CITY OF GRAPEVINE
The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday
evening, April 4, 1994, at 6:00 P.M. in the Council Chambers, Room #205, 307 West
Dallas Road, Grapevine, Texas, with the following members present to wit:

Chairman, Charles Giffin, called the meeting to order at approximately 6:05 P.M.
NEW BUSINESS
The first item of new business was for the Board of Zoning Adjustment to consider
BZA94-10, submitted by Donald Florence, who is requesting a variance for the
property located at 2826 Roundup Trail, platted as Lot 7, Block 8, Parra Linda II
Estates Addition, Grapevine, Texas.
The request is to the Grapevine Comprehensive Zoning Ordinance 82-73: Section
42.D., Supplementary District Regulations, requires a fifteen (15) foot side yard

adjacent to a side street upon which no property fronts.
The request is to allow a four and one-half (4-1/2) foot variance to encroach the
fifteen (115) foot side yard as shown on the plot plan. If approved, it would allow a
ten and one-half (10-1/2) foot side yard setback.
Marcy Ratcliff, City Planner, explained that Mr. Donald Florence purchased the
property with the house encroaching the building line as shown on the plot plan and
is not the fault of the owner.
Mr. Donald Florence was sworn in to address any questions from the Board. He
stated he purchased the property with a building line encroachment on the west side
of the property.
With no one to speak to the request, Randy Howell moved to close the public hearing.
Patti Bass seconded the motion which prevailed by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Hecht
Nays: None
Absent: Coy
Randy Howell moved that a special condition did exist to Section 42-D. and that being
the current owners purchased the house as shown on the plot plan and was not the
fault of the owner. Ery Meyer seconded the motion which prevailed by the following
vote:
Ayes: Giffin, Bass, Howell, Meyer, Hecht
Nays: None
Absent: Coy
Randy Howell, with a second by Ery Meyer, moved to approve the variance request
for Lot 7, Block 8, Parra Linda Estates Addition, addressed as 2826 Roundup Trail,
Grapevine, Texas to the Grapevine Comprehensive Zoning Ordinance 82-73; Section
42.D. to allow a four and one-half (4-1/2) foot encroachment into the fifteen (15) foot
side yard setback requirement to allow a ten and one-half (10-1/2) foot side yard
setback. The prevailing vote was as follows:

BZA94-11 - WILLIAM & ANITA HILFIKER
Next for the Board of Adjustment to consider was BZA94-11 submitted by William
and Anita Hilfiker requesting variances to the Grapevine Comprehensive Zoning
Ordinance 82-73 for 2210 Lakeridge, being out of the S. Cates Survey, A-2002 and
A. Harris Survey, A-707, Grapevine, Texas.
Marcy Ratcliff, City Planner, explained that Mr. & Mrs. Hilfiker are proposing to
subdivide their property into four (4) lots. There is an eight hundred (800) foot deep
well on the eastern property line that was in place at the time the Hilfiker's purchased
the property. Mr. & Mrs. Hilfiker tell us the water is good and they would like to see
the well remain on the property. However, the City Council can not approve plats on
property that is nonconforming to the current zoning ordinance. Therefore, they are
requesting variances to allow the well, covered by an existing accessory frame
structure, to remain. The following requests are to the Grapevine Comprehensive
Zoning Ordinance 82-73:
Section 42.C.3., Supplementary District Regulations which requires an accessory
structure to be subject to the same side yard requirements as the principal structure.
Section 14.G.6., "R-12.5" Single Family District Regulations which requires a sixteen
(16) foot minimum distance between principal or accessory buildings on adjacent lots.
The first request is to Section 42.C.3., Supplementary District Regulations to allow
the existing accessory frame building along the eastern property line a six (6) foot
variance to encroach the eight (8) foot side yard as shown on the plot plan. If
approved it would allow the existing frame building a two (2) foot side yard setback.
The second request is to Section 14.G.6. Single Family District Regulations to allow
the existing accessory frame building a six (6) foot variance to encroach the sixteen
(16) foot minimum distance between principal or accessory building distance of an
adjacent lot as shown on the plot plan . If approved, it would allow a ten (10) foot
minimum distance between structures on an adjacent lot.
Anita Hilfiker was sworn in to respond to questions from the Board regarding the well.
Mrs. Hilfiker told the Board the well has been in place approximately twenty years.
The well has been inspected and has been approved for use.
With no other guests to speak, one letter against the request, Patti Bass moved to
close the public hearing. Randy Howell seconded the motion which prevailed by the
following vote:

Randy Howell moved that a special condition did exist for the requests and that being
the well with accessory structure were existing at the time the property was
purchased by Mr. and Mrs. Hilfiker. Ery Meyer seconded the motion which prevailed
by the following vote:
Ayes: Giffin, Bass, Howell, Meyer, Hecht

