HomeMy WebLinkAbout1993-07-20STATE OF TEXAS COUNTY OFTARRANT CITY OF GRAPEVINE The Planning and Zoning Commission of the City of Grapevine, Texas, met in Joint Public Hearing with the City Council, on this the 20th day of July, 1993, in the City Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Ron Cook Larry Oliver Cathy Martin Curtis Young Marvin Balvin Steve Stamos Darlene Freed Chairman Vice Chairman Member Member Member Member Member constituting a quorum, and the following City Staff: H. T. (Tommy) Hardy Greg Wheeler Marcy Ratcliff Ray Collins Teresa Wallace David Nighswonger Director of Community Development Building Official Planner Planner Planning Secretary Civil Engineer Mayor William D. Tate called the Joint Public Hearing to order at 7:35 P.M. Chairman Ron Cook called the Planning & Zoning Commission to order at 10:05 P.M. INVOCATION: Planning and Zoning Commission member Marvin Balvin offered the invocation. JOINT PUBLIC HEARING: CONDITIONAL USE CASE CU93-06 - HERITAGE CENTER First on the Agenda for the Commission to consider and make a recommendation to the City Council was Conditional Use Request CU93-06 The Heritage Center. In the public hearing, City Planner, Marcy Ratcliff related the Heritage Center was requesting 1 a Conditional Use permit to allow the possession, storage, retail sale, and on -premise consumption of alcoholic beverages (mixed beverages, beer and wine) in conjunction with the Heritage Center's special events such as GrapeFest and Main Street Days. with the possession, storage, retail sales and on -premise consumption not being on an ongoing basis. She explained the applicant is also requesting a waiver to Section 47.E.2. in accordance with Section 47.F. Ron Emrich, Heritage Foundation Director, was introduced to answer any questions regarding the request. Ron Emrich told the Mayor, City Council and the Planning and Zoning Commission members the request for the alcoholic beverage permit was to alleviate the problems incurred with acquiring the special events licenses for the booths serving alcoholic beverages on Main Street during annual events on Main Street. Mayor Tate asked if there were any guests who wished to address the requests. Bruce Rider of 325 West Worth Street questioned the storage of alcoholic beverages on the Heritage Center property as conflicting with the intention of the center. In response, Ron Emrich stated that alcoholic beverages would not be stored on the premises except during special events times only. It was noted that the site plan did not stipulate that alcoholic beverages would not be stored on the premises. The applicant was instructed to correct the error. John Armistead questioned whether alcoholic beverages would be sold on the property even on festival weekends. Ron Emrich responded that the permit would allow them to license booths on the street and it was not intended that alcoholic beverages would be sold on the property. With no one else to speak, and no letters or petitions the public hearing was closed. In the Commission's deliberation session, Ron Emrich requested that the Planning and Zoning Commission table action on the request until September 21, 1993. Darlene Freed moved, with a second by Larry Oliver, to table request CU93-06 until the date requested by applicant. The prevailing vote was as follows: Ayes: Cook, Oliver, Martin, Young, and Freed Nays: Balvin, Stamos CONDITIONAL USE REQUEST CU93-07 - FELLOWSHIP OF LAS COLINAS CHURCH: Next for the Commission to consider and make a recommendation to the City Council was the Conditional Use Request CU93-07 to allow a church to be developed on 21.002 acres under the standard development option of the "PID" Planned Industrial District. In the public hearing, Planner, Marcy Ratcliff, introduced Mr. David Hardesty to address any questions relative to the request. David Hardesty introduced Ed Young, 0 Pastor, Jeff Williams, Engineer, David Shanks, Architect, to address any questions regarding the development of the project, and John Joiner to address environmental noise issues. Questions from the Council and Planning and Zoning Commission members addressed Noise Zone Corridors "B" and "C" of the Dallas/Ft. Worth Airport existing and proposed east runway relative to the needs of a church. Also, questions arose concerning the property lying in both Grapevine and Coppell and interlocal agreements regarding utilities. Mayor Tate called for a recess before guests were invited to speak. The hearing was reconvened at 9:35. The following guests spoke in favor of the granting the request. Stan Waldrip, 1607 Dowling, Irving, Texas Chris Coy, 2166 Wedgewood Drive, Grapevine, Texas Brett Vezch, 1919 Stafford, Grapevine, Texas John Peterson, 4307 Greenwood, Grapevine, Texas With no further guests to speak, and no letters of petition, Mayor Tate inquired of Tommy Hardy as to whether any deviation had ever been made on requests in Noise Zone "B". Concerns on permitting a church in the airport runway path troubled members of the City Council and the effect of aircraft noise on the quiet enjoyment of the church in the future. Council member Jerry Pittman suggested the request be tabled to allow the City's Noise Consultant, Andy Harris, an opportunity to review the plan. Commission member Curtis Young moved to table the request until August 17, 1993. Darlene Freed seconded the motion, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Young, Balvin, Freed and Stamos Nays: None ZONE REQUEST Z93-06 TOWN PARK ADDITION In the Commission's deliberation session, City Planner, Marcy Ratcliff explained the recommendation by Staff to table the request since Staff has made requests of the airport to furnish noise control information on the subject property with no response. Staff's opinion was that no response would be received from the airport and the city would need to make a determination based on noise zone information received from consultants, Freese & Nichols. Steve Stamos made a motion, with a second by Curtis Young, to approve zone change application Z93-06, with the prevailing vote as follows: 3 Ayes: Abstain: Cook, Oliver, Martin, Young, Freed and Stamos Balvin The plat request was part of the tabling action of Fellowship of Las Colinas Church and will be heard on August 17, 1993. REPLAT - LOTS 8R & 9R, BLOCK 3,.PLACID PENINSULA ADDITION: Next for the Commission to consider and make a recommendation was the replat of Lots 8R & 9R, Placid Peninsula Addition. Catherine Martin made a motion to approve, with a second by Steve Stamos and the prevailing vote was as follows: Ayes: Cook, Oliver, Martin, Young, Balvin, Freed, and Stamos Nays: None CONSIDERATION 0 F MINUTES -Q-E-MAY 25, 1993 Next for the Commission to consider were the minutes of May 25, 1993. Marvin Balvin, with a second by Curtis Young, made a motion to accept the minutes as amended. The prevailing vote was as follows: Ayes: Cook, Oliver, Young, Balvin, Stamos, and Freed Nays: None Abstain: Martin CONSIDERATION OF MINUTES OF JUNE 8, 1993 Next for the Commission to consider were the minutes of June 8, 1993. Curtis Young, with a second by Larry Oliver, made a motion to accept the minutes as written, with the prevailing vote as follows: Ayes: Cook, Oliver, Martin, Nays: None Abstain: Balvin Young, Stamos and Freed 4 CONSIDERATION OF MINUTES OF JUNE 15 1993 Next for the Commission to consider were the minutes of June 15, 1993.
