Section 42.C.3., Accessory Buildings - requires an accessory building to be located no nearer than six (6) feet to any rear lot line and shall be subject to the same side yard requirements as the principal structure. In the case of a corner lot, no accessory building shall be located within any side yard required on the street side. The applicant is requesting a variance to allow a fifteen (15) font encroachment into the required fifteen (15) foot side yard for -an accessory storage building and to allow an encroachment of five (5) feet into, the required'six (6) foot `rear yard setback If approved. it would allow an accessory— storage building to be located within the fifteen (15) foot side yard setback and on (1) foot from "the rear Rrope by line. I am requesting that the board consider my plea to allow me to finis the storage shed I started building outside the boundaries set by section 42 of city code. I unknowingly started building a shed without a permit of the street side of my backyard since the biggest portion of the lot is on that side. The lot itself is L shape and is only 30 ft from the patio egde to the back fence, but once it passes the southwest corner of the house, it opens up to a larger yard. ITEM 5. The following variances are to section 15.G.1 -Front Yard Setback for R75 Single Family Resendential. 1. Request a variance of 4 feet for the existing foundation southeast comer which encroaches approximately 3.6 feet over the 30' setback line. (See 1996 Plat and revised Site Plan.) 2. Request a variance of 4 feet for a garage addition which has the same encroachment as the residence foundation of 3.6 feet. (See Site Plan) ITEM 6. When this residence was originally constructed in 1973, it was encroaching over the platted 30' building line at the southeast corner of the foundation. This condition was not discovered until an accurate survey was done on November 23,1996 by Arthur Surveying Company. The plat supplied when we purchased the house in 1980 indicated that the foundation had more than a foot of clearance from the setback line. Consequently it appeared that there was plenty of room without encroachment to build a garage on the front of the house and because of that; the original garage was built into an extra bedroom and office. The original plan to build a garage on the front was conceived using, as correct, the 1980 plat information. It had been certified as correct by James H. Dowdy P.E. in 1980 so there was no reason to doubt its' validity. This plat was also used to apply for a loan to accomplish the garage, various interior and exterior remodelling tasks. The garage addition was the major factor in securing the loan amount necessary. This loan closed on Friday December 6, 1996. That was when the plat was given to us with the encroachment shown. This was verified by measuring from the property line established by Arthur Surveying Co. Please note (Brookhollow Estates Plat) the irregular placement of the homes on the west side of Meadowbrook Drive which indicates why no one has noticed the encroachment until this recent survey. It is because of this irregular placement of the homes on the west side of Meadowbrook Drive that we submit that the existing home with a garage addition will have only a positive visual impact on the neighborhood and enhance the value of all surrounding properties. ITEM 7 No unique circumstances other than form inspection did not catch the error. ITEM 8 Included with this application is the 1980 plat, the 1996 plat, a site plan(revised 1996) and the original Brookhollow Estates plat. 8. ATTACH A DETAILED DIAGRAM OF THE SITE DRAWN TO SCALE, AND ANY OTHEF DRAWINGS OR PICTURES NECESSARY TO HELP EXPLAIN THE CASE TO THE BOARD. The first item for the Board of Zoning Adjustment to consider was BZA96-40 submitted by David Wilson who requested variances for 829 South Dooley Street. The variances are from the Grapevine Comprehensive Zoning Ordinance 82-73: Section 31.F, Light Industrial District, requires a minimum lot size of twenty thousand (20,000) square feet. The proposed variance would allow a ten thousand -six hundred and twenty-one (10,621) square foot reduction in the required lot size. If approved, it would allow a lot size of nine thousand -three hundred and seventy nine (9,379) square feet. Section 31.G.1, Light Industrial District, requires a minimum lot width of one hundred (100) feet. The proposed variance would allow a fifteen (15) foot reduction in the required lot width. If approved, it would allow a lot width of eighty-five (85) feet. BZA Minutes 11/04/96 Section 31.G.2, Light Industrial District, requires a minimum lot depth of one hundred fifty (150) feet. The proposed variance would allow a seven (7) foot reduction in the required lot depth. If approved, it would allow a lot depth of one hundred forty-three (143) feet. Section 31.G.3, Light Industrial District, requires a front yard of not less than thirty (30) feet in depth which shall be utilized as a landscaped setback area. Front yards shall not be used for any building, structure, fence, wall, parking or storage area, except that signs shall be permitted in this area. The proposed variance would allow parking in the required front yard setback. If approved, it would allow two (2) parking spaces in the required front yard setback. Section 31.G.4, Light Industrial District, requires every lot to have two side yards, each of which shall not be less than fifteen (15) feet in width. The proposed variance would allow a three (3) foot reduction to the required side yard to the north. If approved, it would allow a side yard of twelve (12) feet along the north property line. Section 53.H.2.b, Landscaping Regulations, requires that whenever an off-street parking or vehicular use area abuts an adjacent property line, a perimeter landscape area of at least ten (10) feet in width shall be maintained between the edge of the parking area and the adjacent property line. The proposed variance would allow a five (5) foot reduction in the perimeter landscape area depth. If approved, it would allow a perimeter landscape area of five (5) feet. Mr. Stombaugh explained that Staff found special conditions existed for all the proposed variances because the lot and structure, previously used as a single family residence, were existing in a zoning district now zoned Light Industrial. Mr. David Wilson, applicant, of 501 Smith Street, Grapevine, took the Oath of Truth and explained about the lot, parking and that the plat was going before the City Council December 17, 1996. There was discussion about there being enough parking for future uses of the property. The Board discussed the option of deleting the two head -in parking spaces E BZA Minutes 11/04/96 shown on the plot plan and adding a third parallel space in line with the two parallel spaces shown on the plot plan. With no one else to speak either for or against the request, Carl Hecht made a motion to close the public hearing. The variances were from the Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures, which allows the Board of Zoning Adjustment to approve the remodeling or enlargement of a nonconforming use or structure. The requested special exception would allow the enlargement of an existing building and the use of an existing concrete pad for parking. Section 53.H.2.b, Landscaping Regulations, which requires that whenever an off- street parking or vehicular use abuts an adjacent property line, a perimeter landscape area of at least ten (10) feet in width shall be maintained between the edge of the parking area and the adjacent property line. The requested variance would eliminate the required ten (10) feet of perimeter landscape area around the proposed off-street parking area. If approved, it would allow the development of an off-street parking area without the required ten (10) foot perimeter landscaping. Section 31.H, Light Industrial District, which requires whenever a Light Industrial District abuts a residentially zoned district, a landscape buffer zone of not less than twenty-five (25) feet in depth shall be provided from the lot line. 4 BZA Minutes 11/04/96 The requested variance would allow a nine (9) foot reduction in the required buffer zone at the new building line, and a twenty-two (22) foot reduction in the required buffer zone at the end of a concrete pad at the entrance of the new building. If approved, it would allow a buffer zone of sixteen (16) feet at the building line and three (3) feet at the end of the concrete pad. Mr. Stombaugh explained the case and noted that Staff found that special conditions existed for the proposed special exception since the building and concrete pad already exist; for the proposed variance to the landscaping requirement around the concrete pad to be used as a parking area because the concrete pad is in place two hundred - twelve (212) feet along the rear lot line and one hundred -ninety-five (195) feet along the east lot line; and for the proposed variance to the buffer requirement due to the irregular shape of the lot and the existing building placement within the lot. A solid wood screening fence already existed along the rear and west property lines. A one thousand -nine hundred and forty two (1,942) square foot warehouse addition is proposed to be added to the existing 6,978 square foot warehouse. The concrete pad will be used for loading/staging access to the new warehouse addition. A five thousand -ninety two (5,092) square foot proposed office addition will be added to the four thousand -six hundred and sixty seven (4,667) square foot existing office area. Additional parking will be provided at the front of the building. Mr. Jon Kennedy, applicant, took the Oath of Truth and explained that the building was built in 1980 and there were variances at that time. Mr. Kennedy explained that he was proposing to double the office size. Mr. Stombaugh noted that the required number of parking spaces, (37) per the gross square footage of the building, were provided. Mr. Kennedy explained that the area to the north, that is shown with slash marks on the plot plan, is already existing concrete and will be removed for the expansion of the building on the north end. The front entry will be changed to the north side. There was discussion concerning how trucks would enter the property. Mr. Kennedy explained that the trucks would enter the property through the north entry between the concrete area west of the parking area and the building. The proposed variance would allow a seven hundred (700) foot reduction of the minimum lot size. If approved, it would allow a minimum lot size of sixty-eight hundred (6,800) square feet for -the existing lot. Mr. Kerlee explained that in 1983, his father had built his house with a thirty-five (35) foot front yard setback due to City requirements. Mr. Kerlee expressed concern to see continuity on the street. Vickie Diedrick, applicant of 1800 Fern Court, Grapevine, took the Oath of Truth and explained that she was trying to purchase the lot contingent on variances being granted by the Board of Zoning Adjustment. BZA Minutes 02/03/97 Jesse Saenz took the Oath of Truth and explained that he interpreted the code to be that structures are to be fifteen (15) feet from the curb for corner lots. The shed was built in accordance with his interpretation of those regulations. Terry Walker of 1912 Wood Creek, the neighbor directly behind Mr. Saenz, took the Oath of Truth and explained that the shed looked professionally built and recommends the Board grant the variance. Bryan Kline of 1836 Meadowcrest, took the Oath of Truth and explained that he had followed the regulations to build his shed, Mr. Kline noted that there is no unusual topography of Mr. Saenzs lot and the shed could be located in another area of the yard. Mr. Kline also noted that this project was started three years ago and has not been completed. The Board asked Mr. Saenz why he did not obtain a building permit. Mr. Saenz explained that he had talked with someone from the City and was told he could do anything he wanted in his back yard. He did note he obtained a permit to move his fence and for paving for his R.V. which is parked legally in his side yard. Section 15.G.1., Single Family District Regulations, Front Yard Setback, requires a front yard setback of thirty (30) feet. The applicant requested a variance to allow a five (5) foot reduction of the front yard setback for the proposed garage addition. Section 15.J., R-7.5, Single Family District Regulations, Off Street Parking, requires all required off-street parking to be located behind the front building line. The applicant requested a variance to allow required off-street parking to encroach five (5) feet into the required front yard setback. Mr. Williams explained that Staff recommended approval for the first request because the existing encroachment is not the fault of the owner, but denial was recommended for the second and third requests because no special conditions could be found. Mr. Williams also explained that the encroachments could be slightly less than five (5) feet, but since the survey does not show the actual setback at various points across the front of the house, Staff modified the applicants request to a conservative five (5) feet. Mr. Loban, applicant, took the Oath of Truth and explained that ten years ago, he had planned to build a garage with the survey which showed the residence to be one (1) foot behind the setback line. Mr. Loban explained that when he had a recent survey done, it showed the existing house encroaching three and one-half (3.5) feet. The next item for the Board of Zoning Adjustment to consider was BZA97-01, submitted by David Barnhouse who is requesting a variance for 221 Starnes Street, platted as Lot D, J. J. Hall Addition. The variance was from the Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures allows the Board of Zoning Adjustment to permit the remodeling or enlargement of a nonconforming use or structure. The proposed special exception would allow the construction of an accessory garage building to be constructed on a lot with an existing single family residence in a R -MF -1, Multi -Family Zoning District as shown on the plot plan. Mr. Williams explained that Staff found a special condition existed, as the setbacks would comply with R-7.5, Single Family District Regulations for accessory building