AS PREPARED AND POSTED ON THIS THE 3RD DAY OF DECEMBER, 1993, AT 5:00 P.M. •: , • , r • • STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met in regular session, Monday evening December 6, 1993, at 6:00 P.M. in the Council Chambers, Room #205, 307 West Dallas Road, Grapevine, Texas, with the following members present to wit: Charles Giffin Chairman Randy Howell Secretary Ery Meyer Member Chris Coy Member Carl Hecht Ist Alternate Jeff Wood 2nd Alternate with member Patti Bass absent, constituting a quorum. Also present was City Council Representative, Gil Traverse, and the following City Staff: Greg Wheeler Building Official Teresa Wallace Planning Secretary CALL TO ORDER Chairman, Charles Giffin, called the meeting to order at approximately 6:00 P.M. NEW BUSINESS BZA93-35 - DON T. GERSCHICK The first item of new business was for the Board of Zoning Adjustment to consider BZA93-35, submitted by Dr. Don T. Gerschick, who is requesting a special exception for the property located at 310 East Northwest Highway, metes and bounds survey out of Abstract No. 946 of the A. F. Leonard Survey. The special exception requested is to Grapevine Comprehensive Zoning Ordinance 82-73, Section 58.B., Parking and Loading Area Development Standard regulations, which requires all off street parking, loading, and drives to be hard surfaced, i.e. asphaltic concrete or concrete slab. The applicant is asking for a special exception to allow the gravel parking area to continue to exist as is shown on Exhibit A, until redevelopment occurs on the property. Greg Wheeler explained that Dr. Don T. Gerschick is currently trying to sell the subject property and is requesting a special exception to allow the gravel parking on the property remain as is, since all the property along Northwest Highway is nonconforming to the current ordinance. The properties on either side of the subject property do not currently have paved parking® Mr. Wheeler explained the future development of the Northwest Highway corridor will impact the parking on all of the nonconforming properties along the right-of-way with drive cuts, curbs, and gutters. Dr. Don Gerschick, applicant of 310 East Northwest Highway, Grapevine, Texas, took the Oath of Truth and explained that the property has always been allowed gravel parking and furnished a picture to members to show the current condition of the parking. Greg Wheeler stated there were no objections received. With no one else to speak either for or against the request, Randy Howell made a motion to close the public hearing. Jeff Wood seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Wood Nays: None Absent: Bass Randy Howell made a motion that a special condition did exist to Section 58.B. Parking and Loading Area Development Standards Regulations, and the special condition for the special exception being the existing condition has been allowed to exist as is for the current owner. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Wood Nays: None Absent: Bass Randy Howell made a motion to approve the special exception to Grapevine Comprehensive Zoning Ordinance 82-73, Section 58.B., Parking and Loading Area Development Standards to allow a gravel parking area to continue to exist as shown on the plot plan until the property is redeveloped at 310 East Northwest Highway. THOMAS JR The next item of business was for the Board of Zoning Adjustment to consider a variance request BZA93-36 submitted by Ernest R. Thomas, Jr. Mr. Thomas is requesting a variance to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1. Single Family District Regulations which requires a thirty (30) foot front yard setback. The applicant is requesting a variance to allow a one and one half (1-1/2) foot encroachment to the required thirty foot front yard setback allowing a twenty eight and one half (28 1/2) foot front yard setback. Greg Wheeler explained the special condition for the request is the encroachment of the bay window was discovered when a survey of the property was completed for the recent sale of the property. The area was developed in the early to mid 1980's before required setback inspections were initiated by the Building Inspection Division of the City of Grapevine. The applicant, Ernest R. Thomas, Jr., 3156 Stone Creek Lane, Grapevine, Texas, took the Oath of Truth. Mr. Thomas explained the bay window encroached into the required front yard setback when the property was developed and is not his fault. With no one else to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Meyer, Howell, Hecht, Coy Nays: None Absent: Bass Carl Hecht made a motion that a special condition did exist for the variance request to Section 15.G.1., Single Family District Regulations, and the special condition being that Mr. Thomas had purchased the property with the encroachment existing at the time of the sale of the property and was not the fault of the owner. Randy Howell seconded the motion which prevailed by the following vote: 3 Ayes: Giffin, Meyer, Howell, Hecht, Coy Nays: None Absent: Bass Carl Hecht then made a motion to grant the variance to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1., Single Family District Regulations, of one and one half feet to the required thirty (30) foot front yard setback allowing a twenty eight and one half foot (28 1/2') front yard setback as shown on the plot plan. Randy Howell seconded the motion which prevailed by the following vote: Ayes: Giffin, Meyer, Howell, Hecht, Coy Nays: None Absent: Bass The next item of new business was for the Board of Zoning Adjustment to consider BZA93-37, submitted by Tim Lancaster. Mr. Lancaster is requesting a variance to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 54, Masonry Regulations, which requires all principal buildings and structures to have a minimum of seventy (70) percent masonry exterior. The applicant is requesting a 100% variance to three proposed structures to be developed as metal clad buildings as shown on the plot plan. The property is located at 1201 Minters Chapel Road, legally described as Lot 1, Block 2, DF W Air Freight Centre Addition, Tarrant County, Texas. In his presentation, Greg Wheeler, Building Official, explained that there are currently two metal clad buildings completed as part of a development approved in 1985. These two buildings represent only 23 percent of the total square footage of the proposed development. The applicant is requesting to develop three additional metal clad buildings on the remaining site. Tim Lancaster, applicant of 1201 Minters Chapel Road took the oath of truth. Mr. Lancaster explained he thought he had received site plan approval in March of 1985 which would allow the structures to be developed as metal clad buildings. He told the Board the masonry tilt wall buildings with a brick veneer were not economically feasible. His building cost would impact the rents he charged on the buildings, making the lease cost too expensive for the area. 1B Chairman Giffin asked if anyone else would like to address to request. Dr. Ed Lancaster spoke to the Board asking them to approve the request. With no one else to speak for or against the request, Chris Coy moved, with a second by Randy Howell to close the public hearing. During deliberations Ery Meyer questioned the Building Official, Greg Wheeler, on the current zoning requirements for the district and the fire resistance of the metal clad exterior as requested. Also discussed was the date of adoption adding the masonry requirements to the Zoning Ordinance. Randy Howell stated that he could not see that a special condition did exist since only 23% of the development is now built. Ery Meyer moved, with a second by Chris Coy, that a special condition did not exist with the prevailing vote as follows: Ayes: Meyer, Coy, Wood Nays: Giffin and Howell Absent: Bass Tim Lancaster, applicant, then requested of the Board that he be allowed further consideration of the request. Chairman Giffin explained to the applicant that economic factors could not be taken into consideration. Randy Howell suggested a compromise might be obtained if the applicant would like to make a proposal. City Councilman Gil Traverse questioned if a special condition might be that the buildings already on the property were metal clad and the applicant was trying to make his development similar in appearance. Chris Coy moved, with a second by Randy Howell, to table the request until the end of the agenda for further consideration. The prevailing vote was as follows: Ayes: Giffin, Howell, Meyer, Coy, and Wood Nays: None Absent: Bass BZA93-39 - CHANDLER SIGNS The next item of new business was for the Board of Zoning Adjustment to consider BZA93-39 submitted by Rockford V. Gray for Chandler Signs representing Nations Bank. The applicant is requesting a variance to the Grapevine comprehensive Zoning Ordinance 82-73, Section 60.B.2.C.11., Sign Standards, which requires a twenty (20) foot maximum/minimum height. The applicant is requesting a variance to allow a thirty eight foot sign to be built on the property as shown on the plot plan. The property is located at 301 South Park Boulevard, legally described as Lot 3, Block 1, Park and Wall Addition, City of Grapevine, Tarrant County, Texas. 5 Greg Wheeler, Building Official, explained that staff could find no special condition for the request to allow a variance of eighteen (1 8) feet to the required twenty (20) foot sign height to allow a thirty eight (38) foot tall sign. Board member Carl Hecht declared he had a conflict of interest and would not be able to address the request. Les Beaver, of 1917 Rockcreek, Grand Prairie, Texas took the oath of truth to speak for the applicant. Mr. Beaver explained that due to the topography of the area the bank had no visibility from the eastbound lanes of traffic on State Highway 114 West. An enlarged graphic was passed around to the Board showing a depiction of the sign as shown on the plot plan. Rick Garrison, Manager of the Grapevine Branch of Nations Bank also took the oath of truth and spoke to the Board of Zoning Adjustment members regarding the sign height. With no one else to speak either for or against the request, Randy Howell made a motion, with a second by Chris Coy, to close the public hearing which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Wood Nays: None Absent: Bass Chris Coy made a motion that a special condition did exist for the variance request to Section 60.B.2.C. 11 . Sign Standards, and the special condition is that the topography of the land to the west makes it impossible to see the existing sign as constructed within the guidelines of the current Zoning Ordinance when approaching on State Highway 114 from the west. Jeff Wood seconded the motion and the prevailing vote was as follows: Ayes: Giffin, Howell, Meyer, Coy, Wood Nays: None Absent: Bass Chris Coy made a motion to approve the variance request to the Grapevine Comprehensive Zoning Ordinance 82-73 for 301 South Park Boulevard, Lot 3, Block 1, Park and Wall Addition, Grapevine, Texas, Section 60.B.2.C. 11 - Sign Standards to allow an eighteen (18) foot variance to the sign standard requirement to a maximum height of twenty (20) feet to allow a thirty eight (38) foot pole sign no larger than four (4) foot by twelve (12) foot as per the site plan. Jeff Wood seconded the motion with the prevailing vote as follows: R Ayes: Giffin, Howell, Meyer, Coy, Wood Nays: None Absent: Bass Abstain: Hecht Next the Board of Zoning Adjustment considered