CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, May 3, 1993, at 6:00 P.M., in the Council Chambers,
Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members
present to wit:

constituting a quorum with Vice Chairman, Patti Bass and 1 st Alternate, Ron Williams
absent. Also present were City Council Representative, Gil Traverse, and the

CALL TO ORDER
Chairman, Charles Giffin called the meeting to order at 6:05 P.M.
NEW BUSINESS
BZA 93-07 GLENN O'NEAL
The first item of new business for the Board of Zoning Adjustment to consider was
BZA93-07, submitted by Glenn O'Neal who is requesting a variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Changing Nonconforming
Uses, for 649 West Hudgins Street. The request is to allow the enlargement of a
garage for storage as shown on the plot plan.
Greg Wheeler explained that Mr. O'Neal is currently storing many personal belongings
in a semi -trailer parked on the property. Mr. O'Neal would like to expand this
nonconforming use to be able to store his personal belongings and move the semi-
trailer.
With no one to speak either for or against the request, Randy Howell made a motion
to close the public hearing. Ery Meyer seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Howell, Meyer, Coy, Zimmerman
Nays: None
Absent: Bass, Williams
Randy Howell then made a motion that a special condition did exist and the special
condition being, that it does not alter any setback requirements for the enlargement
of the storage building, along with taking away the structure that is being utilized now
for personal storage. Ery Meyer seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Howell, Meyer, Coy, Zimmerman
Nays: None
Absent: Bass, Williams
Randy Howell then made a motion to grant the variance from Grapevine
Comprehensive Zoning Ordinance 82-73, Section 43.E.3., Changing Nonconforming
Uses to allow the enlargement of a garage for storage as shown on the plot plan. Ery
Meyer seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy, Zimmerman
Nays: None
Absent: Bass, Williams
The next item of new business was for the Board of Zoning Adjustment to consider
BZA93-08 submitted by William Brown who is requesting the following variances for
809 Redbud Lane, from Grapevine Comprehensive Zoning Ordinance 82-73:
1. Section 15.& 1 ., Front Yard Setback District Regulations which requires a 30
foot front yard building setback.
The variance request is to allow the carport a fifteen (15) foot variance, to
encroach the thirty (30) foot front yard, as shown on the plot plan.
2. Section 15.G.2., Rear Yard Setback District Regulations which requires a 25
foot rear yard setback.

The variance request is to allow the one story brick and frame accessory
building to be attached to the existing one story brick and frame dwelling,
which will require a 19 foot variance to encroach the 25 foot rear yard as
shown on the plot plan.
William Brown, of 809 Redbud Lane and applicant took the Oath of Truth and
explained the hardships of the property and why the variances are needed. Mr. Brown
explained that he was maintaining two households in order to store personal
belongings which is creating a hardship on his family. Mr. Brown also explained that
due to the elevation and lot layout, there is no other way to expand. He explained he
would simply be making use of current dead space between the existing garage and
the existing storage building.
Greg Wheeler noted there were six letters of approval from surrounding property
owners.
With no one else to speak either for or against the request, Chris Coy made a motion
to close the public hearing. Randy Howell seconded the motion which prevailed by
the following vote:
Ayes: Giffin, Howell, Meyer, Coy, Zimmerman
Nays: None
Absent: Bass, Williams
Second Alternate, Al Zimmerman had to leave at this point of the meeting, 7:05 p.m.
After further discussion, Randy Howell made a motion that special conditions did exist
for Section 15.G.1. and the special conditions being the variance requested will not
create any more of a hardship to the other neighbors than it already does, a corner lot
takes away the maximum use of the lot, the different levels of the lot makes it hard
to place a carport, and by the way the house was originally placed on the lot. Chris
Coy seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
Randy Howell made a motion to grant the variance to Section 15.G.1., Grapevine
Comprehensive Zoning Ordinance 82-73 to allow the carport a 15 foot variance, to
encroach the 30 foot front yard, as shown on the plot plan. Chris Coy seconded the
motion which prevailed by the following vote:

Randy Howell then made a motion that special conditions did exist for Section
15.G.2., and the special conditions being, the detached structure is existing, the
existing walls will remain the same, and it will not be anymore of a hardship as it has
been in the past to the neighbors, and the different levels of the lot creates a hardship
for building a carport. Chris Coy seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
Randy Howell made a motion to accept the variance to Section 15.G.2., Rear Yard
Setback District Regulations to allow the one story brick and frame accessory building
to be attached to the existing one story brick and frame dwelling, allowing a 19 foot
variance to encroach the 25 foot rear yard.
Chris Coy seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
Randy Howell made a motion to amend both of his motions that the variances be
granted in accordance to the site plans submitted, Chris Coy seconded the motion
which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
The next item of new business for the Board of Zoning Adjustment to consider was
BZA93-09, submitted by Bethel Baptist Church who is requesting a variance from
Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.J., Parking District
Regulations which requires a 30 foot front yard setback for 1224 Hilltop Drive, Lots
14, 15, 16, Block 6, W. C, Lucas Addition. The variance requested is to allow the
addition of three handicap parking spaces for a 20 foot variance to encroach the 30
foot front yard as shown on the plot plan, allowing a 10 foot front yard setback.

