicant is requesting a waiver to the site plan requirements of Section 47.E.2. in accordance with Section 47.F. Civil Engineer, Larry Frassinelli, presented the replat application of Lots 1-R-1 and 3-R-1, Block 1, Towne Center Addition to construct future retail area and a Luby's Cafeteria. Marcy Ratcliff introduced Larry Cates and Mike Bailey to address any questions regarding the concept plan on the overall project and the rearrangement of Luby's Cafeteria on the lot. Larry Cates showed preliminary drawing to members of the City Council and Planning and Zoning Commission explaining the use of detention ponds for storm drainage. Steve Stamos arrived at 7:45 p.m. and Cathy Martin arrived at 8:15 p.m. in Council Chambers. Linda Huff, City Secretary, read two letters of approval from Payless Shoe Source and the Federal Adjustment Bureau. With no further questions and no guests to speak, the public hearing was closed. In the Commission's deliberation session, members discussed the need for a concept plan for the development of the property, which would show internal streets, traffic movement, storm drainage and proposal for future retail or restaurant development. Larry Cates discussed the proposed storm drainage. Council members requested a concept plan be presented before any other permit request applications were presented. Tommy Hardy, Director of Community Development, clarified that the Conditional Use for Luby's Cafeteria is presented as an alternate plan. Curtis Young made a motion, with a second by Marvin Balvin, to approve Zoning Case 92-09, Conditional Use Request 92-23 with a waiver to Section 47.E.2. in accordance with Section 47.F., with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Young, Balvin, Stamos and Freed Nays: None PRESENTATION OF STATE HIGHWAY 121 CORRIDOR STUDY: Tommy Hardy, Community Development Director, introduced Dan Boutwell of Planning 5 Resources Group, Inc. to present the State Highway 121 Corridor Study his firm had been commissioned to perform. Mr. Boutwell, using prepared maps, showed the existing land use and present zoning of properties located along the south corridor of State Highway 121. Having met in a workshop format with the Planning and Zoning Commission on December 8, 1992, Mr. Boutwell presented his findings on the present land use and proposed changes to land use designation as described in the Master Plan. The Planning and Zoning Commission had worked with Mr. Boutwell to revise the proposed land use designations of undeveloped tracts along the corridor. With no questions from the Planning and Zoning Commission or the City Council members, Mayor Tate asked for comments from guests present. Mr. Kelly Pickett, 2754 Mesquite Lane, expressed concerns over the study and asked for amendments to be tabled until residents could examine the contents and make a recommendation. In order to address the concerns of the homeowners in attendance, Mayor Tate spoke regarding the need for such a study. He explained further, that many applications to change zoning had been brought before the City Council which were not suited for the existing land use. He explained that no action was anticipated tonight and the Planning and Zoning Commission have scheduled another workshop January 26, 1993 to refine the revisions requested of Mr. Boutwell. Mayor Tate clarified that the City Council had requested the study, so that any future development would be in the best interest of all Grapevine residents. Harry Markley, 2927 Mesquite Lane, Western Oaks Subdivision, spoke against the possibility of Multifamily being allowed adjacent to their subdivision at State Highway 121 and Hall - Johnson Road. Ed Givins, 3309 Spruce Lane, Western Oaks Subdivision, addressed the need to provide a gateway to Grapevine through the use of compatible Single Family Residential. Mayor Tate, in reply, stated that a major highway was not a desirable location for Single Family Residential areas. J. R. Zengler, 914 West Hummingbird, requested to know if any schools had been proposed in the land use study area. Bill Crandall, 3302 Sweet Gum Lane, spoke to those present regarding his reasons for moving from Arlington, Texas to Grapevine, Texas, were because of the major changes and increased flow of traffic in the I-20 area of Arlington. Mayor Tate, replied that Grapevine was in a continual process with changing growth patterns and allowing for thoroughfare plans to handle additional traffic as the city develops. C.1 Marvin Balvin, Planning and Zoning Commission Member, asked an open question to those residents from Western Oaks Subdivision whether they would rather have commercial land use instead of multifamily land use next to their area. He suggested they address this question in their homeowner's meetings. Jerry Parson, Manager of the undeveloped property adjacent to Western Oaks Subdivision for the RTC, commented that Single Family would be desirable next to the subdivision and that the prospective purchaser, Centex Homes, was in opposition to any change to rezone the property to any commercial use. With no further questions or comments the Public Hearing was closed. In the Commission's deliberation session no action was taken. FINAL PLAT STEVENSON ADDITION• Next for the Commission to consider was the final plat of the Stevenson Addition. With a motion by Curtis Young, and a second by Steve Stamos to approve the plat as submitted, and the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Young, Balvin, Freed, and Stamos Nays: None PRELIMINARY PLAT FOR LOTS 1 & 2 TOWNE CENTER ADDITION NO. 2 Next for the Commission to consider was the preliminary plat of Lots 1 & 2, Block 1, Towne Center Addition. Curtis Young made the motion, with a second by Marvin Balvin, to approve the plat as submitted. The prevailing vote was as follows: Ayes: Cook, Oliver, Martin, Young, Balvin, Freed, and Stamos Nays: None OLD BUSINESS: Conditional Use Application 92-17 Charles Barbee, having been tabled from November 17, 1992, was readdressed by the Planning and Zoning Commission for changes required in the parking and fire protection zone. Tommy Hardy, Director of Community Development, reported that Bill Powers of the Fire Department, had met with Charles Barbee and worked out a fire protection zone from Main Street access. A new drawing showing head -in parking was presented for approval. Having met all the requirements, Steve Stamos made a motion, with a second by Marvin Balvin to approve the application, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Young, Balvin, Freed, and Stamos Nays: None MISCELLANEOUS REPORTS Marcy Ratcliff reminded everyone of the workshop on January 26, 1993 to discuss to State Highway 121 Corridor Study. Ron Cook requested that concept plans be presented on developments in The CrossRoads of DFW, Towne Center Addition, and Tate Street Plaza be presented at the January 19, 1993 meeting. Also, he requested an update on the Communications Committee to be presented on January 19th.
