PLANNING & ZONING CONFERENCE ROOM SECOND FLOOR 200 SOUTH MAIN STREET CALL TO ORDER WORK SESSION 1. Planning & Zoning Commission to conduct a briefing session to discuss items scheduled to be heard in the April 17, 2012 public hearing. 2. Discuss possible amendments to Appendix D, Comprehensive Zoning Ordinance No. 82-73, as amended, relative to vacation rentals in single family residential districts. Chairman Oliver announced the Planning and Zoning Commission would conduct a work session relative to the following cases: CU12-05 GRAPEVINE KAWASAKI CU12-09 PARK PLACE LEXUS CU12-10 TINT WORLD to discuss development issues. WORK SESSION ITEM 2. Discussion was held regarding vacation rentals in single family residential districts. Hotel/Motel tax should be collected on places used for sleeping less than 30 days. The Commission thought it would be a good idea to have vacation rental home owners 041712BS 0 P & Z BRIEFING SESSION APRIL 17, 2012 register with the City, collect hotel/motel tax and provide the surrounding property owners with their contact information. Consider Conditional Use Application CU12-09 (Park Place Lexus) and make a recommendation to the City Council. 3. Consider Conditional Use Application CU12-10 (Tint World) and make a recommendation to the City Council. CONSIDERATION OF MINUTES 4. Consider the minutes of the March 20, 2012 Planning & Zoning Commission meetings and take any necessary action. JOINT PUBLIC HEARINGS CONDITIONAL USE APPLICATION CU12-05 GRAPEVINE KAWASAKI First for the Commission to consider and make recommendation to City Council was conditional use permit to amend the previously approved site plan of CU04-06 (Ord. 04- 21) for a motorcycle dealership with sales and service of new and used motorcycles, ATV, watercraft and associated equipment specifically to allow for a 40 -foot pole sign. Mr. Dennis Wagner, the applicant, was available to answer questions and requested favorable consideration. 041712 1 P & Z JOINT PUBLIC HEARING APRIL, 17, 2012 With no further questions, guests to speak, one letter of support, the public hearing was closed. In the Commission's deliberation session, 8 J Wilson moved to approve conditional use application CU12_05. Elaine Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Fechter, G. Martin, Tiggelaar, E. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CU12-09 -PARK PLACE LEXUS Next for the Commission to consider and make recommendation to City Council was conditional use application CU12-09 for property located at 901 East State Highway 114 and platted as Lot 1, Block 1, Park Place Lexus Addition. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU05-25 (Ord. 2005-40) for an automobile dealership with sales and service of new and used vehicles specifically for additions to the service bay, pre -owned sales office, service drive and car wash. Mr. Scott Sower, representing the applicant, was available to answer questions requested favorable consideration. With no further questions; guests-. to speak, nor letters or petitions, the public, hearing was closed. In the Commission's deliberation. session-, B J.Wilson moved to approve conditional use application CUl 2-09. Wayne Szdt seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Fechter, G. Martin, Tiggelaar, E. Martin and Szot Nays: None CONDITIONAL USE APPLICATION CUl 2-10 - TINT WORLD Next for the Commission to consider and make recommendation to City Council was conditional use application CU12-10 submitted by John Evans for property located at 1231 William D Tate Avenue and platted. as Lot 4R1, Block 1, Tate Street Plaza Revised. The applicant was requesting a conditional use permit to amend the previously approved site plan of CU99-05 (Ord,. 99-46) for a planned commercial center, specifically to allow for automotive repair (window tinting, audio, detailing and alarm) within a completely enclosed building. At the February 21, 2012 meeting the Planning and Zoning Commission and the City Council heard in a public hearing conditional:use request CU12-01 for automotive repair relative to window tinting, oUtdoor automotive detailing and audiolalarm installation. 041712 2 P & Z JOINT PUBLIC HEARING APRIL 17, 2012 The Planning and Zoning Commission approved the request however, it was denied by the City Council. At the March 21, 2012 meeting Council reconsidered the previous vote to deny CU12-01. Due to changes proposed by the applicant, the Council amended the previous vote to a "denial without prejudice" allowing a new conditional use application to be submitted. Mr. John Evans, the applicant, was available to answer questions requested favorable consideration. Mr. Evans informed the City Council and Planning and Zoning Commission that the tenant has decided to air condition that service bay and keep the overhead door down at all times except to move vehicles in and out. Mr. Evans stated that he also intends to make changes to the elevation of the entire building. With no further questions, guests to speak, nor letters or petitions, the public hearing was closed. In the Commission's deliberation session, B J Wilson moved to approve conditional use application CU12-10. Jimmy Fechter seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Fechter, G. Martin, Tiggelaar, E. Martin and Szot Nays: None 1 • - 1-104101M.11 CONSIDERATION ; • CONSIDERATION OF MINUTES Next for the Commission to consider were the minutes of the March 20, 2012 Planning and Zoning joint public hearing. B J Wilson moved to approve the Planning and Zoning Commission minutes of March 20, 2012. Gary Martin seconded the motion, which prevailed by the following vote: Ayes: Oliver, Wilson, Fechter, G. Martin and Tiggelaar Nays: None Abstain: E. Martin and Szot ADJOURNMENT With no further business to discuss, B J Wilson moved to adjourn the meeting at 8:06 p.m. Elaine Martin seconded the motion which prevailed by the following vote: Ayes: Oliver, Wilson, Fechter, G. Martin, Tiggelaar, E.
