ADJOURNMENT IN ACCORDANCE WITH ARTICLE 6252-17, V.A.T.C.S., AS AMENDED BY CHAPTER 227, ACTS OF THE 61ST LEGISLATURE, REGULAR SESSION, THE BOARD OF ZONING ADJUSTMENT REGULAR MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 29TH DAY OF JANUARY, 1993 AT 5:00 P.M. COMMUNITY DEVVIkPPMENT DIRECTOR STATE OF TEXAS COUNTY OFTARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, February 1, 1993, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Ron Williams 1 st Alternate Al Zimmerman 2nd Alternate constituting a quorum with Vice -Chairman, Patti Bass, absent. Also present was City Council Representative, Gil Traverse and the following City Staff: H. T. (Tommy) Hardy Greg Wheeler Gerrie Anderson CELL TO ORDER Community Development Director Building Official Administrative Secretary Chairman Charles Giffin called the meeting to order at 6:00 p.m. NEW BUSINESS -• b l The first item of new business for the Board of Zoning Adjustment to consider was BZA93-01, submitted by Randy Howell. Mr. Howell is requesting variances for 407 North Main Street, from Grapevine Comprehensive Zoning Ordinance 82-73, Section 43.E.2, Changing Non -Conforming Uses, to allow a special exception to reinstate the non -conforming use of the property as a residence and a future time to allow the property to convert to commercial use as presently zoned; and to Section 56, Off - Street Parking, to allow a special exception to the off-street parking requirements when occupied as a commercial use. Randy Howell, applicant, took the Oath of Truth and explained about the variances requested. Mr. Howell noted that the lot is very narrow and there is little room for parking. He also explained about two houses along that street being used as commercial and two houses that are being used as single family and expressed that he would like flexibility with this property to be able to use it as commercial or residential. lil With no one else to speak either for or against the request, Ron Williams made a motion to close the public hearing. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Meyer, Coy, Williams, Zimmerman Nays: None Abstain: Howell Absent: Bass After further discussion, Chris Coy made a motion that a special condition did exist and the special condition being the primary use of the property in the area is residential, making the request consistent with surrounding land uses. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Meyer, Coy, Williams, Zimmerman Nays: None Abstain: Howell Absent: Bass Chris Coy then made a motion to allow the special exception to Grapevine Comprehensive Zoning Ordinance, Section 43.E.2, Changing Non -Conforming Uses, to reinstate the non -conforming use of the property as a residence and in the future, allow the property to convert to commercial use as presently zoned. Ron Williams seconded the motion which prevailed by the following vote: Ayes: Giffin, Meyer, Coy, Nays: None Abstain: Howell Absent: Bass N W" Lei &V The next item of new business for the Board of Zoning Adjustment to consider was BZA93-02, submitted by Will Wickman. Mr. Wickman is requesting variances from Grapevine Comprehensive Zoning Ordinance 82-73, Section 54, Masonry Requirements. The request is for a 100% variance to allow a railroad boxcar to be brought onto the property at 651 South Main Street to be used as a dining car for a theme restaurant. Greg Wheeler explained the applicant's request to allow a restaurant with a boxcar theme would not be desirable if masonry requirements were strictly enforced. Will Wickman, applicant, and Raymond Truitt, architect for Mr. Wickman both took the Oath of Truth. Mr. Wickman explained the entrance would come off of Hudgins Street, the boxcar would hold 25 people and in the summer more people could be seated outside. Mr. Wickman stated he wants to keep it as rustic and genuine as possible and if the restaurant is successful, would like to add a caboose at a later time. IN Greg Wheeler announced that a letter of approval had been received by Authur M. Waters of Master Made Feeds, Incorporated. After further discussion, Randy Howell made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Williams, Zimmerman Nays: None Absent: Bass Mr. Wickman noted he could add seven more parking spaces at this time and has enough room to add more in case a caboose is added. Chairman Giffin expressed concern about the quality of design of the add-on of the vestibule and the kitchen to the boxcar and whether it compliments the surrounding area, including the Heritage Center. Mr. Wickman explained how the add-ons would be constructed and explained he wanted to work closely with the architects so the theme of the restaurant will fit in with the Heritage Center. Chairman Giffin made a motion that a special condition did exist, being the building would be mainly composed of a boxcar and would be inappropriate to cover with masonry, and to have the add-ons keeping with the theme of downtown and the Heritage Center. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Williams Nays: None Absent: Bass Chairman Giffin then made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 54, and have the Historical Preservation Committee review the architectural plans and approve them prior to issuance of the building permit. There was concern from Council Representative, Gil Traverse, about there being a problem tying the add-ons with the approval of the Historical Preservation Commission because the property is not in the Historical Overlay. After further discussion Chairman Giffin amended his motion to state that a majority of the Historical Preservation Commission approve the plans. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Williams Nays: None Absent: Bass 3 MUM Next the Board of Zoning Adjustment considered the minutes of the November 30, 1992, meeting. Ery Meyer made a motion to approve the minutes as written of the November 30, 1992, Board of Zoning Adjustment meeting. Ron Williams seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Williams, Zimmerman Nays: None Absent: Bass 1 4 : With no further questions, Chris Coy made a motion to adjourn.