BZA93-40 submitted by Burger Street. Burger Street is requesting a one hundred (100%) percent variance to the Grapevine Comprehensive Zoning Ordinance, Section 54, Masonry Requirements, which requires all principal buildings and structures to have a minimum of seventy (70%) percent masonry. Burger Street is proposing to use an exterior wall system similar to the trade name product Dryvit manufactured and distributed by Senergy, Inc., for the proposed development to be located at 1135 William D. Tate Avenue, Lot 2, Block 1, Tate Street Plaza Addition, City of Grapevine. Greg Wheeler, Building Official, described and demonstrated a type of exterior system similar to Dryvit to the Board of Zoning Adjustment. Mr. Wheeler stated that staff's interpretation of the Grapevine Comprehensive Zoning Ordinance No. 82-73, Masonry Requirements currently prohibits use of Dryvit systems, Senergy systems, and similar products to comply with the masonry requirements of the City of Grapevine which require exterior walls to be constructed of brick, stone or other masonry or material of equal characteristics in accordance with the City's Building Code and Fire Prevention Code to comply with fire -resistive ratings shown in Grapevine Building Code in Table 43-B. Bill Egan, Vice President of Senergy Inc. made a presentation to the Board of Zoning Adjustment on the Senergy product proposed for use by Burger Street in the City of Grapevine. Mr. Egan told the Board his product was low maintenance, easy to clean, has flexibility with movement of the building, compressive strength, has an appealing esthetic quality, that also provides insulation value. Patsy Vaughn, Senergy District Sales Manager, showed pictures of developments in Grapevine that have used their product in the past. She told the Board the product was more cost effective than brick or masonry and easily maintained with a life range of thirty years. Craig Johnson, Vice President of Burger Street, took the oath of truth and told the Board his company used this product on twenty one of their twenty two stores and have been satisfied with its performance. City Councilman, Gil Traverse, recommended further consideration of this type of product be addressed by the Planning & Zoning Commission and City Council as an approved alternate to the masonry requirement of the Zoning Ordinance stipulating a one hour fire wall to be attached. With no one else to speak for or against the case Carl Hecht made a motion to close the public hearing. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Absent: Bass Carl Hecht made a motion, with a second by Chris Coy, that a special condition does exist in that fourteen of our neighboring cities allow this type of product to be used with the prevailing vote as follows: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Absent: Bass Carl Hecht made a motion, with a second by Chris Coy, to approve the request to Grapevine Comprehensive Zoning Ordinance No. 82-73 for 1135 William D. Tate Avenue, Lot 2, Block 1, Tate Street Plaza Addition, Grapevine, Texas to allow a one hundred (100) percent variance to Section 54, Masonry Requirements, on the exterior walls of the proposed structure to use the Senergy product as an alternate material as demonstrated and shown on the site plan. The prevailing vote was as follows: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Absent: Bass Randy Howell made a motion to forward consideration of the products Dryvit and Senergy to the Planning & Zoning Commission and City Council to be added to the Grapevine Comprehensive Zoning Ordinance No. 82-73, Section 54, Masonry Requirements as an approved alternate. Chris Coy seconded the motion which prevailed by the following vote: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Absent: Bass 0.* BZA93-37 - TIM LANCASTER Next the Board of Zoning Adjustment reopened the hearing on BZA93-37, Tim Lancaster, to allow a one hundred (100) percent variance to the three proposed structures at 1201 Minters Chapel Road, Lot 1, Block 2, DFW Air Freight Center Addition, Grapevine, Texas. Mr. Lancaster approached the Board with a new proposal to allow an eighty (80%) percent variance to the required seventy (70%) percent masonry requirement making a total of twenty (20%) percent exterior masonry. If approved one hundred (100%) percent of the front elevation of each building fronting Minters Chapel Road would be masonry, including the existing building. Chuck Giffin moved that a special condition does exist and that being the existing buildings on the property per site plan from 1985 and the existing structures in neighboring proximity were also of similar construction. Randy Howell seconded the motion with the prevailing vote as follows: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Absent: Bass Chuck Giffin moved to grant a variance to the Grapevine Comprehensive Zoning Ordinance 82-73, Section 54, Masonry Requirements of seventy (70%) percent to allow a one hundred (100%) percent masonry exterior on the elevations directly fronting Minters Chapel Road, including the existing building "B", the proposed building "A" and the proposed building "C" as noted on the site plan. The remainder of all exterior walls of proposed Building "A" and proposed Building "C" will be of metal clad construction. Randy Howell seconded the motion with the prevailing vote as follows: Ayes: Giffin, Howell, Meyer, Coy, Hecht Nays: None Absent: Bass MUNUM Next the Board of Zoning Adjustment considered the minutes of the August 30, 1993, October 4, 1993, November 1, 1993 and November 15, 1993 meetings. Carl Hecht made a motion to approve the minutes of the August 30, 1993, October 4, 1993, November 1, 1993 and November 15, 1993 meetings as amended.
