REQUESTED ZONE CHANGE, CONDITIONAL USE, SPECIAL USE, PLANNED
DEVELOPMENT OVERLAY AND COMMENTS:
The applicant is requesting a zone change to rezone 4.459 acres from "LI” Light Industrial
District to "GU" Governmental Use District for the development of a rail station, hotel, and
parking garage, a conditional use permit to establish a hotel and restaurant with the
possession, storage, retail sale and on-premise consumption of alcoholic beverages(beer,
wine and mixed drinks) and a special use permit to establish a public rail station facility.
Lastly the applicant is requesting a planned development overlay to deviate from but not be
limited to building setback requirements relative to the "LI" Light Industrial District.
As part of the TexRail regional commuter rail project, the City of Grapevine is partnering
with Coury Hospitality to construct a rail station, hotel, and parking facility on a 4.459 acre
tract at the northeast corner of South Main Street and East Dallas Road. Directly at the
corner, a large open air landscaped plaza with a public art area, water feature, and stage
for outdoor events is proposed. Moving eastward from the outdoor plaza, the six story(80
feet in height) rail station is proposed with the first floor consisting of a market hall, great
hall and a restaurant/retail lease area that combines meeting, retail and restaurant space in
one homogenous area along with a second floor that contains offices and additional
meeting space. The third floor is open to the area below with the fourth floor consisting of a
large ballroom, meeting spaces and a pre-function area. The fifth floor is open to the
fourth floor ballroom/meeting room area below. There is also stairwell and elevator access
to the clock tower that is 150 feet in height along the western elevation.
Immediately adjacent to the east of the train station is the six story(85 feet in height) hotel
containing 121 rooms with the first floor consisting of the main lobby, restaurant/bar/dining
area as well as private dining space, billiard room, and hotel office and operations areas.
Floors two through six consist primarily of the guest rooms which range from 349 s.f. for a
standard room up to 1,216 s.f. for an executive suite.
Parking will be provided by the five level parking garage immediately adjacent to the east of
the hotel with a total of 552 spaces. A small multi-tenant retail lease space area (1,868
s.f.) is available on the first floor of the garage along East Dallas Road. Relative to the
retail/restaurant areas in the train station, the room count and restaurant area in the hotel
and the small retail area in the garage, and the TexRail overall parking requirement for all
functions is approximately 532 spaces. Given the 552 provided, 30 excess parking spaces
are available to visitors to the downtown area. A parking study was conducted (see
attached) that determined a weekday demand for the train station and hotel (with a five
percent additional buffer) of 356 spaces and a weekend demand (with a five percent
additional buffer)of 376 spaces which provides an excess of 196 weekday spaces and 176
spaces during the weekend.
Relative to the planned development overlay the zoning ordinance requires for property
zoned "GU" Governmental Use District to provide building setbacks no less than those of
the most restrictive abutting district which in this particular instance is "LI" Light Industrial
District immediately adjacent to the east; this fifteen foot building setback is encroached
upon by the parking garage approximately four feet near the southeast corner of the
garage.
Signage will consist of a monument sign which is part of a larger design feature in front of
the drop-off area to the hotel (54 s.f.) as well as a projecting hotel roof sign (150 s.f.) along
the south elevation of the hotel. Two projecting blade signs (100 s.f.) projecting
approximately four feet from the eastern and western building elevations of the parking
garage will denote the entrance to the garage. Section 60, Sign Standards provides a
mechanism for the Commission and Council to consider this type of signage(roof sign and
projecting sign) though the conditional use process.
PRESENT ZONING AND USE:
The property is currently zoned "LI" Light Industrial District and is vacant; the previously
existing building has been demolished and the site is awaiting construction pending zoning
approval.
HISTORY OF TRACT AND SURROUNDING AREA:
The subject and surrounding property was rezoned from "L-I" Limited Industrial District to
"LI" Light Industrial District during the 1984 City Rezoning. The property to the south of
Dallas Road was rezoned from "C-2" Community Business District and "L-I" Limited
Industrial District to "PO" Professional Office District during the 1984 City Rezoning. At the
November 17, 1998 joint public hearing Council approved a rezoning of the property to the
west from "LI" Light Industrial District to "CBD" Central Business District (Z98-24; Ord. 98-
136)and a conditional use permit(CU98-58; Ord. 98-147)for an artisan studio. The Board
of Zoning Adjustment approved at their December 7, 1998 public hearing (BZA98-40) a
total variance to the 70 percent masonry requirement in the"CBD" Central Business District
on this same site to the west thus allowing the metal buildings to exist as developed. At
the April 6, 1999 meeting a conditional use permit was granted (CU99-19)for a winery with
on- and off-premise consumption of alcoholic beverages (wine only)on the property to the
west. A conditional use permit (CU01-65) for a restaurant with on-premise alcoholic
beverage consumption called "The Venue"was approved by Council at their December 18,
2001 meeting on this same property; however, the restaurant closed shortly thereafter. At
Council's December 21 , 2004 meeting a conditional use permit was approved (CU04-41)
for a restaurant with on-premise alcoholic beverage sales in the same location previously
occupied by The Venue. Conditional Use Request CU05-47(Ord. 2005-47)was approved
at the August 16, 2005 meeting to allow for an expansion of an existing restaurant (Main
Street Blues Room) into Building B or 816 South Main Street. Lastly, a conditional use
permit (CU11-07) was also approved on the property to the west to allow for a murder
mystery concept with on-premise alcohol beverage sales in conjunction with a restaurant.

