KINDRICK, PLA ER4� SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA97-29 MEETING DATE: MONDAY, DECEMBER 1, 1997 RECOMMENDATION Staff recommends the Board of Zoning Adjustment a rove the request for a variance to the Grapevine Comprehensive Zoning Ordinance 82-73 for 418 East Northwest Highway, platted as Lot 1, Block 2, A. F. Leonard, City of Grapevine, Tarrant County, Texas, conditional to the City Council approval of Conditional Use Request CU97-55 as follows: Section 60.J.5. Sign Standards which requires a ten (10) foot setback for on -premise pole signs in the "HC" Highway Commercial District. The applicant is reauestina a six 16► foot variance to the ten (10► foot setback reauirement for an nn se pole sign If the Board of Zoning Adjustment approves the request it would allow the relocation of an existing twenty (20► foot pole sign four (4► feet from the property line SPECIAL CONDITION: Staff finds a special condition exists because the building was developed prior to the City of Grapevine Comprehensive Zoning Ordinance 82-73. The subject property was granted approval to exist as developed under BZA96-51. However, the pole sign, as it exists, is partially blocked by an existing building to the west. BACKGROUND INFORMATION: Pursuant to Conditional Use Permit CU97-04 (Ordinance 97-23) the applicant currently occupies an existing 8,400 square foot building as Grapevine Kawasaki -Polaris Dealership. There is also an existing variance on the subject property, BZA96-51, allowing a special exception to exist as developed. 0:\BZA\97-29.41 This case was tabled at the request of the applicant at the November 3,1997 Board meeting. Since that time, Council has approved Conditional Use Application CU97-55 allowing the relocation of the twenty (20) foot pole sign. There will be a second reading of this conditional use at the December 2, 1997 City Council Meeting for this conditional use. An application to the Board of Zoning Adjustment was submitted by Mr. Howard Lawson for property addressed as 300 State Highway 114 East and legally described as Tract 2A1 William Bradford Survey, Abstract 131, City of Grapevine, Tarrant County, Texas. Mr. Lawson has also submitted a plat application to the Public Works Department on the described property. KINDRICK, PLA ER I SUBJECT: BOARD OF ZONING ADJUSTMENT CASE #BZA97-30 MEETING DATE: MONDAY, DECEMBER 1, 1997 I7:[*17►TiliTir*tl7tr11[QL, Staff recommends the Board of Zoning Adjustment approve the request for a special exception to the Grapevine Comprehensive Zoning Ordinance 82-73 for 141 Central Avenue, platted as Lot 4, Block 1, Central Business Park, City of Grapevine, Tarrant County, Texas, as follows: Section 26.M.4, Highway Commercial District Regulations which require a buffer strip of at least twenty (20) feet in width when a "HC" Highway Commercial District is adjacent to any residentially zoned district. If the Board of Zoning Adjustment approves the special exception, it would allow the existing development to remain as developed and would waive the requirement for the required twenty (20) foot buffer strip. SPECIAL CONDITION: Staff finds a special condition exists for this property in that it was developed prior to the 1984 City-wide Rezoning. Full compliance with the buffer requirement would require the applicant to demolish an existing paved area (approximately 10 feet by 135 feet) that has previously been used for parking motor vehicles. BACKGROUND INFORMATION: A request was submitted to the Department of Development Services by Walter Nelson. Section 26 "HC" Highway Commercial District was recently amended to allow for outside storage along Central Avenue. Until this time, all outside storage on Central Avenue was nonconforming. The applicant has submitted a Conditional Use Application requesting outside storage in conjunction with a sprinkler supply company. If council approves the 1 Conditional Use and if the variance is approved, the property will come into compliance with the City of Grapevine Comprehensive Zoning Ordinance. NEW BUSINESS BZA97-28 GOODWIN & MARSHALL INC. The first item of new business for the Board of Zoning Adjustment to consider was BZA97- 28, submitted by Goodwin & Marshall, Inc., who requested a variance for 4055 Corporate Drive, platted as Lot 1, Block 2, DFW Trade Center, Grapevine, Texas. The following variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 32.K.1., "BP" Business Park District Regulations which requires no off-street parking area be located closer than twenty-five (25) feet to any residentially zoned property, nor ten (10) feet to any adjacent property line. 1 The applicant requested a fifteen (15) foot variance to the required twenty-five (25) foot setback for off-street parking adjacent to residentially zoned property. If approved, it would allow parking within ten (10) feet of the residentially zoned property, as shown on the site plan. JoAnn Stout explained the case and that a special condition existed to allow parking within ten (10) feet of the adjacent residentially zoned property since it lies within the Denton Creek flood plain and could not be developed as currently zoned. Ms. Stout also noted that the adjacent property is currently owned by the City of Grapevine and is intended to be rezoned to "GU" Governmental Use, to be utilized as a hike and bike trail and a city park. Ed Kellie of Goodwin and Marshall, 6001 Bridge Street, Fort Worth, Texas, took the Oath of Truth and said he would be available for any questions the Board may have. Ms. Stout clarified that the City of Grapevine