SUBJECT: RIGHT-OF-WAY ABANDONMENT — DALLAS ROAD
RECOMMENDATION:
City Council consider adopting an ordinance abandoning a 13.4 foot wide strip of East
Dallas Road right-of-way extending east from the intersection of South Main Street and
East Dallas Road abutting Lot 1, Block 1 , Grapevine Main for a length of 670 feet, and
take any necessary action.
BACKGROUND:
The 13.4 foot wide strip of right-of-way for East Dallas Road abutting the proposed Lot 1,
Block 1, Grapevine Main subdivision for a length of 670 feet is incorporated within the
plat under consideration by Planning and Zoning and City Council on October 17, 2017
as a pedestrian, drainage and utility easement. This easement includes a pedestrian
corridor that will connect with the upcoming Dallas Road Trail Project extending from
Ball Street to Texan Trail using the Dallas Road Corridor and the Cottonbelt RR
Corridor.
Staff recommends approval.
ORDINANCE NO. 2017-068
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, ABANDONING AND VACATING A
PORTION OF DALLAS ROAD RIGHT OF WAY IN THE CITY
OF GRAPEVINE, TEXAS AS HEREINAFTER DESCRIBED;
DECLARING AN EMERGENCY AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the owner of Lot 1, Block 1, Grapevine Main has requested that a 13.39
foot wide and 670 foot long strip of Dallas Road Right of Way, as herein after described, be
abandoned and vacated; and
WHEREAS, the right of way has been incorporated into the area of Lot 1, Block 1,
Grapevine Main by plat as a pedestrian, drainage and utility easement and is not needed
for public street use and will not be needed in the future for public street use; and
WHEREAS abandoning and vacating the said right of way will relieve the City of
Grapevine, Texas from the cost and expense of maintaining said property.
WHEREAS, all constitutional and statutory prerequisites for the approval of this
ordinance have been met, including but not limited to the Open Meetings Act; and
WHEREAS, the City Council deems the adoption of this ordinance to be in the best
interests of the health, safety, and welfare of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1. That all matters stated hereinabove are found to be true and correct
and are incorporated herein by reference as if copied in their entirety.
Section 2. That the public street right of way described in Exhibit "A" and Exhibit
"B", attached hereto and incorporated herein for all purposes, is hereby abandoned and
vacated for public use subject to the retention of said right of way for a pedestrian,
drainage and utility easement.
Section 3. That the terms and provisions of this ordinance shall be deemed to be
severable, and that if the validity of any section, subsection, word, sentence or phrase shall
be held to be invalid, it shall not affect the remaining part of this ordinance.
Section 4. The fact that the right of way is no longer needed by the public for
public usage and would create a hardship or burden upon the City of Grapevine to keep
open and maintain such easement creates an urgency and an emergency for the
immediate preservation of the public health, safety, and general welfare which requires that
this ordinance shall take effect immediately from and after its passage and it is accordingly
so ordained.

LAND DESCRIPTION
RIGHT-OF-WAY ABANDONMENT
BEING a tract of land situated in the William Dooley Survey, Abstract No. 422, Tarrant County, Texas,
and being a portion of Blocks 5 and 6 of Blocks 1 To 7 Inclusive Lipscomb And Daniel Subdivision, an
addition to the City of Grapevine, Tarrant County, Texas, as recorded in Volume 388-D, Page 333, of
the Plat Records of Tarrant County, Texas (P.R.T.C.T.), and being a portion of a 0.1363 Acre tract of
land described in instrument to the City of Grapevine as recorded in Volume 9645, Page 1933 of the
Deed Records of Tarrant County, Texas (D.R.T.C.T.), and being a portion of East Dallas Road (a 90-
foot right-of-way), and being more particularly described as follows:
BEGINNING at a 5/8 inch iron rod found with plastic cap stamped "GSES INC. RPLS 4804" at the
northeast corner of said City of Grapevine tract (Vol. 9645, Pg. 1933), same being the southeast corner
of a called 4.2529 acre tract of land described in instrument to the City of Grapevine and recorded in
Instrument No. D209250024, D.R.T.C.T., said point being on the northerly right-of-way line of East
Dallas Road;
THENCE, South 07 degrees 44 minutes 11 seconds East, along the east line of said 0.1363 Acre tract,
passing at a distance of 7.45 feet the southeast corner of the same and continuing a total distance of
13.39 feet to an "X" cut set in concrete;
THENCE, South 85 degrees 28 minutes 50 seconds West, a distance of 670.13 feet to an "X" cut set in
concrete;
THENCE, North 04 degrees 31 minutes 22 seconds West, crossing at a distance of 4.95 feet the south
line of said 0.1363 Acre tract and continuing a total distance of 13.37 feet to a 1/2 inch iron rod found
on the north line of said 0.1363 Acre tract, same being the south line of said 4.2529 acre tract,
said point being at the southeast end of a corner clip of the intersection of the northerly right-
of-way line of East Dallas Road and the easterly right-of-way line of South Main Street (an 80-
foot right-of-way);
THENCE, North 85 degrees 28 minutes 50 seconds East, along the south line of said 4.2529 acre tract,
a distance of 669.38 feet to the POINT OF BEGINNING and CONTAINING 0.2056 Acre or 8,955
Square Feet of land, more or less.
Bearings are based on the Texas State Plane Coordinate System, North American Datum of 1983,
North Central Zone (4202).