WEST: "CBD" Central Business District—Chill restaurant, Murder Mystery
Theater
AIRPORT IMPACT:
The subject tract is located within "Zone A" zone of minimal effect as defined on the
"Aircraft Sound Exposure: Dallas/Fort Worth Regional Airport Environs" map. Few
activities will be affected by aircraft sounds in Zone A, except for sound sensitive activities
such as auditoriums, churches, schools, hospitals, and theaters. The proposed rail
station/hotel/parking garage is an appropriate use in this noise zone.
MASTER PLAN APPLICATION:
The Master Plan designates the subject property as a Commercial/Mixed Use Land Use.
The proposed rail station/hotel/parking garage is not in compliance with the Master Plan.
THOROUGHFARE PLAN APPLICATION:
The Thoroughfare Plan designates Dallas Road and South Main Street as Type C, Minor
Arterials with a minimum 80-foot right-of-way developed as 4 lanes with a center left turn
lane.

AN ORDINANCE AMENDING ORDINANCE NO. 82-73, THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS
APPENDIX "D" OF THE CITY CODE OF GRAPEVINE,
TEXAS, GRANTING ZONING CHANGE Z17-06 ON A TRACT
OF LAND OUT OF THE WILLIAM DOOLEY SURVEY,
ABSTRACT NO. 422, DESCRIBED AS BEING A TRACT OF
LAND LYING AND BEING SITUATED IN THE CITY OF
GRAPEVINE, TARRANT COUNTY, TEXAS MORE FULLY
AND COMPLETELY DESCRIBED IN THE BODY OF THIS
ORDINANCE; (815 SOUTH MAIN STREET, 217 AND 255
EAST DALLAS ROAD) ORDERING A CHANGE IN THE USE
OF SAID PROPERTY FROM "LI" LIGHT INDUSTRIAL
DISTRICT TO "GU" GOVERNMENTAL USE DISTRICT;