requirements. Mr. Williams explained that the erection of the structure will result in the demolition of an existing nonconforming accessory building per the application submitted by the owner. David Barnhouse, the applicant, took the Oath of Truth and explained that the existing storage building would be demolished and he would like to build a new accessory building that would be the same size as the house that is located on the lot. Mr. Barnhouse explained that the accessory building would be used for his Father's hobby of rebuilding vintage cars. The Board asked Mr. Barnhouse if the structure would at any time be used for any type of business operation. Mr. Barnhouse stated that it would not. The variance is to the Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3., Nonconforming Uses and Structures allows the remodeling or enlargement of a nonconforming use or structure. The proposed special exceptions would allow the existing building to remain as developed and to allow the remodeling of the existing parking lot area. If approved, it would allow Texas Bank to remodel the drive through lanes and the entrances and exits of the property as shown on the site plan. Marcy Ratcliff explained that the bank was built under the 70-10 Zoning Ordinance. Ms. Ratcliff explained that Municipal Boulevard, which runs along the banks north property line will be realigned with Vine Street to provide better traffic flow in and out of the parking area of the bank and the Public Library. She explained that Mr. James L. Hewlett, the architect, submitted a request for the special exception to allow the redevelopment of Texas Bank's parking lot. Texas Bank originally submitted a layout upgrading their parking lot and the drive through lanes to better serve their patrons. The City worked with the applicant to help solve the traffic hazard at the entrances to Municipal Way (which accesses the Library and the Community Activities Center) and to Texas Bank. Marcy Ratcliff explained that Staff found special conditions existed because the building was developed under the prior Zoning Ordinance and the applicant is attempting to create 0 BZA Minutes 02/03/97 a better traffic flow through his property. Additionally, the applicant has worked with the City to redevelop the driveways and intersections along Main Street to help alleviate a traffic hazard. Mr. Jim Hewlett, architect for Texas Bank and applicant, took the Oath of Truth and explained that they were working with the City on alternative ways to locate the traffic lanes around the building and traffic flow. BZA96-51 - GRAPEVINE KAWASAKI -POLARIS Next for the Board of Zoning Adjustment to consider was BZA96-51, submitted by Grapevine Kawasaki -Polaris who requested special exceptions for 418 East Northwest BZA Minutes 02/03/97 Highway, platted as Lot 1, Block 2, A.F. Leonard Addition. The special exceptions are to Grapevine Comprehensive Zoning Ordinance 82-73: The requested special exceptions would allow the existing non -conforming development to remain as developed and allow the remodeling of the exterior gravel area. If approved, it would allow the existing development to remain as developed and the remodeling of the exterior gravel area as shown on the site plan. Marcy Ratcliff noted the applicant had submitted a revised proposed site plan dated February 3, 1997. As a result of the revised site plan dated February 3, 1997, Staff revised the recommendation from consideration to approval. The revised site plan indicates some landscaping along the front property line adjacent to East Northwest Highway and a revised pole sign which meets the current sign regulations. As a result of these changes, Staff found a special condition for the existing development. The building as exists has a metal exterior, and the development and layout of the property limits the amount of landscaping allowable along Northwest Highway. Ms. Ratcliff went on to explain that Mr. Wilbur Goltz submitted the request for the special exception to allow Grapevine Kawasaki -Polaris to use the non -conforming development in conjunction with a Conditional Use Permit CU97-04 for automotive sales and service for motorcycles, all terrain vehicles and watercraft. The applicant proposed to pave the existing graveled area up to the surrounding fence line and provide a screening wall for proposed storage areas. Phil Morley, architect and applicant of 920 South Main Street, Grapevine, took the Oath of Truth and explained about the property being built in 1985, prior to the current zoning ordinance and that the existing sign is shown as 26 feet which will be cut down to 20 feet. Mr. Morley explained that the owner will pave the area as per City specifications. Ms. Ratcliff commended the applicant with his efforts in working with Staff on the signage.