initiated the zone change of the property from R-20, Single Family District Regulations to GU, Governmental Use District. Ms.Stout announced that the zone change would be heard at the next Planning and Zoning Commission meeting, December 2, 1997. After some discussion, Dennis Luers made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Davis Nays: None Absent: Anderson, Bruner Ery Meyer made a motion that a special condition existed to allow parking within ten (10) feet of the adjacent residentially zoned property since it lies within the Denton Creek flood plain and could not be developed as currently zoned. Leonard Survey, Grapevine, Texas. The following variance request, from the Grapevine Comprehensive Zoning Ordinance, was conditional to City Council approval of Conditional Use Request CU97-55: Section 60.J.5., Sign Standards which requires a ten (10) foot setback for on -premise pole signs in the "HC" Highway Commercial District. The proposed variance would allow a reduction of six feet to the ten foot setback requirement for an on -premise pole sign. JoAnn Stout explained the case to the Board and explained that Staff found a special condition existed because the building was developed prior to the City of Grapevine Comprehensive Zoning Ordinance 82-73. Ms. Stout explained that the subject property was granted approval to exist as developed under BZA96-51, however, the pole sign, as it exists, is partially blocked by an existing building to the west. Phil Morley, representing Grapevine Kawasaki, of 920 S. Main Street, Suite 190, Grapevine, Texas, took the Oath of Truth and explained that the existing pawn shop sign would block the sign once it had been lowered. Mr. Morley proposed to move the sign where it would be more visible, yet not block any traffic. There was some discussion that lack of visibility did not constitute a hardship. The Board also discussed possible complying locations to move the sign, but no satisfactory conclusion was reached. Ms. Davis and Mr. Cook suggested the applicant using a monument sign or use the planter boxes adjacent to the building for placement of the sign. Ms. Stout explained that Tommy Hardy, Director of Development Services, stated City Council would most likely not be willing to give up landscaping for a location of a sign. After further discussion, Phil Morley asked the Board if the case could be tabled until the next regular meeting. 3 Jill Davis made a motion that Case BZA97-29 be tabled to the next Board of Zoning Adjustment meeting at the request of the applicant. OLD BUSINESS BZA97-29, MORLEY ARCHITECTS FOR GRAPEVINE KAWASAKI The item of old business for the Board of Zoning Adjustment to consider was BZA97-29, submitted by Phil Morley representing Grapevine Kawasaki. This item was tabled at the November 3, 1997, meeting at the request of the applicant. The requested variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 60.J.5. Sign Standards, which requires a ten (10) foot setback for on -premise pole signs in the "HC" Highway Commercial District. The proposed variance would allow a reduction of six (6) feet to the ten (10) foot side setback requirements for an on -premise pole sign. Stephen Kindrick explained that since the November 3, 1997, meeting, the first reading of the Ordinance was approved by City Council for CU97-55 allowing the relocation of the twenty (20) foot pole sign, pending the outcome of this variance request. Phil Morley, applicant, representing Grapevine Kawasaki, took the Oath of Truth and explained that additional measurements were taken and other locations were considered for the placement of the sign. Mr. Morley explained that the only location the sign could be placed would be the far east side of the property. Mr. Morley noted that the Fire Marshall approved the proposed location of the sign. Mr. Morley then showed the Board slides of east and west views of the property from Northwest Highway. Ms. Davis asked the applicant to explain the nature of the hardship that was prompting this request. Mr. Morley explained that by keeping the sign in its existing location, and lowering it to twenty (20) feet in height, would cause the sign to be invisible from the west, as it would be blocked by another sign. Ms. Davis explained that she had a problem with visibility being a hardship and felt the sign could be relocated elsewhere on the property. Randy Howell, Chairman, asked Ms. Davis where the sign might be relocated. Ms. Davis suggested that the sign be located in the front planter, up against the building. The Board agreed that this would not be a logical location, due to visibility and landscaping concerns. Roy Stewart, City Council Representative, took the Oath of Truth and explained that when the City Council reviewed the conditional use request that was brought before them a month ago, they agreed the proposed location of the sign was the best place on the property. Mr. Stewart also explained that the City Council asked many of the same questions that Ms. Davis was concerned about. Mr. Morley noted that the existing twenty-four (24) foot fire lane located on the east side of the property was approved by City Council at the last City Council meeting. With no one else to speak either for or against the request, Dennis Luers made a motion to close the public hearing. Ery Meyer seconded the motion, which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Davis Nays: None Absent: Bruner 2 There was discussion among the members whether or not the applicant had a hardship. Mr. Cook explained that he saw no hardship, and