R OF DEVELOPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas met on Monday evening, March 2, 1998, at 6:00 P.M. in the Council Chambers, 2nd Floor, 200 South Main Street, Grapevine, Texas, with the following members present to wit: Randy Howell Chairman Carl Hecht Vice -Chairman Ery Meyer Secretary Russell Anderson 1 st Alternate Ron Cook 2nd Alternate Kip Bruner 3`d Alternate constituting a quorum with Members Dennis Luers and Jill Davis absent. Also present were City Councilman Roy Stewart and the following City Staff: H. T. (Tommy) Hardy Director of Development Services Scott Williams Building Official Ron Stombaugh Planner II Gerrie Anderson Secretary Chairman Randy Howell called the meeting to order at 6:00 P.M. OLD BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA97-25 HOWARD LAWSON The first item for the Board of Zoning Adjustment to consider was BZA97-25, submitted by Mr. Howard Lawson for property located at 300 State Highway 114 East, legally described as Tract 2A1, William Bradford Survey, Abstract 131. Mr. Stombaugh explained that the case was first tabled at the December 1, 1997, public hearing pending changes to the concept plan that the applicant failed to make prior to the meeting date. Mr. Stombaugh explained the case was also tabled, at the Board's request, at the January 5, 1998, public hearing due to inconsistencies between the variances as stated in the memo and the original variances requested in the application. Mr. Stombaugh noted that the inconsistencies had been eliminated. Mr. Stombaugh also explained that the case was tabled again at the February 2, 1998 meeting at the Board's request due to the applicant's absence from the meeting. BZA MINUTES MARCH 2, 1998 Mr. Stombaugh explained that at the February 2, 1998, meeting, the Board expressed concern about granting variances to the landscaping requirements for the site. Mr. Stombaugh explained that the Ordinance requires 15% minimum open space and the applicant exceeds the overall landscaping requirement for the site. The members asked the applicant if alternative plans were considered for the site. Mr. Howard Lawson, applicant, took the Oath of Truth and explained that the site plan submitted was not the only one that would work on the property. Mr. Lawson explained that for adequate square footage, parking, the irregular shape of the land, and considering that the landscaping exceeds the required 15%, this was the best design for the site. Mr. Hardy explained that staff gave the applicant direction on saving the street scape along State Highway 114 and the plan they submitted seemed to work best for the site. Mr. Hardy also explained that the development would be enhancing the City by eliminating two billboards along the highway. With no one else to speak either for or against the request, Ery Meyer made a motion to close the public hearing. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis After further discussion, Ery Meyer made a motion that special conditions exists being the irregular shape of the tract and the applicant has done as good a job as possible in keeping with the spirit of the ordinance. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis Ery Meyer then made a motion to grant the following variances to Grapevine Comprehensive Zoning Ordinance 82-73: Section 31.G.1., Light Industrial District Regulations allowing a 34 foot variance to the 100 foot lot width requirement allowing a lot width measured at the front building line of 66 feet. BZA MINUTES MARCH 2, 1998 Section 31.G.4., Light Industrial District Regulations allowing a 10 foot rear yard setback as shown on the concept plan. Section 31.G.5., Light Industrial District Regulations allowing a five (5) foot side yard setback to the south as shown on the concept plan. Section 53.H.2.a., Landscaping Regulations allowing the elimination of the 15 foot landscaping strip between off-street parking and a public right-of-way. Section 53.H.2.b., Landscaping Regulations allowing the elimination of the 10 foot landscaping strip between off-street parking and an adjacent property line. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis BOARD OF ZONING ADJUSTMENT CASE BZA98-02 DON AND JACKIE WHITTIER Next the Board of Zoning Adjustment considered the applicant's request to table their case BZA98-02 to the April 6, 1998 public hearing. Mr. Stombaugh explained that the applicant needed additional time to compile more information and to consider other options to present to the Board concerning parking as it relates to the proposed skating facility. Ery Meyer made a motion to table the public hearing, at the applicant's request, to the April 6, 1998, meeting. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis NEW BUSINESS The first item of new business was for the Board of Zoning Adjustment to consider BZA98- 04 submitted by Mr. N. C. (Clayton) Biggers for 416 Bluebonnet Drive, platted as Lot 4R, Block 3, Ridgecrest Addition. The following variance request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.3., Supplementary District Regulations which requires a detached accessory building to be separated at least 10 feet from the main structure. The proposed request would allow a reduction of four (4) feet to the separation requirement. If approved, it would allow a six (6) foot separation between the carport and the residence as shown on the plot plan. Mr. Williams explained that staff found a special condition existed, specifically there was inadequate rear yard to accommodate the desired size carport and maintain the ten (10) foot separation. Mr. Williams went on to explain that Section 14. DA. of the R-12.5, Single Family District Regulations allow developments platted prior to December 4, 1984, to comply with setbacks prescribed by the R-7.5, Single Family District Regulations. Mr. Williams explained that the subdivision was platted in 1961 and revised in 1981, therefore, the carport can be constructed as close as six (6) feet from the side property line, although a ten (10) foot building separation must be maintained unless a variance is granted. Randy Howell noted that two letters of approval had been received. Mr. Biggers was present to answer any questions from the Board. With no one to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Bruner Nays: None Abstain: Cook Absent: Luers, Davis BOARD OF ZONING ADJUSTMENT CASE BZA98-05 KEVIN CUMMINS The next item of business for the Board of Zoning Adjustment to consider was BZA98-05, submitted by Kevin Cummins for property located at 1702 Dunn Street, platted as Lot 11AR, Shorecrest Acres. The following requested variances are from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., Single Family District Regulations which requires a thirty (30) foot front yard setback. The proposed request would allow a reduction of nine (9) feet to the required thirty (30) foot front yard setback. If approved, it would allow a twenty-one (21) foot front yard setback for an addition to the existing residence. Section 15.G.2., Single Family District Regulations which requires a twenty-five (25) foot rear yard setback. The proposed request would allow a reduction of nine (9) feet to the required twenty-five (25) foot rear yard setback. If approved, it would allow a sixteen (16) foot rear yard setback for an addition to the existing residence as shown on the plot plan. Mr. Williams explained that staff found a special condition existed, specifically the lot is unusually shallow. Mr. Williams explained that a variance was granted in 1982 for a ten (10) foot reduction to the front building line, resulting in a twenty (20) foot front yard setback for the existing residence. BZA MINUTES MARCH 2, 1998 Mr. Howell noted that one letter of approval had been received and announced that Mr. Cummins was present to answer any questions. With no one to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Cook, Bruner Nays: None Abstain: Anderson Absent: Luers, Davis Carl Hecht then made a motion that a special condition existed being the lot is unusually shallow. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Cook, Bruner Nays: None Abstain: Anderson Absent: Luers, Davis Carl Hecht made a motion to approve the requested variances from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1., allowing a twenty-one (21) foot front yard setback for an addition to the existing residence as shown on the plot plan. Section 15.G.2., allowing a sixteen (16) foot rear yard setback for an addition to the existing residence as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Cook, Bruner Nays: None Abstain: Anderson Absent: Luers, Davis The last item of new business was for the Board of Zoning Adjustment to consider BZA98- 06, submitted by International Porcelain Artists and Teachers, Inc., for property located at BZA MINUTES MARCH 2, 1998 204 East Franklin Street, platted as Lots 1 A and 1 B, Block 31, and Lot 1, Block 16, City of Grapevine. The following requested variance was from Grapevine Comprehensive Zoning Ordinance 82-73: Section 54, Masonry Requirements which requires a minimum 70% of the exterior walls of principal structures in the "CBD" Central Business District be covered with masonry. The applicant requested a 100% reduction in the masonry requirement and if approved would allow the wood siding on the existing structure to remain. Mr. Williams explained that staff found a special condition existed, specifically the structure was existing and if properly restored could be of high historic integrity according to the housing inventory conducted by the City of Grapevine in 1995. Mr. Williams noted that a zoning change was approved by Planning and Zoning and City Council on February 17, 1998 for the back lot. Mr. Williams explained that the change was from R-7.5, Single Family District to CBD, Central Business District, so that both lots would be zoned CBD after the second reading of the ordinance on March 3, 1998. Carl Hecht asked if the usage of the property would be commercial. Barbara Nunn, representing the applicant, of 2936 Scenic Drive, Grapevine, took the Oath of Truth and explained the use would be the International Headquarters for the IPAT. Ms. Nunn noted that there would be two full time staff members and this location would house their displays. Ms. Nunn noted that visitors would be minimal. After further discussion, Ery Meyer made a motion to close the public hearing. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis Ery Meyer made a motion that a special condition existed being the existing structure, if properly restored could be of high historic integrity according to the housing inventory conducted by the City of Grapevine in 1995. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis BZA MINUTES MARCH 2, 1998 Ery Meyer then made a motion to approve the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 54, Masonry Requirements allowing a 100% reduction of the masonry requirements which would allow the wood siding on the existing structure to remain according to the concept plan. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Anderson, Cook Nays: None Absent: Luers, Davis MISCELLANEOUS REPORTS Mr. Williams updated the Board that the permit for the foundation package had been approved for Bass Pro Shops, but a contractor had not been chosen. Mr. Meyer asked about feasibility of combining the libraries of the City's of Grapevine, Southlake and Colleyville. Mr. Stewart, Council Representative, explained that a meeting had been scheduled for the City Managers of Grapevine, Southlake and Colleyville to discuss the issue.
