Grapevine Lake l oVe - PROPERTY LOCATION AND SIZE: s 41 I.H.1635 Northwest The subject property is addressed at 815 South Main ods 42 Street, as well as 217 and 255 East Dallas Road. The )1 „ property is proposed to be platted as Lot 1, Block 1, low Grapevine Main. The addition contains 4.459 acres I Hall-Johnson S ,? '41r/FDI s and has 200 feet of frontage along South Main Street and 670 feet of frontage along Dallas Road. LJ °i Glade Rd. ` I 0 REQUESTED ZONE CHANGE, CONDITIONAL USE, SPECIAL USE, PLANNED DEVELOPMENT OVERLAY AND COMMENTS: The applicant is requesting a zone change to rezone 4.459 acres from "LI” Light Industrial District to "GU" Governmental Use District for the development of a rail station, hotel, and parking garage, a conditional use permit to establish a hotel and restaurant with the possession, storage, retail sale and on-premise consumption of alcoholic beverages(beer, wine and mixed drinks) and a special use permit to establish a public rail station facility. Lastly the applicant is requesting a planned development overlay to deviate from but not be limited to building setback requirements relative to the "LI" Light Industrial District. As part of the TexRail regional commuter rail project, the City of Grapevine is partnering with Coury Hospitality to construct a rail station, hotel, and parking facility on a 4.459 acre tract at the northeast corner of South Main Street and East Dallas Road. Directly at the corner, a large open air landscaped plaza with a public art area, water feature, and stage for outdoor events is proposed. Moving eastward from the outdoor plaza, the six story(80 feet in height) rail station is proposed with the first floor consisting of a market hall, great hall and a restaurant/retail lease area that combines meeting, retail and restaurant space in one homogenous area along with a second floor that contains offices and additional meeting space. The third floor is open to the area below with the fourth floor consisting of a large ballroom, meeting spaces and a pre-function area. The fifth floor is open to the fourth floor ballroom/meeting room area below. There is also stairwell and elevator access to the clock tower that is 150 feet in height along the western elevation. Immediately adjacent to the east of the train station is the six story(85 feet in height) hotel containing 121 rooms with the first floor consisting of the main lobby, restaurant/bar/dining area as well as private dining space, billiard room, and hotel office and operations areas. Floors two through six consist primarily of the guest rooms which range from 349 s.f. for a standard room up to 1,216 s.f. for an executive suite. Parking will be provided by the five level parking garage immediately adjacent to the east of the hotel with a total of 552 spaces. A small multi-tenant retail lease space area (1,868 s.f.) is available on the first floor of the garage along East Dallas Road. Relative to the retail/restaurant areas in the train station, the room count and restaurant area in the hotel and the small retail area in the garage, and the TexRail overall parking requirement for all functions is approximately 532 spaces. Given the 552 provided, 30 excess parking spaces are available to visitors to the downtown area. A parking study was conducted (see attached) that determined a weekday demand for the train station and hotel (with a five percent additional buffer) of 356 spaces and a weekend demand (with a five percent additional buffer)of 376 spaces which provides an excess of 196 weekday spaces and 176 spaces during the weekend. Relative to the planned development overlay the zoning ordinance requires for property zoned "GU" Governmental Use District to provide building setbacks no less than those of the most restrictive abutting district which in this particular instance is "LI" Light Industrial District immediately adjacent to the east; this fifteen foot building setback is encroached upon by the parking garage approximately four feet near the southeast corner of the garage. Signage will consist of a monument sign which is part of a larger design feature in front of the drop-off area to the hotel (54 s.f.) as well as a projecting hotel roof sign (150 s.f.) along the south elevation of the hotel. Two projecting blade signs (100 s.f.) projecting approximately four feet from the eastern and western building elevations of the parking garage will denote the entrance to the garage. Section 60, Sign Standards provides a mechanism for the Commission and Council to consider this type of signage(roof sign and projecting sign) though the conditional use process. PRESENT ZONING AND USE: The property is currently zoned "LI" Light Industrial District and is vacant; the previously existing building has been demolished and the site is awaiting construction pending zoning approval. HISTORY OF TRACT AND SURROUNDING AREA: The subject and surrounding property was rezoned from "L-I" Limited Industrial District to "LI" Light Industrial District during the 1984 City Rezoning. The property to the south of Dallas Road was rezoned from "C-2" Community Business District and "L-I" Limited Industrial District to "PO" Professional Office District during the 1984 City Rezoning. At the November 17, 1998 joint public hearing Council approved a rezoning of the property to the west from "LI" Light Industrial District to "CBD" Central Business District (Z98-24; Ord. 98- 136)and a conditional use permit(CU98-58; Ord. 98-147)for an artisan studio. The Board of Zoning Adjustment approved at their December 7, 1998 public hearing (BZA98-40) a total variance to the 70 percent masonry requirement in the"CBD" Central Business District on this same site to the west thus allowing the metal buildings to exist as developed. At the April 6, 1999 meeting a conditional use permit was granted (CU99-19)for a winery with on- and off-premise consumption of alcoholic beverages (wine only)on the property to the west. A conditional use permit (CU01-65) for a restaurant with on-premise alcoholic beverage consumption called "The Venue"was approved by Council at their December 18, 2001 meeting on this same property; however, the restaurant closed shortly thereafter. At Council's December 21 , 2004 meeting a conditional use permit was approved (CU04-41) for a restaurant with on-premise alcoholic beverage sales in the same location previously occupied by The Venue. Conditional Use Request CU05-47(Ord. 2005-47)was approved at the August 16, 2005 meeting to allow for an expansion of an existing restaurant (Main Street Blues Room) into Building B or 816 South Main Street. Lastly, a conditional use permit (CU11-07) was also approved on the property to the west to allow for a murder mystery concept with on-premise alcohol beverage sales in conjunction with a restaurant. SURROUNDING ZONING AND EXISTING LAND USE: NORTH: "GU" Governmental Use District—Grapevine Vintage Railroad Train Station area SOUTH: "MXU" Mixed Use District—The Resort at 925 multifaimily, retail, restaurant mixed use project EAST: "LI" Light Industrial District—Sunbelt Rental WEST: "CBD" Central Business District—Chill restaurant, Murder Mystery Theater AIRPORT IMPACT: The subject tract is located within "Zone A" zone of minimal effect as defined on the "Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities such as auditoriums, churches, schools, hospitals, and theaters. The proposed rail station/hotel/parking garage is an appropriate use in this noise zone. MASTER PLAN APPLICATION: The Master Plan designates the subject property as a Commercial/Mixed Use Land Use. The proposed rail station/hotel/parking garage is not in compliance with the Master Plan. and WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing called by the City Council of the City of Grapevine, Texas did consider the following factors in making a determination as to whether this requested change should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, the effect on adequate light and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation, water, sewerage, schools, parks and other public facilities; and WHEREAS, the City Council further considered among other things the character of the district and its peculiar suitability for particular uses and with the view to conserve the value of buildings, encourage the most appropriate use of land throughout this city; and WHEREAS, the City Council of the City of Grapevine, Texas does find that there is a public necessity for the zoning change, that the public demands it, that the public interest clearly requires the amendment, that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; This ordinance shall be cumulative of all other ordinances of the City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the provisions of this ordinance. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 7. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to Ordinance No. 2017-072 3 exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 8. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, and it is accordingly so ordained.