Greg Wheeler explained that Bethel Baptist Church is upgrading their parking lot for
the convenience of the congregation. The special condition is to place the
handicapped parking spaces close to the handicapped accessible entrance to the
church. Mr. Wheeler also announced that one letter of approval had been received.
Reverend L. E. Holmes was present to answer any questions.
With no one to speak either for or against the request, Ery Meyer made a motion to
close the public hearing. Randy Howell seconded the motion which prevailed by the
following vote:

Chris Coy made a motion that a special condition did exist and the special condition
being to place the handicapped spaces need to be as close to the entrance as possible
so patrons will not have to cross the parking lot. Randy Howell seconded the motion
which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy

Absent: Bass, Williams, Zimmerman
Chris Coy then made a motion to approve the variance requested from Grapevine
Comprehensive Zoning Ordinance 82-73, Section 15.J., to allow the addition of three
handicapped parking spaces for a 20 foot variance to encroach the 30 foot front yard
setback as shown on the plot plan, allowing a 10 foot front yard setback. Randy
Howell seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy

BZA93-10 TIM LANCASTER
The next item of new business was for the Board of Zoning Adjustment to consider
BZA93-10, submitted by Tim Lancaster who is requesting variances for 1201 Minters
Chapel, legally described as Lot 1, Block 2, DFW Air Freight Centre, from Grapevine
Comprehensive Zoning Ordinance 82-73, for the following sections:
Section 31.G.5., Rear Yard Setback District Regulations requiring a 30 foot rear yard
setback. The variance request is to allow the existing metal building a 20 foot
variance to encroach the 30 foot rear yard as shown on the plot plan.

Section 54, Masonry Requirements requiring 70 percent masonry. The variance
request is to allow an addition to the existing metal building a 100 percent variance
to the 70 percent masonry requirement.
Greg Wheeler explained Mr. Lancaster was requesting these variances because the
site plan is not fully developed. Currently, the occupant of the building wants to
expand his business and Mr. Lancaster has no other vacancies at this location to
move the tenant. The building can not be expanded to the south because of required
parking spaces, nor can it be expanded to the west because of a communications
building supporting a 100 foot tower. The only option for expansion Mr. Lancaster
has is to the east of the building which would encroach the rear yard setback. The
second request if for zero percent masonry on the addition in order to match the
existing metal sided building, Mr. Wheeler explained that Staff recommended denial
for the request because there is adequate room to expand as shown on the site plan
and still meet all the setbacl< requirements.
Tim Lancaster of 2010 Forest Hills Road, Grapevine, and applicant, took the Oath of
Truth and explained he has no other place to expand this building except into the
setback, and the tenant needs the room to stay at this site. Mr. Lancaster expressed
that the tenant has been there two years and keeps the building very nice.
With no one else to speak either for or against the request, Chris Coy made a motion
to close the public hearing. Randy Howell seconded the motion which prevailed by
the following vote:

Tim Lancaster explained the tenant is using all of the building and the new add-on
would let him expand and add more equipment.
After further discussion, Ery Meyer made a motion that a special condition did not
exist. Chris Coy seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
The variance was denied.

The last item of new business for the Board of Zoning Adjustment to consider was
BZA93-11, submitted by David Ritz who is requesting a variance from Grapevine
Comprehensive Zoning Ordinance 82-73, Section 14.G.2, Rear Yard Setback District
Regulations which requires a 25 foot rear yard setback for 3510 Emerald Court, Lot
14, Block 2, Windsor Forest Addition. The variance request is to allow the dwelling
a seven foot variance to encroach the 25 foot rear yard setback as shown on the plot
plan.
Greg Wheeler explained that Staff recommends approval of the request because the
builder has proposed a plan to save the maximum amount of mature post oak trees
located on the property. Mr. Wheeler further noted that if the house were flipped, all
trees would have to be removed. Also one letter of approval was received.
Chris Coy made a motion to close the public hearing. Randy Howell seconded the
motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy

Frank Ritz, applicant, took the Oath of Truth and explained the irregular shape of the
lot.
Randy Howell made a motion that special conditions did exist and the special
conditions being the irregular shaped lot and the builder has done everything in
building a desirable home and saving as many natural trees on the lot as possible. Ery
Meyer seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
Randy Howell then made a motion to approve the variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 14.G.2., to allow a seven foot
encroachment, allowing an 18 foot rear yard setback for the plot plan submitted only.
Ery Meyer seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman

MINUTES
Next, the Board of Zoning Adjustment considered the minutes of the March 1, 1993,
and the April 5, 1993, minutes.
Ery Meyer made a motion to adopt the minutes of the March 1, 1993, meeting. Chris
Coy seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
Chris Coy made a motion to adopt the minutes of the April 5, 1993, meeting with one
change being corrected, Ery Meyer seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Howell, Meyer, Coy
Nays: None
Absent: Bass, Williams, Zimmerman
Greg Wheeler announced there will be six or seven cases for the June 7th meeting.
Also, the July meeting will be held June 28, due to the Fourth of July holiday.
Marcy Ratcliff announced there are three zoning cases for next months meeting; Tia's,
Good Eats, Hansom Hank's.

With no further discussion, Chris Coy made a motion to adjourn. Randy Howell
seconded the motion which prevailed by the following vote:
