I hope this cover letter will help to clear up my position in requesting a zoning variation for my residence at 1917 Rose Ct. Unaware of the easement along my north property line, I built a small tool shed in my back yard in the only logical place to put it. I realize now that it will have to be moved or torn down because it stands less than three feet from my next door neighbors residence. I am requesting the variance in order to comply with this restriction. If approved, I will move the shed three feet east but it would remain on the easement. I built it low, standing only seven feet tall at the tallest point so it would not be visible from the street (see enclosed photos). My next door neighbor, Mr. Mike Comparoni owns the house with the easement restriction. He doesn't mind having the shed where it is right now and has offered to help me move it gree feet east if this request is approved. Section 14.G.1., R-12.5, Single Family District Regulations -Area Regulations, requires a front yard setback of thirty-five (35) feet. The proposed variance request would allow a ten (10) foot reduction of the front yard setback If approved it would allow a twenty-five (25) foot front yard setback. 2. Section 14.G.5., R-12.5, Single Family District Regulations - Area Regulations, requires a minimum lot depth of one hundred (100) feet. The proposed variance request would allow a one and six tenths (1.6) foo reduction of the lot depth along the west side of the lot If approved it would allow a ninety-eight and four -tenths (98.4) foot lot depth on the west side of thelot, SPECIAL CONDITION: Staff finds a special condition exists for the first proposed variance due to the lot being originally platted with a twenty-five (25) foot front building line; other developed lots in this subdivision have a twenty-five (25) foot front yard setback; the shallow depth of the lot adds further reason for reduction. Staff feels the second request is justified, as the existing lot has a ninety-eight and four -tenths (98.4) foot lot depth, and an increase in depth is beyond the control of the applicant. BACKGROUND INFORMATION: Ms. Vickie Diedrick submitted a request for the variances to allow the development of a new residence. Staff finds no special condition exists for the fourth request (to allow an existing residential use to remain). Staff finds no hardship for this request, as this is not a permitted use that other properties in this zoning district enjoy. BZA96-43 WILLIAM S. EASTWOOD The first item for the Board of Zoning Adjustment to consider was BZA96-43 submitted by William S. Eastwood who requested variances for 1917 Rose Court, platted as Lot 6, Block 2, Park Central Addition, Grapevine, Texas. The variances were from the Grapevine Comprehensive Zoning Ordinance 82-73: Section 16.6.6., R-5.0, Zero Lot Line District Regulations which requires a twelve (12) foot separation between buildings on adjacent properties. The proposed variance would allow a reduction of eight (8) feet to the separation requirements. If approved, it would allow a four (4) foot separation between buildings on adjacent properties. Section 42.C.3., Supplementary District Regulations which requires a detached accessory building to be separated ten (10) feet from the main residence and have the same sideyard setback as required for the main structure, eleven (11) feet. The proposed variance would allow a seven (7) foot reduction in separation, and an eight (8) foot reduction of the required sideyard setback. If approved, it would allow a minimum separation of three (3) feet between the accessory building and the main structure and a BZA Minutes 1/06/96 minimum of three (3) feet between the accessory building and the side property line. Mr. Williams explained that staff recommended denial of the request, as there is room on the lot for a complying structure. Mr. Williams also noted that Mr. and Mrs. Eastwood were not able to attend the meeting. The variances were from the Grapevine Comprehensive Zoning Ordinance 82-73: Section 14.G.I., R-12.5, Single Family District Regulations - Area Regulations, which requires a front yard setback of thirty-five (35) feet. The proposed variance would allow a ten (10) foot reduction of the front yard setback. If approved, it would allow a twenty-five (25) foot front yard setback. Section 14.G.5.- R-12.5., Single Family District Regulations - Area Regulations, which requires the lot depth of one hundred (100) feet. The proposed variance would allow a one and six tenths (1.6) foot reduction of the lot depth along the west side of the lot. If approved, it would allow a ninety-eight and four - tenths (98A) foot lot depth on the west side of the lot. Mr. Williams explained that Staff found special conditions existed for the proposed variance due to the lot being originally platted with a twenty-five (25) foot front building 0 BZA Minutes 1/06/96 line; other developed lots in this subdivision have a twenty-five (25) foot front yard setback, and that Staff found the second request was justified, as the existing lot has a ninety-eight and four -tenths (98.4) foot lot depth, and an increase in depth is beyond the control of the applicant. Matthew Kerlee of 2307 High Drive, Lot 15, Grapevine, took the Oath of Truth and explained that he was against the variance to the twenty-five (25) foot front yard setback. Mr. Kerlee explained that in 1983, his father had built his house with a thirty-five (35) foot front yard setback due to City requirements. Mr. Kerlee expressed concern to see continuity on the street. Vickie Diedrick, applicant of 1800 Fern Court, Grapevine, took the Oath of Truth and explained that she was trying to purchase the lot contingent on variances being granted by the Board of Zoning Adjustment. Ms. Diedrick explained that she was planning to build a 1650 square foot single story house, with a side entry garage. Ms. Diedrick noted that Mr. Kerlee's lot was bigger and deeper. Donna Snider of 203 North Capri, Duncanville, Texas, and owner of the lot, took the Oath of Truth and explained that when she purchased the property, the front yard setback was twenty-five (25) feet. Ms. Snider explained that she has been unable to sell the property due to the lot size and setback requirements. The members discussed that the house could be moved back on the lot four (4) feet which would leave the front yard setback at twenty-nine (29) feet instead of the requested twenty- five (25) feet. After further discussion, Jill Davis made a motion to close the public hearing. Mr. Williams explained that Dick Ward, Fire Marshall, expressed concern about Fire Department access to the back of the property where the second residence was located. Mr. Williams also explained that one of the lots was already overdeveloped at 43% lot coverage. Section 15.G.2., Single Family District Regulations - Area Regulations, to allow a twenty- four (24) foot reduction of the twenty-five (25) foot rear yard setback, allowing a one (1) foot rear yard setback for the second residence. Section 15.B., Single Family District Regulations - Accessory Uses, to allow a special exception for an existing second residence to remain.