Randy Howell moved, with a second by Ery Meyer, to approve the variance requests
to the Grapevine Comprehensive Zoning Ordinance 82-73 for 2210 Lakeridge Drive,
legally described by metes and bounds survey out of the S. Cates Survey, A-2002 and
A. Harris Survey, A-707 to allow a six (6) foot variance to encroach the (8) foot side
yard setback, to allow a two (2) foot side yard setback; and to allow a six (6) foot
variance to encroach the sixteen (16) foot minimum distance between principal or
accessory building distance of an adjacent lot, to allow a ten (10) foot minimum
distance between structures on an adjacent lot as shown on the plot plan with the
prevailing vote as follows:
Ayes: Giffin, Bass, Howell, Meyer, Hecht

BZA94-12 - PAYTON WRIGHT PROPERTIES., INC.
Next for the Board of Adjustment to consider was BZA94-12 submitted by Jimmy
Payton for Payton Wright Properties, Inc. who is requesting variances for the property
located at 440 State Highway 114 West, legally described as Lot 1, Block 2, Payton
Wright Addition and Lot 1 R, Block 2, Hayley Addition, Grapevine, Texas.
The following requests are to the Grapevine Comprehensive Zoning Ordinance 82-73,
Section 26.F.3., Highway Commercial District Regulations, which requires a minimum
open space of fifteen (15) percent of the lot.
Section 26.F.4., Highway Commercial District Regulations, which requires a maximum
impervious surface area of eighty five (85) percent.

Section 26.G.3., Highway Commercial District Regulations, which requires a twenty
five (25) foot landscaped front yard setback.
Section 43.E.3., Nonconforming Uses and Structures Regulations states the Board of
Zoning Adjustment has the ability to approve as a special exception the remodeling
or enlargement of an existing nonconforming use or building and allow the structure
to exist as developed.
The first request is to Section 26.F.3. to allow a two (2) percent variance to the
required fifteen (15) percent open space requirement as shown on the plot plan. If
approved, it would allow thirteen (13) percent open space of the lot.
The second request is to Section 26.17.4. to allow a two (2) percent variance to
exceed the maximum eighty five (85) percent impervious area as shown on the plot
plan. If approved it would allow a maximum of eighty seven (87) percent impervious
surface area.
The third request is to Section 26.G.3. to allow a twenty five (25) foot variance to the
twenty five (25) foot required landscaped front yard as shown on the plot plan. If
approved, it would allow a zero (0) foot landscaped front yard setback.
The fourth request is to Section 43.E.3., to allow a special exception to allow an
expansion of the existing car dealership in a similar fashion and as shown on the plot
plan. If approved, it would allow the remaining property between Payton Wright Ford
and Tia's Tex Mex to be developed the same as the current dealership.
Marcy Ratcliff, City Planner, explained that Payton Wright is proposing to expand the
dealership to maintain the volume of business with additional land to be used as a
sales lot with a sales office building. The applicant is proposing to match the existing
development as shown on the plot plan. They are trying to meet the intent of the
Ordinance and make the entire development look the same. This is the final land
expansion available at this location for the dealership.
Jimmy Payton of Payton Wright Properties was sworn in to respond to questions from
the Board. Mr. Payton told the Board that Payton Wright is proposing to expand the
dealership on the adjacent lot. They are requesting variances to make the dealership
consistent in appearance. He also told the Board he has spoken to the Texas
Department of Highways regarding paving of the drainage area in front of the
development.
With no other guests to speak and two letters of support, Patti Bass moved with a
second by Randy Howell, to close the public hearing. The vote was as follows:

Patti Bass moved that a special condition did exist and that being the applicant is
trying to meet the intent of the Ordinance at the same time they are expanding the
development to match the existing dealership. The development to the east is in
place and has no front yard setback. The building and use was in conformance when
the dealership was originally developed and variances were granted for the last
expansion in 1993 (BZA92-27). Randy Howell seconded the motion which prevailed
by the following vote:

Patti Bass moved, with a second by Randy Howell, to approve the requests for a
variances and a special exception to the Grapevine Comprehensive Zoning Ordinance
82-73 for 440 State Highway 114 West, legally described as Lot 1, Block 2, Payton
Wright Addition and Lot 1 R, Block 2, Hayley Addition, Grapevine, Texas to allow the
following : a two (2) percent variance to Section 26.17.3. which requires fifteen (15)
percent open space of the lot, allowing a thirteen (13) percent open space area; to
allow a two (2) percent variance to exceed the maximum eighty five (85) percent
impervious area, to allow a maximum of eighty seven (87) percent impervious surface
area; to allow a twenty five (25) foot variance to the twenty five (25) foot required
landscaped front yard, to allow a zero (0) foot landscaped front yard setback; to allow
a special exception to allow an expansion of the existing car dealership in a similar
fashion, all as shown on the site plan. Randy Howell seconded the motion which
prevailed by the following vote:

Next for the Board of Adjustment to consider were the minutes of the March 7, 1994
meeting.
Ery Meyer moved, with a second by Carl Hecht, to approve the minutes of March 7,
1994. The vote prevailed as follows:

With no further discussion, Patti Bass made a motion to adjourn. Ery Meyer seconded

The meeting was adjourned at approximately 6:45 P.M.
