Section 15.G.1., R-7.5, Single Family District Regulations requires a thirty (30) foot front yard setback. The proposed variance would allow a three (3) foot encroachment of the existina house into the required thirty (30) foot front yard setback If approved it would allow the existing house a twenty-seven (27) foot front yard setback as shown on the plot plan. SPECIAL CONDITION: Staff finds a special condition exists for the request, as the structure is existing, and the encroachment is not the fault of the current owner. cxel• - An application was submitted to the Department of Development Services by Mr. Mike Swimelar. This structure was constructed in 1989 after the implementation of setback inspections. Staff will have the permit packet for 2818 Woodland Hills Drive available at the meeting. 0:\BZA\97-1 z.a 1 Z89 -16G: att]u _l-, r c. i _ %1 5\I z 6 6 s J C O{i OOj' OR+vE IN a i 1 1 ._._—__ - •K , Clz. College Street as follows: 1. Section 54, Masonry Requirements requires a minimum of 80% of the exterior walls on structures in the R-TH, Townhouse Zoning District, be constructed of masonry. -• -••-•dr.10181 1111 -0 --ill •. • •- ••• -• • • •- - • • - • •. • •• • • - • • • .• Staff finds a special condition exists for the request. This existing building was originally designed without masonry veneer, and is to be moved into the College Street historic district allowing the existing wood siding to remain and will allow the structure to be visually compatible with other buildings in the district. The financial burden of adding masonry veneer would prevent the utilization of this valuable historic resource. An application was submitted to the Department of Development Services by Mr. Ray Andrae representing the First United Methodist Church. This structure is currently located in Colleyville on John McCain Road and must be moved as a result of impending development. This is a residential structure, and will be used as an office. 1 •< I ` a .Jo lZ Z7 --- TS 1GV`q, rI I I b SB v —CU83- m -- - --U9 7 - .R co (OE H - 32 38 U9 1 3 CU i -Q2 P T ,q 7 TTS, H C 1 a o T jR f = j /1 'a' 18 ;( 9 _ , .5'S c ,)a , 02.0 t f- 1 C \O l^ T5 la.. i J9 TO .M R 2 k 2 •LLn' P Z X03 68 TOwWALL ST. tP .5, sqe aT r za GU I TR 5e 5 FI w< TP. Dooley Survey, Abstract A-422, Tarrant County, Texas and Lot 1, Block 1, Payton Wright 11 Addition and addressed as 417 and 441 East Dallas Road as follows: 1. Section 43.E.2., Changing Non -Conforming Uses - allows the Board of Zoning Adjustment to grant a change of use from one non -conforming use to another non- conforming use provided such change is a permitted use in that zoning district. The requested special exception would grant Payton -Wright the ability to change the non -conforming Chamber of Commerce office use and development to a permitted vehicle leasing facility use and remain as developed in conjunction with the development of display/storage area on Lot 1. Block 1. Pavton-Wriaht II SPECIAL CONDITION: Staff finds a special condition exists because the applicant is proposing to bring the use of the property into conformance, while using the existing non-confroming Chamber of Commerce development. BACKGROUND INFORMATION: Section 43, Non -conforming Uses and Structures defines types of non -conformity as any use of land or buildings which does not conform to the use regulations prescribed in the Zoning Ordinance. Non -conforming developments (buildings, setbacks landscaping lot size etc.) are termed as non -conforming uses. 0:\BZA\97-14.4 1 Payton -Wright Ford Sales is proposing to replat tract 7A and Lot 1, Block 1, Payton -Wright II Addition into one lot to develop a vehicle leasing facility, which is a permitted use in the Light Industrial District. The applicant proposes to use the existing Chamber of Commerce office building and develop a paved storage area for the vehicles. The special exception to the Grapevine Comprehensive Zoning will grant a change of use from an office use to a vehicle leasing facility. The Light Industrial District does not allow offices uses as a principal use, however accessory office uses are allowed. 0:\BZA\97-14.4 2 'b 164 6- 2 00t 2 0 ILI j IC It j 0;06 L Al cv9z --04 -CU91-ic cc 32 38 CU92 " 45171 sir I SIC ITO cud5- 2 vLA -T Z 7 9T ejl I I z j IT C R jT. LIST THE PERTINENT SECTION(S) OF THE ZONING ORDINANCE AND INDICATE THE SPECIFIC VARIANCE AMOUNTS BEING REQUESTED. IF NECESSARY USE A SEPARATE SHEET. Section 54, Grapevine Comprehensive Zoning Ord. X182-73 requires all structures in Government Use Zoning District to have exterior walls be at least 70 % masonry. The requested variance would allow the sheathing of an existing non -historic concrete block building in wood to be more compatible with the historic Cotton Belt Depot, Section Foreman's House & Tenant Farmers House nearby, also on the Grapevine Heritage Center site. 6. STATE THE GROUNDS FOR THE REQUEST AND DETAIL ANY SPECIAL CONDITIONS WHICH CAUSE HARDSHIPS THAT IN YOUR OPINION JUSTIFY THE VARIANCE(S) OR SPECIAL EXCEPTION(S) YOU ARE REQUESTING. EXAMPLES OF SPECIAL CONDITIONS ARE: HILLS, VALLEYS, CREEKS, POWER POLES, ELEVATIONS, IRREGULAR LOT OR TRACT SHAPES, ETC. THE BOARD OF ZONING ADJUSTMENT MUST DETERMINE A SPECIAL CONDITION OR CONDITIONS EXIST(S) BEFORE MAKING A MOTION TO APPROVE A REQUEST. IF IT IS DETERMINED THAT NO SPECIAL CONDITION EXISTS, THE MOTION MUST BE TO DENY THE REQUEST. Restoration of the historic (wooden) buildings on the Heritage Center property has rendered the large concrete block building "obsolete" from a visual and compatibility perspective. The Foundation's mission to interpret the late 19th & early 20th century history of Grapevine will be advanced through renovation of the Heritage Center Building. Wood surfaces will be most compatible with existing buildings on site. 7. EXPLAIN ANY UNIQUE CIRCUMSTANCES, IF APPLICABLE, NOT CONSIDERED BY THE ZONING ORDINANCE. EXAMPLES: (1) IF THE GRAPEVINE CITY COUNCIL APPROVED A PLAT PRIOR TO PRESENT ZONING ORDINANCE REQUIREMENTS; OR (2) THE ORDINANCE WAS AMENDED OR A POLICY CHANGE WAS ADOPTED AFTER INITIATION OF THE PLANS CHECK PROCESS FOR A BUILDING PERMIT OR OTHER PHASE OF THE DEVELOPMENT PROCESS. The entire Heritage Center property has recently been listed in the National Register of Historic Places based on the architecture and history of the wood -sheathed railroad & agricultural buildings. Covering the Heritage Center structure with wood will bring it up to compatibility with the National -Register - listed buildings. 8. BZA97-12 MIKE SWIMELAR The first item for the Board of Zoning Adjustment to consider was a request from Mr. Mike Swimelar who requested a variance for 2818 Woodland Hills Drive, platted as Lot 30, Block 3, Western Oaks Addition, Grapevine, Texas. The following variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., R-7.5, Single Family District Regulations requires a thirty (30) foot front yard setback. The proposed variance would allow a three (3) foot encroachment of the existing house into the required thirty (30) foot front yard setback. Mr. Williams explained that Staff found special conditions for the request, as the structure was existing, and the encroachment was not the fault of the current owner. Mr. Williams also explained that the structure was constructed in 1989 after the implementation of setback inspections. BZA Minutes , 6/2/97 CII Mr. ippti , took the Oath of Truth and explained he had bought the house in April, which at that time, the survey showed the southwest corner encroaching three feet into the front yard setback. With no one else to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Carl Hecht made a motion that a special condition existed, as the encroachment was not the fault of the current owner. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Carl Hecht made a motion to approve the variance to Section 15.G.1., R-7.5, Single Family District Regulations to allow a three (3) foot encroachment of the existing house into the required thirty (30) foot front yard setback allowing the existing house a twenty- seven (27) foot front yard setback as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis BZA97-13 FIRST UNITED METHODIST CHURCH The next item for the Board of Zoning Adjustment to consider was BZA97-13 submitted by the First United Methodist Church who requested a variance for 300 West College Street, platted as Lot 1, Block 1, First United Methodist Church Addition. The following variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 54, Masonry Requirements requires a minimum of 80% of the exterior walls on structures in the R-TH, Townhouse Zoning District, be constructed of masonry. 2 BZA Minutes 6/2/97 The proposed variance request would allow a 100% reduction of the masonry requirement. If approved, it would allow an existing wood framed structure that has been moved onto the site with no exterior masonry as shown on the plot plan. Mr. Williams explained that Staff found that special conditions existed for the request. Mr. Williams noted that the financial burden of adding masonry veneer would prevent the utilization of this valuable historic resource. Mr. Williams noted that an application was submitted to the Department of Development Services by Mr. Ray Andrae representing the First United Methodist Church. Mr. Williams also noted that the structure was previously located in Colleyville on John McCain Road and had been moved as a result of development. The structure will be used as an office for the church. After discussion concerning the plans for the parking area, Ery Meyer made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Ery Meyer made a motion that special conditions existed being that the existing building was originally designed without masonry veneer. Allowing the existing wood siding to remain would allow the structure to be visually compatible with other buildings in the district. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Davis Ery Meyer then made a motion to approve the variance to Section 54, Masonry Requirements to allow a 100% reduction of the masonry requirement, allowing an existing wood framed structure that has been moved onto the site with no exterior masonry as shown on the plot plan. The next item for the Board of Zoning Adjustment to consider was BZA97-14 submitted by Payton Wright Ford Sales, Inc., who requested variances for 417 and 441 East Dallas Road, platted as Lot 1, Block 1, Payton Wright II Addition. The following variances are from Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.2., Changing Non -Conforming Uses allows the Board of Zoning Adjustment to grant a change of use from one non -conforming use to another non -conforming use provided such change is a permitted use in that zoning district. Ms. Ratcliff explained that the requested special exception would grant Payton -Wright the ability to change the non -conforming Chamber of Commerce office use and development to a permitted vehicle leasing facility use and remain as developed in conjunction with the development of display/storage area on Lot 1, Block 1, Payton -Wright II Addition. Ms. Ratcliff also explained that the major use will be vehicle leasing and the office use is a secondary use to that. Ms. Ratcliff noted that this would go before Planning and Zoning on June 17, 1997, contingent on BZA's approval. Jimmy Payton, Chairman of the Board for Payton Wright Ford, Inc., took the Oath of Truth and explained how the property would be used for fleet sales and that the Chamber of Commerce building would be used for their fleet sales office for four to five people.
