ACTS OF THE 1993 TEXAS LEGISLATURE, THE BOARD OF ZONING ADJUSTMENT MEETING AGENDA WAS PREPARED AND POSTED ON THIS THE 24TH DAY O 1998 1 STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, August 3, 1998, at 5:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Randy Howell Chairman Carl Hecht Vice -Chairman Ery Meyer Secretary Dennis Luers Member Russell Anderson Member Ron Cook 1 st Alternate Kip Bruner 2nd Alternate constituting a quorum. Also present were City Councilman, Roy Stewart, and the following City Staff: H. T. (Tommy) Hardy Director of Development Services Ron Stombaugh Planner II Gerrie Anderson Secretary CALL TO ORDER Chairman Randy Howell called the meeting to order at 5:03 P.M. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA98-18, MASTERPLAN 2351 POOL ROAD The first item of New Business for the Board of Zoning Adjustment to consider was BZA98-18, submitted by William E. Cothrum representing Masterplan for property located at 2351 Pool Road, platted as Lot 1R, Block 1, Doil Addition. The following request was to Grapevine Comprehensive Zoning Ordinance 82- 73: Section 26.1.1., Highway Commercial District Height Regulations which restricts the height of flagpoles to thirty-five (35) feet. If approved, it would allow a forty (40) foot variance resulting in a seventy-five (75) foot maximum height for telecommunications equipment to be collocated with a flagpole. Board of Zoning Adjustment 8/3/98 Mr. Stombaugh read to the Board, a letter from Bill Bauman, representing PrimeCo, requesting the case be tabled until further notice. Dennis Luers made a motion to table Board of Zoning Adjustment Case BZA98- 18, at the owner's request, to the September 14, 1998 meeting. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE 98-23, GOODWIN AND MARSHALL 625 WESTPORT PARKWAY The next item of business for the Board of Zoning Adjustment to consider was BZA98-23, submitted by Goodwin and Marshall for 625 Westport Parkway, platted as Lot 2, Block 1, Westport Business Park. The following variance requests were to Grapevine Comprehensive Zoning Ordinance 82-73: Section 31.H., Light Industrial District, Buffer Area Regulations requires a landscape buffer zone of not less than twenty-five (25) feet in depth from the lot line when a "Ll" Light Industrial District abuts a residentially zoned district. If approved it would allow a fifteen (15) foot variance to this requirement resulting in a landscape buffer of ten (10) feet along the west property line. Section 31.H., Light Industrial District, Buffer Area Regulations requires that no building or structure shall be located nearer to any residentially zoned district than a distance equal to one and one half (1 1/2) times the height of any building or structure. If approved it would allow a sixty (60) foot variance to this requirement to the west resulting in a building setback of fifteen (15) feet from the west property line. Section 31.1., Light Industrial District, Height, requires that no building or structure located contiguous to an existing single family district shall exceed one story or thirty-five (35) feet in height. If approved it would allow a fifteen (15) foot variance to this requirement resulting in a maximum building height of fifty (50) feet. Section 50.8.1 Screening requires that where the side, rear, or service side of a non-residential use is adjacent to a single family district, screening of not less than six (6) feet in height shall be erected separating the use from the adjacent I Board of Zoning Adjustment 8/3/98 residential district. The screening shall consist of a solid masonry, concrete or wood construction. If approved it would eliminate the requirement for screening from the adjacent single family district. Section 53.H.2.b Landscaping Regulations requires that whenever an off-street parking or vehicle use area abuts an adjacent property line a perimeter landscape buffer of at least ten (10) feet be maintained between the edge of the parking area and the adjacent property line. In addition, when the adjacent property is zoned or used for residential purposes the landscape buffer shall include a wall, hedge, or berm not greater than eight (8) feet in height or less than three (3) feet in height. If approved it would eliminate the requirement for a wall, hedge, or berm in the landscape buffer area between the edge of the parking areas at the west property line and the adjacent single family zoned property. Mr. Stombaugh explained that Staff found that special conditions existed being the property and the surrounding area is designated as an Industrial/Commercial land use according to the City of Grapevine's Master Plan. Mr. Stombaugh noted that the property in question and the surrounding property was never intended to be developed as single family residential. Mr. Stombaugh noted that the Board granted the same variances for a case that was heard several meetings ago. Ed Kellie, representing Goodwin and Marshall, took the Oath of Truth and explained that the zoning for the property had been approved at the last City Council meeting to LI, Light Industrial. The Board asked if the rest of the property could be rezoned from R-20, Single Family to LI, Light Industrial, eliminating variance requests. Mr. Hardy explained that the property, owned by Mary Stone Myers, was annexed into the City as R-20, Single Family District Regulations. Mr. Hardy commented that he felt that Ms. Myers would develop the land and it would then be rezoned. With no one else to speak either for or against the request, Carl Hecht made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None 3 Board of Zoning Adjustment 8/3/98 Carl Hecht made a motion that a special condition existed being the property and the surrounding area is designated as an Industrial/Commercial land use according to the City of Grapevine's Master Plan and that the property in question and the surrounding property was never intended to be developed as single family residential. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None Carl Hecht made a motion to approve the following variances, according to the Site Plan, to Grapevine Comprehensive Zoning Ordinance 82-73: Section 31.H., Light Industrial District, Buffer Area Regulations allowing a fifteen (15) foot variance, resulting in a landscape buffer of ten (10) feet along the west property line. Section 31.H., Light Industrial District, Buffer Area Regulations allowing a sixty (60) foot variance, resulting in a building setback of fifteen (15) feet from the west property line. Section 31.1., Light Industrial District, Height allowing a fifteen (15) foot variance, resulting in a maximum building height of fifty (50) feet. Section 50.B.1 Screening, eliminating the requirement for screening from the adjacent single family district. Section 53.H.2.b Landscaping Regulations eliminating the requirement for a wall, hedge, or berm in the landscape buffer area between the edge of the parking areas at the west property line and the adjacent single family zoned property. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None BOARD OF ZONING ADJUSTMENT CASE BZA98-2 LORETTA AND GREG DUNN, 317 E. WORTH STREET The next item of business for the Board of Zoning Adjustment to consider was BZA98-25, submitted by Loretta and Greg Dunn for property located at 317 E. Worth Street, platted as Lot 2, Block 34, Original Town of Grapevine. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: 0 Board of Zoning Adjustment 8/3/98 Section 15.G.1., Single Family District Regulations requires a thirty (30) foot front yard setback. The applicant requested a reduction of nine (9) feet to the front yard setback. If approved, it would allow a front yard setback of twenty-one (21) feet for the existing house. Mr. Stombaugh explained that Staff found a special condition existed being the structure exists. Ms. Loretta Dunn, applicant of 317 E. Worth Street, took the Oath of Truth and explained the house was built in 1925 and that in order to add on to the back of the house a variance was needed before a building permit could be issued. With no one else to speak either for or against the request, Dennis Luers made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None Dennis Luers made a motion that a special condition existed being the house was built in 1925 and did not have the same setback as is presently required and that it is an existing structure. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None Dennis Luers made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.1., allowing a front yard setback of twenty-one (21) feet for the existing house. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None The last item of business for the Board of Zoning Adjustment to consider was BZA98-28, submitted by Ben Royal for property located at 520 East Franklin Street, platted as Lot 5, and the west 12.5 feet of Lot 6, Block 114, College 5 Board of Zoning Adjustment 8/3/98 Heights Addition. The following variance requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.F.2., "R-7.5" Single Family District, Density Requirements, which requires a minimum lot size of 7,500 square feet. If approved, it would allow a variance of thirty-two (32) square feet, resulting in a lot size of 7,468 square feet. Section 15.G.1., "R-7.5" Single Family District, Area Regulations, which requires a minimum front yard depth of thirty (30) feet. If approved, it would allow a variance of five (5) feet, resulting in a front yard setback of twenty-five (25) feet. Section 15.G.4., "R-7.5" Single Family District, Area Regulations, which requires a minimum lot width of sixty-five (65) feet. If approved, it would allow a variance of three (3) feet, resulting in a lot width of sixty-two (62) feet. Mr. Stombaugh explained that Staff found special conditions existed as the size and width requests were due to the property having been platted long before the current zoning ordinance regulations were established. Mr. Stombaugh explained that the variance to the front yard setback results from the applicant's desire to match the front yard setback of the property immediately to the west. Mr. Ben Royal of 12619 Montford Drive, Dallas, and applicant, took the Oath of Truth and explained that he changed the plans from when he submitted his variance application but the change would comply with the variances submitted. Mr. Royal explained that fourteen (14) feet of the covered porch would now be part of the house. Mr. Royal explained also that he was working with the Historic Preservation Commission in keeping with the neighborhood. Mr. Royal noted that there were no setback requirements when the area was platted in 1909. With no one else to speak either for or against the request, Ery Meyer made a motion to close the public hearing. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None After some discussion, Ery Meyer made a motion that special conditions existed being the lot was platted long before the current zoning ordinance regulations were established and that the applicant desires to match the front yard setback to N Board of Zoning Adjustment 8/3/98 the property immediately to the west. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None Ery Meyer then made a motion to grant the following variances to Grapevine Comprehensive Zoning Ordinance 82-73, as shown on the revised drawings: Section 15.F.2., "R-7.5" Single Family District, Density Requirements, allowing a variance of thirty-two (32) square feet, resulting in a lot size of 7,468 square feet. Section 15.G.1., "R-7.5" Single Family District, Area Regulations, allowing a variance of five (5) feet, resulting in a front yard setback of twenty-five (25) feet. Section 15.G.4., "R-7.5" Single Family District, Area Regulations, allowing a variance of three (3) feet, resulting in a lot width of sixty-two (62) feet. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None MINUTES Next the Board of Zoning Adjustment considered the minutes of the July 6, 1998, meeting. Ery Meyer made a motion to approve the minutes as written for the July 6, 1998, meeting. Carl Hecht seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: None MISCELLANEOUS REPORTS/DISCUSSION Mr. Howell explained that he had mixed emotions about BZA98-28, which he feels the lots in the old section of town could be built on without variances. Mr. Hardy explained that when Staff makes recommendations, they look to see if the applicant is trying to build a huge house on a small lot or if a moderate size house was being planned to fit the zoning requirements. 7 Board of Zoning Adjustment 8/3/98 There was discussion about patios extending into the rear yard. Mr. Bruner asked about the case that was heard several meetings ago concerning the back porch being enclosed and encroaching in rear yard setback. Mr. Hardy said covered patios could extend as far as six (6) feet into the rear yard as long as it was not enclosed. Mr. Hardy explained that Staff took to the Planning & Zoning Commission and Council a proposal to allow covered patios in the back yard and P & Z and Council agreed. There was discussion concerning covered patios, that flatwork was different than a monolithic slab. Mr. Anderson asked about what Mr. Lowry, the City Attorney had said about not basing decisions on the public input. Mr. Hardy explained that the Board's decisions are like Staff's recommendations; the Board should use public input to help make the decision but if there was no question that a special condition does not exist and the whole neighborhood was for the request, it should not be granted.
