CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular
session, Monday evening June 28, 1993, at 6:00 P.M. in the Council Chambers,
Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members
present to wit:

constituting a quorum. Also present was City Council Representative, Gil Traverse,
and the following City Staff:

Chairman, Charles Giffin, called the meeting to order at approximately 6:00 p.m.
OATH OF OFFICE
Gerrie Anderson administered the Oath of Office to new members, 1st Alternate, Carl
Hecht; 2nd Alternate, Jeff Wood; and to returning member, Randy Howell.
NEW BUSINESS
BZA93-20 GARY GREENER
The first item of new business was for the Board of Zoning Adjustment to consider
BZA93-20, submitted by Gary Greener, who is requesting a variance for his property
located at 1311 Shannon Street, Lot 21, Shamrock Shores Estates. The variance
requested is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1.,
Single Family District Regulations, which requires a thirty (30) foot front yard setback.
The applicant is asking for a variance to allow a 3 1/2 foot variance to encroach the
30 foot front yard as shown on Exhibit A, allowing a 26 1/2 foot front yard setback.

Greg Wheeler explained that Mr. Greener is proposing to build his residence on this
lot, and due to the irregular shape and shallowness of the property, needs the variance
request.
Gary Greener, applicant of 504 Yellowstone, Grapevine, Texas, took the Oath of
Truth and explained that he preferred to have the encroachment in the front yard
setback instead of the rear yard because of the heavy traffic during the summer on
the Corp road to Oak Grove Park that runs along the back of his lot.
With no one else to speak either for or against the request, Patti Bass made a motion
to close the public hearing. Chris Coy seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: None
Randy Howell made a motion that a special condition did exist and the special
condition being the platted lot is irregular shaped, which creates a hardship to build
a single family dwelling. Patti Bass seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy
Nays: None
Absent: None
Randy Howell made a motion to approve the variance to Grapevine Comprehensive
Zoning Ordinance 82-73, Section 15.G.1, Single Family District Regulations, to allow
a 3 1/2 foot variance to encroach the 30 foot front yard as shown on Exhibit A,
allowing a 26 1/2 foot front yard setback for 1311 Shannon Street. Chris Coy
seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy

The next item of new business was for the Board of Zoning Adjustment to consider
BZA93-18, submitted by Jeff Cook. Mr. Cook is requesting a variance from
Grapevine Comprehensive Zoning Ordinance 82-73, Section 42.C.3., Supplementary
District Regulations, which requires an accessory building to not be located any nearer
than six feet to the rear property line. The applicant is requesting a variance to allow
a five foot variance to encroach the six foot rear yard accessory building setback as

shown on the plot plan. The property is located at 986 South Riverside Drive, Lot 10,
Block E, The Woods Addition.
Marcy Ratcliff explained that staff failed to find a special condition for the request
because there is ample room in the rear yard to meet the Ordinance requirements.
Jeff Cook, applicant of 986 South Riverside Drive, Grapevine, Texas, took the Oath
of Truth. Mr. Cook passed out photographs of the property, and also letters from
Brazos Electric and TU Electric stating they had no problems with the building in the
rear 18 foot easement.
Staff received one letter of approval.
Carl Hecht asked if Mr. Cook if he had taken out a building permit for the accessory
building.
Mr. Cook stated that he checked with the City and was told that size building did not
require a building permit.
With no one else to speak either for or against the request, Randy Howell made a
motion to close the public hearing. Patti Bass seconded the motion which prevailed
by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy

Jeff Cook explained about the swale that runs through his property and how the
water runs from his neighbors lots and ends up at the street side of his yard. He
explained that he has a driveway in the back yard that is built with a lot of steel and
would be hard to move. He also explained that if the building was moved to the
middle of the back yard, it would be more visible to the neighbors.
Chris Coy made a motion that special conditions did exist, and the special conditions
being the odd topography of the lot, including the slop coming down from the house
and easement, making up a large portion of the back yard, making it difficult to find
a level area to put any accessory structure, and that would not block the drainage.
Randy Howell seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy

Chris Coy then made a motion to grant the variance to Grapevine Comprehensive
Zoning Ordinance 82-73, Section 42.C.3., Supplementary District Regulations, to

allow a five foot variance to encroach the six foot rear yard accessory building
setback as shown on the plot plan, allowing a one foot rear yard accessory building
setback. Patti Bass seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy

The next item of new business for the Board of Zoning Adjustment to consider was
BZA93-22, submitted by Colleen G. Adams who is requesting a variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 15.6.1., Single Family District
Regulations which requires a thirty (30) foot front yard setback. The variance request
is to allow a ten foot variance to encroach the thirty foot front yard as shown on the
plot plan for 3733 Oakwood Drive, Lot 1, Block 1, Grapevine Lake Estates.
Greg Wheeler explained the existing residence had been demolished and Ms. Adams
is wanting to building a new structure, but variances are needed because of the
topography of the lot drops in the front and rear yards of the property.
With no one to speak either for or against the request, Chris Coy made a motion to
close the public hearing. Patti Bass seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy

Ery made a motion that a special condition did exist and the special condition being
the topography of the lot drops in the front yard and in the rear yard and the house
was situated in the same area on the lot. Patti seconded the motion which prevailed
by the following vote:

Ery Meyer then made a motion to grant the variance to Grapevine Comprehensive
Zoning Ordinance 82-73, Section 15.G.1., to allow a ten foot variance to encroach
the thirty (30) foot front yard as shown on the plot plan, allowing a twenty (20) foot
front yard setback for 3733 Oakwood Drive. Patti Bass seconded the motion which
prevailed by the following vote:

BZA93-23, RANDY HOWELL
The last item of new business was for the Board of Zoning Adjustment to consider
BZA93-23, submitted by Randy Howell who is requesting a variance to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 18.G.1., Three and Four Family
Residential District Regulations which requires a thirty foot front yard setback. The
variance request is to allow the parking lot area a four foot variance to encroach the
thirty foot front yard as shown on the plot plan, allowing a twenty-six foot front yard
setback in the parking lot area only, for 113 Wildwood Court, Lot 4, Marshall Estates
Addition.
Marcy Ratcliff explained the special condition for the request is the irregular shape of
the lot and the property layout was designed to meet the former twenty-five foot front
yard setback requirements.
Randy Howell, applicant, took the Oath of Truth and explained that he tried various
layouts to get the 10 required parking spaces in the 30 foot front yard setback but
was unsuccessful. He explained no matter where the parking spaces were located,
a variance would be needed.
With no one else to speak either for or against the request, Chris Coy made a motion
to close the public hearing. Patti Bass seconded the motion which prevailed by the
following vote:
Ayes: Giffin, Bass, Meyer, Coy, Hecht

Absent: None
Abstain: Howell
Patti Bass made a motion that a special condition did exist and the special condition
being the irregular shaped lot was designed to meet the 25 foot setback from Zoning
Ordinance 70-10. Chris Coy seconded the motion which prevailed by the following
vote:

Patti Bass then made a motion to grant the variance to Grapevine Comprehensive
Zoning Ordinance 82-73, Section 18.G.1., to allow the parking lot area only a four (4)
foot variance to encroach the thirty (30) foot front yard as shown on the plot plan and
not to vary what so ever, allowing a twenty-six foot front yard setback in the parking
lot area only. Ery Meyer seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Meyer, Coy, Hecht
Nays: None
Absent: None
Abstain: Howell
MINUTES
Next the Board of Zoning Adjustment considered the minutes of the May 3, 1993,
meeting.
Chris Coy made a motion to approve the minutes of the May 3, 1993, meeting. Ery
Meyer seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy, Hecht, Wood
Nays: None
Absent: None
Greg Wheeler announced to the Board that the Building Inspection Division was now
issuing permits for all accessory structures at no charge. By requiring a permit for
accessory buildings, variances may be eliminated.
With no further discussion, Patti Bass made a motion to adjourn. Chris Coy seconded
the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Coy, Hecht, Wood
Nays: None
Absent: None
The meeting was adjourned at approximately 7:30 p.m.