WHEREAS, applications were made to amend the Official Zoning Map, City of
Grapevine, Texas by making applications for same with the Planning and Zoning
Commission of the City of Grapevine, Texas as required by State statutes and the zoning
ordinances of the City of Grapevine, Texas and all the legal requirements, conditions and
prerequisites having been complied with, the case having come before the City Council of
the City of Grapevine, Texas after all legal notices, requirements, conditions and
prerequisites having been complied with; and
WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing
called by the City Council did consider the following factors in making a determination as to
whether these requested changes should be granted or denied; safety of the motoring
public and the pedestrians using the facilities in the area immediately surrounding the site;
safety from fire hazards and measures for fire control, protection of adjacent property from
flood or water damages, noise producing elements and glare of the vehicular and
stationary lights and effect of such lights on established character of the neighborhood,
location, lighting and types of signs and relation of signs to traffic control and adjacent
property, street size and adequacy of width for traffic reasonably expected to be generated
by the proposed use around the site and in the immediate neighborhood, adequacy of
parking as determined by requirements of this ordinance for off-street parking facilities,
location of ingress and egress points for parking and off-street locating spaces, and
protection of public health by surfacing on all parking areas to control dust, effect on the
promotion of health and the general welfare, effect on light and air, the effect on the
transportation, water sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas at a public hearing
called by the City Council of the City of Grapevine, Texas did consider the following factors
in making a determination as to whether this requested change should be granted or
denied; effect on the congestion of the streets, the fire hazards, panics and other dangers
possibly present in the securing of safety from same, the effect on the promotion of health
and the general welfare, the effect on adequate light and air, the effect on the
overcrowding of the land, the effect on the concentration of population, the effect on the
transportation, water, sewerage, schools, parks and other public facilities; and
WHEREAS, the City Council further considered among other things the character of
the district and its peculiar suitability for particular uses and with the view to conserve the
value of buildings, encourage the most appropriate use of land throughout this city; and
WHEREAS, the City Council of the City of Grapevine, Texas does find that there is
a public necessity for the zoning change, that the public demands it, that the public interest
clearly requires the amendment, that the zoning changes do not unreasonably invade the
rights of those who bought or improved property with reference to the classification which
existed at the time their original investment was made; and does find that the change in
zoning lessens the congestion in the streets, helps secure safety from fire, panic and other
dangers; promotes health and the general welfare; provides adequate light and air;
prevents the overcrowding of land; avoids undue concentration of population; facilitates the
adequate provisions of transportation, water, sewerage, schools, parks and other public
requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas has determined that
there is a necessity and need for this change in zoning and has also found and determined
that there has been a change in the conditions of the property surrounding and in close
proximity to the property requested for a change since this property was originally
classified; and, therefore, feels that a change in zoning classification for the particular piece
of property is needed, is called for, and is in the best interest of the public at large, the
citizens of the City of Grapevine, Texas and helps promote the general health, safety, and
welfare of this community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City of Grapevine Ordinance No. 82-73, being the
Comprehensive Zoning Ordinance of the City of Grapevine, Texas same being also known
as Appendix "D" of the City Code of Grapevine, Texas, be, and the same is hereby
amended and changed by Zoning Application Z17-06 to rezone the following described
property to-wit: being a 4.459 acre tract of land out of the William Dooley Survey, Abstract
Ordinance No. 2017-069 2
No. 422, Tarrant County, Texas (815 South Main Street, 217 East Dallas Road and 255
East Dallas Road), more fully and completely described in Exhibit"A", attached hereto and
made a part hereof, which was previously zoned "LI" Light Industrial District is hereby
changed to "GU" Governmental Use District, all in accordance with Comprehensive Zoning
Ordinance No. 82-73, as amended.
Section 2. The City Manager is hereby directed to correct the official zoning map
of the City of Grapevine, Texas to reflect the herein change in zoning.
Section 3. That in all other respects, the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinances and all other applicable and pertinent ordinances of the City
of Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future, to lessen congestion in the streets; to secure safety from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. This ordinance shall be cumulative of all other ordinances of the City of
Grapevine, Texas affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances are in direct
conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to
exceed two thousand dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
Ordinance No. 2017-069 3
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.

Texas, as recorded in Volume 388-D, Page 333, of the Plat Records of Tarrant County,
Texas (P.R.T.C.T.) and being all of a called 4.2529 acre tract of land described in
instrument to the City of Grapevine, as recorded in Instrument No. D209250024 of the
Deed Records of Tarrant County, Texas (D.R.T.C.T.), and being a portion of a 0.1363