felt the property owner could conform to the setback requirements. Mr. Luers noted that with a pre-existing building and pre-existing site, the property owner could not conform. Mr. Howell added that the pole sign could not be located deeper into the fire lane and that presented a hardship. Carl Hecht then made a motion that special conditions existed, being that in making the applicant comply with the ten (10) foot side setback would place the sign in the firelane and that the applicant was proposing a greater front setback than that required by the Ordinance, and the side setback would be greater than currently existed. Mr. Kindrick explained that Mr. Lawson was unable to make the necessary changes to the concept plan associated with the plat that was submitted to the Public Works Department in time to be included in the Board's packets for review in considering his variance request. The next item of business was for the Board of Zoning Adjustment to consider BZA97-30, submitted by Grapevine Truck Leasing, Inc., for property located at 141 Central Avenue, platted as Lot 4, Block 1, Central Business Park. The following special exception was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 26.M.4., Highway Commercial District Regulations which requires a buffer strip of at least twenty (20) feet in width when a "HC" Highway Commercial District is adjacent to any residentially zoned district. The proposed special exception would allow the existing development to remain as developed and would waive the requirement for the required twenty (20) foot buffer strip. Stephen Kindrick explained that Staff found a special condition existed for the property in that it was developed prior to the 1984 City-wide rezoning. Mr. Kindrick explained that full compliance with the buffer requirement would require the applicant to demolish an existing paved area (approximately 10 feet by 135 feet) that had previously been used for parking motor vehicles. Mr. Kindrick explained that the applicant submitted a Conditional Use Application requesting outside storage in conjunction with a sprinkler supply company. Walter Nelson, consulting Engineer representing Grapevine Truck Leasing, of 1002 West Wall Street, Grapevine, took the Oath of Truth and explained that the only way for the property to remain as developed without variances would be for another truck leasing company to occupy the property. Mr. Nelson showed the Board photos of the property. Marvin Balvin, applicant, of 316 East Dallas Road, Grapevine, Texas, took the Oath of Truth and explained that the building was in compliance when it was built in 1984. Mr. Balvin explained that Longhorn Plumbing had a contract on the property, which would 4 move them from their present location on Northwest Highway, into an area where a plumbing supply business would be more appropriate. Mr. Hecht questioned the use of outside storage. Mr. Nelson explained that a Conditional Use request was going before the Planning and Zoning Commission for outside storage and a six (6) foot high fence. Mr. Nelson explained that the outside storage mentioned would be screened by a seven (7) foot high wood fence on the west side and would not be visible to the adjacent property. Jill Davis stated that she felt there were no grounds for the variance, and the applicant had no hardship. After further discussion, Carl Hecht made a motion to close the public hearing. WRIGHT The next item for the Board of Zoning Adjustment to consider was BZA97-31, submitted by Joe L. Wright for 3345 Lexington Avenue and 3344 Wilshire Avenue, platted at Lots 1 and 22, Block B, Belfort Addition, Grapevine. The following variance requests are from Grapevine Comprehensive Zoning Ordinance 82-73: 9 Section 15.B., Single Family District Regulations which requires detached accessory buildings to be located 45 feet from the front property line. The special exception would allow subdivision entry features to be placed less than 45 feet from the front property line. Section 42.C.3., Supplementary District Regulations which prohibits detached accessory buildings within the required building setback on corner lots and requires detached accessory buildings to be located in the rear one-half of the lot. The special exception would allow subdivision entry features to be located within the 15 foot building setback along Heritage Avenue and be located within the front one-half of the lots as shown on the site plan. Section 42.D., Supplementary District Regulations which prohibits accessory structures within the 15 foot side building line on corner lots. The special exception would allow subdivision entry features to be placed within the 15 foot sideyards as shown on the site plan. Scott Williams explained that Staff found special conditions existed, specifically that although these entry features would be on private property, they would not actually serve as accessory buildings to the houses that would share the lots, and therefore would not provide benefit for any particular property owner. Martin Schelling of Wright Development Company, 601 W. Wall Street, Grapevine, took the Oath of Truth and explained that the structures would have a foundation, sides and a roof. Mr. Williams explained that subdivision entry fences are typically heard by the Building Board of Appeals but because of the nature of these features, they fall under the Zoning Ordinance as accessory structures and are required to be heard by the Board of Zoning Adjustment. After further discussion, Ery Meyer made a motion to close the public hearing.
