CITY OF GRAPEVINE
The Planning and Zoning Commission of the City of Grapevine, Texas, met in Joint
Public Hearing with the City Council, on this the 18th day of May, 1993, in the City
Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the
following members present to wit:

Ron Cook called the Planning & Zoning Commission to order at 8:40 P.M.

BAJA DEVELOPMENT CORPORATION:

First on the Agenda for the Commission to consider and make a recommendation to
the City Council was Zone Change Request Z92-10 Hall -Johnson Partnership, Ltd.,
and Z93-01 Baja Development Corporation. In the public hearing, City Planner, Marcy
Ratcliff explained to City Council Members and Planning and Zoning Commission
members the applicants were requesting to table their applications until June 15,
1993. She also made them aware that a petition was received from the homeowners
residing adjacent to the proposed development asking that Zone Change Request Z92-
10 be tabled and Zone Change Request Z93-01 be withdrawn. Mayor Tate asked for
questions from Planning and Zoning and the Council. Questions were raised regarding
the tabling action of the referenced cases at the previous meeting and the necessity
of allowing the applicants to request tabling action again. Marcy Ratcliff explained the
property covered by Zone Change Request Z93-01 had a new owner and they
requested additional time to address the issues in the application. Members voted to
table any action until June 15, 1993. Mayor Tate explained to the homeowners in
attendance that he understood their frustration and a tablet would be provided for
their names and addresses if they wished to be notified regarding the Zone Change
Requests to be heard June 15, 1993 meeting. With nothing further the public hearing
was closed.
In the Commission's deliberation session, a motion was made by Darlene Freed, with
a second by Curtis Young, to table request Z92-10 and Z93-01 until June 15, 1993.
The prevailing vote was as follows:
Ayes: Cook, Oliver, Martin, Young, Balvin, and Freed

CONDITIONALUSEAPPLICATION CU93-02 - TIA'S INC.:
Next for the Commission to consider and make a recommendation to the City Council
was the Conditional Use Application CU93-02 to amend the approved site plan for the
Hayley Addition Planned Commercial Center filed by Tia's Inc. to allow the
possession, storage and on premise consumption of alcoholic beverages (beer, wine,
and mixed drinks) in conjunction with a restaurant, and a 40 foot pole sign, with a
waiver to specific requirements of Section 47.E.2. pursuant to Section 47.F. of
Ordinance 82-73. In the public hearing, City Planner, Marcy Ratcliff, introduced Mr.
Steve Rimar to address any questions relative to the request. Questions from the
Planning and Zoning Commission addressed lighting, parking, and the location of the
dumpster. Questions from the Council addressed the screening fence, patio noise and
music for the outdoor dining area. Mayor Tate asked if their were any guests to speak
to the request.

Mrs. Bryant of 1203 South Ball Street spoke on Ball Street being used as access to
the developments in the Hayley Addition. James Brackett spoke regarding the use of
Ball Street by beer trucks servicing the restaurants in the Hayley Addition. Nancy
Buscher of 1209 South Ball Street also spoke to these same issues. City Councilman,
Ted Ware, informed the members of the Council there was no posted speed limit sign
on Ball Street. City Manager, Trent Petty, advised the Council that he would
investigate the speed limit sign and have one posted immediately. City Attorney,
John Boyle, addressed the concerns of the use of Ball Street stating there were
ordinances regarding the weight of large vehicles and parking on the street. Also, it
was noted the access to the Hayley Addition from Ball Street was to allow emergency
response vehicles for the fire and police departments.
With nothing further the public hearing was closed.
In the commissions's deliberation session, members discussed the use of Ball Street
by commercial vehicles and the need to protect the citizens residing near Planned
Commercial Centers. Marvin Balvin made a motion, with a second by Larry Oliver, to
approve the request with a waiver to Section 47.E.2. in accordance with Section
47.F. The prevailing vote was as follows:

CONDITIONAL USE APPLICATION CU93-03 - GOOD EATS RESTAURANT:
Next on the agenda for the Commission to consider and make a recommendation to
the City Council was the Conditional Use request filed by Gene Street for Good Eat's
Restaurant to amend the approved site plan for the Tate Street Plaza Addition Planned
Commercial Center to allow the possession, storage, retail sale, and on premise
consumption of alcoholic beverages (mixed beverages, beer and wine) in conjunction
with a restaurant and two 20 foot pole signs on one lot, with a waiver to specific
requirements of Section 47.E.2. pursuant to Section 47.F. of Ordinance 82-73.
Marcy Ratcliff, City Planner, advised the applicant is requesting to amend to approved
site plan of Tate Street Plaza Addition and introduced Kent Holcomb, Architect for
Good Eat's Restaurant, to address any questions. Concerns were addressed regarding
the outdoor lighting and screening from the residents of the Bellaire Addition. Also,
it was noted there would be no access to Ball Street from this development and the
six foot masonary screening fence would be continued across the entire rear of the
property . Patron paging and music for the outside dining area were also discussed.
With no further questions from the Council or the Planning and Zoning Commission,
Mayor Tate asked for comments from guests.

Mrs. Bryant, Mrs. Buscher, and Mr. Brackett of the Bellaire Addition again voiced their
concerns over the changes in their neighborhood resulting from development in the
Tate Street Plaza Addition Planned Commercial Center and the Hayley Addition
Planned Commercial Center.
With no further comments or letters of response the public hearing was closed.
In the Commission's deliberation session, members discussed the necessity of
extending the existing six foot masonary screening fence on the property. Members
addressed concerns of the homeowners regarding the outdoor music and lighting.
A motion by Cathy Martin, with a second by Curtis Young, was to approve the
Conditional Use request, with a waiver to specific requirements of Section
pursuant to • 47.F., with the prevailing • as follows:

Next for the Commission to consider and make a recommendation was Conditional
Use Request 93-04 filed by Pool Road Partnership to amend the approved site plar
to allow revisions to the site plan, and a waiver to specific requirements of Section
47.E.2. pursuant to Section 47.F. of Ordinance 82-73. Marcy Ratcliff, City Planner,
introduced Ron McFarland to address any questions on the changes to the Dalton OV,
project.
With no questions from the Commission or the City Council, Mayor Tate asked for
response from any guests wanting to speak to the case. With no guests present to
speak to the case or any written response the public hearing was closed.
In the Commission's deliberation session Curtis Young made a motion to approve the
Conditional Use to amend the approved site plan with a waiver to specific
requirements of Section 47.E.2. pursuant to Section 47.F. Larry Oliver seconded the
motion and the prevailing vote was as follows:

Next for the Commission to consider and make a recommendation was the plat
request for the Belfort Addition.
Larry Oliver, with a second by Cathy Martin, was to table the request with the
prevailing vote as follows:

Nays: None

CONSIDERATION OF MINUTES OF APRIL 20 1993
Next for the Commission to consider were the minutes of April 20, 1993.
Marvin Balvin, with a second by Cathy Martin, made a motion to accept the minutes
as amended. The prevailing vote was as follows:
Ayes: Cook, Oliver, Martin, Young, Balvin, and Freed
Nays: None
Absent: Stamos
MISCELLANEOUS
Marcy Ratcliff, City Planner, reminded the Commission members that a tri -annual
workshop would be held May 25th. Recommendations for discussion at the
workshop were parking lots in residential areas; drive cuts, and distances between
drive cuts; William D. Tate/Highway 121 Corridor Study.
Marvin Balvin reported on his trip to the National American Planning Association
Conference in Chicago to learn more about the planning process.
ADJOURNMENT:
With no further business for the Commission to consider, a motion by Larry Oliver and
a second by Cathy Martin was to adjourn the meeting at 9:45 PM, with the prevailing
vote as follows:
