DIRECTOR OF DEVELOPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening, July 7, 1997, at 6:00 P.M. in the Council Chambers, 2nd Floor, 200 South Main Street, Grapevine, Texas, with the following members present to wit: Randy Howell Chairman Carl Hecht Vice -Chairman Ery Meyer Secretary Dennis Luers Member Jill Davis Member Russell Anderson 1 st Alternate Ron Cook 2nd Alternate constituting a quorum. Also present was City Council Representative Roy Stewart and the following City Staff: Scott Williams Ron Stombaugh Gerrie Anderson Building Official City Planner Secretary Chairman Randy Howell called the meeting to order at 6:00 P.M. OATH OF OFFICE Gerrie Anderson administered the Oath of Office to reappointed members Randy Howell and Russell Anderson and to newly appointed 2nd Alternate, Ron Cook. BZA97-17 KAREN REYNOLDS The item of business for the Board of Zoning Adjustment to consider was a request from Ms. Karen Reynolds who requested variances for 712 East Texas Street, platted as Lot 10, Block 107, College Heights Addition, Grapevine, Texas. The following variances were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15. F. 2., - "R-7.5" Single Family District which requires a minimum lot size of 7500 square feet. The request would allow a variance of 500 feet to the required 7500 square foot minimum lot size requirement. If approved, it would allow a minimum lot size of 7000 square foot. BZA Minutes 7/7/97 Section 15.6.1., "R-7.5" Single Family District which requires a thirty (30) foot front yard setback. The request would allow a five (5) foot variance to the thirty (30) foot front yard setback requirement. If approved, it would allow a twenty-five (25) foot front yard setback. Section 15.G.4., "R-7.5" Single Family District which requires a minimum lot width of sixty-five (65) feet. The request would allow a fifteen (15) foot variance to the sixty-five (65) foot minimum lot width requirement. If approved, it would allow a fifty (50) foot minimum width of lot. Section 15.H., "R-7.5" Single Family District which requires a forty (40) foot buffer yard setback when adjacent to a multi -family district. The request would allow a thirty-four (34) foot variance to the forty (40) foot buffer yard requirement for the east and west side property lines, and a fifteen (15) foot variance to the required forty (40) foot buffer yard requirement for the rear property line. If approved, it would allow a six (6) foot buffer side yard setback and a twenty five (25) foot buffer rear yard setback. Mr. Stombaugh explained that special conditions existed for the requests because the College Heights Addition was originally platted in 1909 for single family development with a fifty (50) foot lot width and a one -hundred forty (140) foot lot depth, and a twenty-five (25) foot front yard setback. Mr. Stombaugh further explained that the older subdivisions in Old Town Grapevine do not meet any of the current requirements for single family development. The request would be in keeping with a new program instituted by City Council to revitalize the original township area. Ms. Reynolds, applicant, of 1860 Hunter's Creek, Southlake, Texas, took the Oath of Truth and explained that she did not need to request the thirty (30) foot front yard because she plans on placing the house forty-five (45) feet from the street. Jill Davis asked that if the house was pulled forward on the lot, would the rear buffer yard variance of fifteen (15) feet be needed. 2 BZA Minutes 7/7/97 Ms. Reynolds explained that there was a dedicated alley to the rear of the property, and she did not feel that the rear buffer yard should be required. Mr. Williams explained that he felt due to the alley, the rear buffer requirement could be avoided. He further added that whether or not the applicant needed the front yard setback, the variance request was proper in order to bring the property into compliance. Mr. Williams explained that the request to rezone the property to R-7.5 Single Family District and redevelop it as a residence is consistent with the single family uses of surrounding properties and the revitalization of the old town area of Grapevine. Mr. Williams explained that the request to rezone the property to R-7.5, Single Family District was heard in public hearing on June 17, 1997, by Council and the Planning and Zoning Commission and was approved on the first reading of the ordinance pending approval of the Board of Zoning Adjustment. Mr. Williams passed out a plot plan of the property showing the house that would be moved onto the property. The Board asked about off-street parking. Ms. Reynolds stated that the driveway would come from the paved alley in the rear which would constitute the required off- street parking. With no one else to speak either for or against the request, Ery Meyer made a motion to close the public hearing. Jill Davis seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Davis Nays: None Absent: None Ery Meyer then made a motion that special conditions existed because the College Heights Addition was originally platted in 1909 for single family development with a fifty (50) foot lot width and a one hundred forty (140) foot lot depth, with a twenty-five (25) foot front yard setback. The request will be keeping with a new program instituted by City Council to revitalize the original township area. Jill Davis seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Davis Nays: None Absent: None 3 BZA Minutes 7/7/97 Ery Meyer then made a motion to approve the following variances to Grapevine Comprehensive Zoning Ordinance 82-73: Approval of Section 15.F.2., Single Family District, to allow a variance of 500 feet to the required 7500 square foot minimum lot size requirement, allowing a minimum lot size of 7000 square feet. No action was taken on the request to Section 15.G.1. for a five (5) foot variance to the thirty (30) foot front yard setback. Based upon the plot plan submitted by the applicant, it was determined that the variance was not needed. Approval of Section 15.G.4., R-7.5, Single Family District, to allow a fifteen (15) foot variance to the sixty-five (65) foot minimum lot width requirement, allowing a fifty (50) foot minimum width of lot. Approval of Section 15.H., R-7.5, Single Family District, to allow a thirty-four (34) foot variance to the forty (40) foot buffer yard requirement for the east and west side property lines, allowing a six (6) foot buffer side yard setback. The Board determined that the request for a fifteen (15) foot variance to the required forty (40) foot buffer yard requirement for the rear property line was not required due to the presence of a dedicated alley at the rear of the property. Jill Davis seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Davis Nays: None Absent: None MINUTES Next, the Board of Zoning Adjustment considered the minutes of the June 2, 1997, meeting. Ery Meyer made a motion to approve the minutes of the June 2, 1997, minutes with corrections. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Abstain: Davis Absent: None 4 BZA Minutes 7/7/97 MISCELLANEOUS DISCUSSION Randy Howell asked Mr. Williams about Ms. Reynold's comment concerning her driveway and off-street parking being off of the alley. Mr. Williams noted that he had not approved Ms. Reynold's plans yet and explained that her off street parking could not be in the required front yard. He explained that if the alley was not paved, the driveway would be required to come from the rear of the lot, through the sideyard and tie into the street.