adequacy of parking as determined by requirements of this ordinance for off-street parking
facilities; location of ingress and egress points for parking and off-street locating spaces,
and protection of public health by surfacing on all parking areas to control dust; effect on
the promotion of health and the general welfare; effect on light and air; the effect on the
overcrowding of the land; the effect on the concentration of population; the effect on the
transportation, water, sewerage, schools, parks and other facilities; and
WHEREAS, the City Council of the City of Grapevine, Texas, at a public hearing
called by the City Council of the City of Grapevine, Texas, did consider the following factors
in making a determination as to whether this requested conditional use permit should be
granted or denied; effect on the congestion of the streets, the fire hazards, panics and
other dangers possibly present in the securing of safety from same, the effect on the
promotion of health and the general welfare, effect on adequate light and air, the effect on
the overcrowding of the land, the effect on the concentration of population, the effect on
the transportation, water, sewerage, schools, parks and other public facilities; and
WHEREAS, all of the requirements of Section 48 of Ordinance No. 82-73 have been
satisfied by the submission of evidence at a public hearing; and
WHEREAS, the City Council further considered among other things the character of
the existing zoning district and its peculiar suitability for particular uses and with the view to
conserve the value of buildings and encourage the most appropriate use of land
throughout this City; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that there is
a public necessity for the granting of this conditional use permit, that the public demands it,
that the public interest clearly requires the amendment, that the zoning changes do not
unreasonably invade the rights of those who bought or improved property with reference to
the classification which existed at the time their original investment was made; and
WHEREAS, the City Council of the City of Grapevine, Texas, does find that the
conditional use permit lessens the congestion in the streets, helps secure safety from fire,
panic and other dangers, prevents the overcrowding of land, avoids undue concentration of
population, facilitates the adequate provisions of transportation, water, sewerage, schools,
parks and other public requirements; and
WHEREAS, the City Council of the City of Grapevine, Texas, has determined that
there is a necessity and need for this conditional use permit and has also found and
determined that there has been a change in the conditions of the property surrounding and
in close proximity to the property requested for a change since this property was originally
classified and, therefore, feels that the issuance of this conditional use permit for the
particular piece of property is needed, is called for, and is in the best interest of the public
at large, the citizens of the City of Grapevine, Texas, and helps promote the general health,
safety and welfare of this community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That the City does hereby issue a conditional use permit in
accordance with Section 48 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance
Ordinance No. 2017-070 2
of the City of Grapevine, Texas, same being also known as Appendix"D" of the City Code,
by granting Conditional Use Permit CU17-20 to establish a hotel and restaurant to allow
the possession, storage, retail sales, and on-premise consumption of alcoholic beverages
(beer, wine and mixed beverages) in a district zoned "GU" Governmental Use District
Regulations within the following described property: Lot 1, Block 1, Grapevine Main (815
South Main Street, 217 East Dallas Road and 255 East Dallas Road) all in accordance with
a site plan approved pursuant to Section 47 of Ordinance No. 82-73, attached hereto and
made a part hereof as Exhibit "A", and all other conditions, restrictions, and safeguards
imposed herein, including but not limited to the following: None.
Section 2. That the City Manager is hereby directed to amend the official zoning
map of the City of Grapevine, Texas, to reflect the herein conditional use permit.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of
Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. That this ordinance shall be cumulative of all other ordinances of the
City of Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. That any person violating any of the provisions of this ordinance shall
be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum
not to exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.

Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace

and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.

accordance with Section 41 of Ordinance No. 82-73, the Comprehensive Zoning Ordinance
of the City of Grapevine, Texas, same being also known as Appendix"D" of the City Code,
by granting Planned Development Overlay PD17-03 to deviate from but not be limited to
the building setback requirements relative to the "LI" Light Industrial District within the
following described property: Lot 1, Block 1, Grapevine Main (815 South Main Street, 217
East Dallas Road and 255 East Dallas Road) all in accordance with a site plan approved
pursuant to Section 47 of Ordinance No. 82-73, attached hereto and made a part hereof as
Exhibit"A", and all other conditions, restrictions, and safeguards imposed herein, including
but not limited to the following: None.
Section 2. The City Manager is hereby directed to amend the official zoning map
of the City of Grapevine, Texas, to reflect the herein planned development overlay.
Section 3. That in all other respects the use of the tract or tracts of land herein
above described shall be subject to all the applicable regulations contained in said City of
Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of
Grapevine, Texas.
Section 4. That the zoning regulations and districts as herein established have
been made in accordance with the comprehensive plan for the purpose of promoting
health, safety, morals and the general welfare of the community. They have been
designed with respect to both present conditions and the conditions reasonably anticipated
to exist in the foreseeable future; to lessen congestion in the streets; to secure safely from
fire, panic, flood and other dangers; provide adequate light and air; to prevent
overcrowding of land, to avoid undue concentration of population; facilitate the adequate
provisions of transportation, water, sewerage, drainage and surface water, parks and other
public requirements, and to make adequate provisions for the normal business, commercial
needs and development of the community. They have been made with reasonable
consideration, among other things, of the character of the district, and its peculiar suitability
for the particular uses and with a view of conserving the value of buildings and encouraging
the most appropriate use of land throughout the community.
Section 5. This ordinance shall be cumulative of all other ordinances of the City of
Grapevine, Texas, affecting zoning and shall not repeal any of the provisions of said
ordinances except in those instances where provisions of those ordinances which are in
direct conflict with the provisions of this ordinance.
Section 6. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of the zoning affecting any portion of the tract or tracts of
land described herein shall be declared to be invalid, the same shall not affect the validity
of the zoning of the balance of the tract or tracts of land described herein.
Section 7. Any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to

exceed Two Thousand Dollars ($2,000.00) and a separate offense shall be deemed
committed upon each day during or on which a violation occurs or continues.
Section 8. The fact that the present ordinances and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace
and general welfare of the inhabitants of the City of Grapevine, Texas, creates an
emergency for the immediate preservation of the public business, property, health, safety
and general welfare of the public which requires that this ordinance shall become effective
from and after the date of its final passage, and it is accordingly so ordained.
