The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday
evening February 7, 1994, at 6:00 P.M. in the Council Chambers, Room #205, 307
West Dallas Road, Grapevine, Texas, with the following members present to wit:

Chairman, Charles Giffin, called the meeting to order at approximately 6:00 P.M.
NEW BUSINESS
BZA93-44 - NORTHWEST ANIMAL HOSPITAL
The first item of new business was for the Board of Zoning Adjustment to consider
BZA93-44, submitted by Northwest Animal Hospital, who is requesting special
exceptions for the property located at 1027 William D. Tate Avenue, proposed to be
replatted as Lot 1R, Block 2, Bellaire Addition.

The following special exception requests are to the Grapevine Comprehensive Zoning
Ordinance 82-73:
Section 24.G.2., CN Neighborhood Commercial District Regulations, requires a
minimum lot depth of not less than one hundred and fifty (150) feet and twenty five
foot front yard setback to be utilized as a landscaped area.
The first request is to allow a thirty five (35) foot special exception to the minimum
required one hundred and fifty (150) foot lot depth as shown on the plot plan. If
approved, it would all a one hundred and fifteen (115) foot lot depth.
The second request is to allow a twenty five (25) foot special exception to encroach
the twenty five (25) foot landscaped front yard setback as shown on the plot plan.
If approved, it would allow a zero (0) foot front yard setback to be utilized as a
parking area instead of a landscaped area.
Greg Wheeler, Building Official, explained that Northwest Animal Hospital is
requesting special exceptions for the proposed development because of the size
constraints of the lot. The applicant is in the process of acquiring the forty (40) foot
right-of-way across the front of the property from the State of Texas. The right-of-
way area along the front of the property with the residential development at the rear
does not provide another alternative to alleviate the depth of the lot at this time.
When the property is acquired from the Texas Department of Transportation the
property will be in compliance with current zoning regulations. The depth of the lot
will become one hundred fifty five (155) feet with an additional forty (40) feet of
landscaped front yard which will exceed the minimum requirements of Section
24.G.2. and 24..3.
Philip Morley, Architect, 210 Park Boulevard, Suite 100, Grapevine, Texas was sworn
in by Chairman Giffin to answer questions from the Board relative to the requests.
He explained to the Board it takes approximately one year to acquire property that has
been abandoned as right-of-way by the State of Texas. The special exceptions
requested for the development were to allow the development to move forward until
that could be accomplished.
With no one to speak to the request, any letters or petitions, Chris Coy moved to
close the public hearing. Ery Meyer seconded the motion with the prevailing vote as
follows:

Chris Coy moved that a special condition did exist to Section 24.G.2. and 24.6.3,
"CN" Neighborhood Commercial District of the Grapevine Comprehensive Zoning
Ordinance 82-73 and that being the existence of the forty (40) feet of right-of-way
owned by the Texas Department of Transportation across the front of the property,
which prevents the development from being in compliance with current zoning
regulations. Ery Meyer seconded the motion which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy, Hecht
Nays: None
Absent: Bass
Chris Coy, with a second by Ery Meyer, moved to approve both special exception
requests to the Grapevine Comprehensive Zoning Ordinance 82-73; Section 24.G.2.
to allow a thirty five (35) foot special exception to the required one hundred and fifty
(150) foot lot depth to allow a one hundred and fifteen (115) foot lot depth; and
Section 24.G.3. to allow a twenty five (25) foot special exception to encroach the
twenty five (25) foot landscaped front yard setback allowing a zero (0) foot
landscaped front yard setback to be utilized as a parking area instead of landscaping.
The prevailing vote was as follows:

Next for the Board of Adjustment to consider was BZA94-02 submitted by Lewis,
Elliott & Studer Architects, Inc. for the First Baptist Church of Grapevine requesting
variances to the Grapevine Comprehensive Zoning Ordinance 82-73 for Lot 1, Block
1, First Baptist Church Addition and addressed as 301 East Texas Street.
Greg Wheeler, Building Official, explained that the First Baptist Church of Grapevine
is proposing to build a new sanctuary building on the south side of the existing
development. The applicant is requesting a ten foot variance to Section 15.G.1.
Single Family District Regulations which requires a thirty (30) foot front yard setback

to allow an entrance porch to encroach the front yard setback as shown on the plot
plan. They are also requesting variances to Section 15.1.1, Single Family District
Regulations which limits the height of a principal structure to two stories or thirty five
(35) feet to exceed the height limit allowing a sanctuary building height of fifty (50)
Feet and a steeple height of one hundred twenty (120) feet as shown on the plot
plan.
Architect, Rick Sowell, 11225 Huron Lane, Suite 104, Little Rock, Arkansas was
sworn in by Chairman Giffin to speak to the request. Mr. Sowell told the Board the
proposed sanctuary is planned to seat 2,500 upon completion of the lower floor and
balcony. However, at this time the balcony is not proposed to be finished and seating
will be based on a 1400 to 1500 seating capacity. The encroachment into the front
yard setback will only consist of an entrance porch. An exhibit showing a depiction
of the exterior of the new building with the steeple was shown to the Board to
illustrate the height of the new addition was equal in height to the existing structure
and the entrance porch as an architectural feature covering a required exit and landing
per the Grapevine Building Code.
City Councilman, Gil Traverse, told the Board that the City was currently working with
the Church to alleviate their parking problem and the City's parking problem on the
north end of downtown Grapevine.
With no other guests to speak to the request and no letters or petitions, Chris Coy
made a motion to close the public hearing. Carl Hecht seconded the motion which
prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy, Hecht

Chris Coy moved, with a second by Randy Howell, that a special condition did exist
for the first request and that being the entrance porch is an architectural feature
covering a required exit and landing required by the Grapevine Building Code and the
special condition for the second request is the height of most church sanctuaries
exceed the height of single family homes which prevailed by the following vote,

Chris Coy moved, with a second by Carl Hecht, to approve the variance requests to
the Grapevine Comprehensive Zoning Ordinance 82-73 for Lot 1, Block 1, First Baptist
Church Addition addressed as 301 East Texas Street, Grapevine, Texas to allow a ten
foot variance to the required thirty (30) foot front yard setback for the entrance porch
and landing to allow a twenty (20) foot front yard setback; and a fifteen (15) foot
variance for the sanctuary building to exceed the thirty five (35) foot height limitation
to allow a fifty (50) foot building height; and a eighty five (85) variance to allow the
steeple on the building to exceed the thirty five (35) foot height limitation to allow a
one hundred and twenty (120) foot steeple height as shown on the plot plan with the
prevailing vote as follows:
Ayes: Giffin, Howell, Meyer, Coy, Hecht

Next for the Board of Adjustment to consider was a request for interpretation of the
Grapevine Comprehensive Zoning Ordinance 82-73 submitted by Ramon Urreta of
Specialized Roofing, Inc. to locate at 110 North Scribner Street which is zoned "HC"
Highway Commercial.
Marcy Ratcliff, City Planner, explained the Highway Commercial District has two tiers
of uses permitted; properties with frontage on a State Highway and properties with
access to and frontage on a street other than a State Highway. The property at 110
North Scribner Street only has access to and frontage on North Scribner Street and
has no access to Northwest Highway. Mr. Urreta is a roofing contractor which staff
considers a building trade contractor. Because building trade contractors are not listed
as a principal use or as a conditional use in Section 26.D.3., he was denied a
Certificate of Occupancy by the Building Official.
Marcy Ratcliff explained to the Board that Mr. Urreta was appealing Staff's
interpretation of the Highway Commercial District to allow his use.
During discussions the Board discussed the definition of a building trade contractor
which included indoor or outdoor storage of building materials. Councilman Gil
Traverse suggested that the Planning and Zoning Commission should review the
permitted and accessory uses of the Highway Commercial District and make a
recommendation to the City Council.

Ery Meyer moved, with a second by Chris Coy, the Board of Zoning Adjustment was
in agreement with Staff's interpretation of the Highway Commercial Zoning District
as currently adopted and further, the Board of Zoning Adjustment requests the.
Planning and Zoning Commission consider defining the term building trade contractor
and review the Highway Commercial Zoning District for permitted and conditional
uses, which prevailed by the following vote:
Ayes: Giffin, Howell, Meyer, Coy, Hecht
Nays: None

Next for the Board of Adjustment to consider were the minutes of the January 3,
1994 meeting.
Ery Meyer moved, with a second by Chris Coy, to approve the minutes of January 3,
1994. The vote prevailed as follows:
Ayes: Giffin, Howell, Meyer, Coy, Hecht
Nays: None
Absent: Bass
MISCELLANEOUS
Marcy Ratcliff informed the Board reappointment of Board of Zoning Adjustment
members would occur in June, 1994. Terms would expire for Chairman Chuck Giffin,
members Patti Bass, Chris Coy and Ery Meyer at that time. The City Secretary would
be sending applications for the 1994-96 terms in April should they wish to apply.
She also told the Board that Lori Shelton has been hired to replace the Community
Development clerk's position formerly held by Carol Baron and FYI packets would
again be sent to them beginning in March.
ADJOURNMENT
With no further discussion, Chris Coy made a motion to adjourn. Ery Meyer seconded
the motion which prevailed by the following vote:
