AT 5:00 'Fialin1�.�U► •' • •• STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, September 14, 1998, at 6:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Vice -Chairman Ery Meyer Secretary Dennis Luers Member Russell Anderson Member Ron Cook 1 st Alternate Kip Bruner 2nd Alternate constituting a quorum with Chairman, Randy Howell absent. Also present were City Councilman, Roy Stewart, and the following City Staff: Scott Williams Assistant Director of Development Services/Building Official Gerrie Anderson Secretary Vice Chairman, Carl Hecht, called the meeting to order at 6:03 P.M. OLD BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA98-18 MASTERPLAN 2351 POOL ROAD The first item of Business for the Board of Zoning Adjustment to consider was BZA98-18, submitted by William E. Cothrum representing Masterplan for property located at 2351 Pool Road, platted as Lot 1 R, Block 1, Doil Addition. Mr. Williams explained that Staff recommended the Board of Zoning Adjustment accept the applicants request to withdraw variance request BZA98-18. Mr. Williams explained that the applicant was requesting the withdrawal because the Special Use Permit was denied by City Council July 21, 1998. With no one else to speak concerning the case, Dennis Luers made a motion to accept the applicant's request to withdraw BZA98-18. Russell Anderson seconded the motion, which prevailed by the following vote: Board of Zoning Adjustment 9/14/98 Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Howell BOARD OF ZONING ADJUSTMENT CASE BZA98-31 JAMES E. LANGFORD 3000 W. D. TATE AVENUE The next item of business for the Board of Zoning Adjustment to consider was BZA98-31, submitted by James E. Langford, representing Memorial Baptist Church for property located at 3000 W. D. Tate Avenue, platted as Lot 1, Block 1, Memorial Baptist Addition. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 13.1., R-20, Single Family District Regulations, Height, limits the height of the principal structure to thirty-five (35) feet. The applicant requested to exceed the thirty-five (35) foot height requirement by thirty-five (35) feet. If approved, a seventy (70) foot tall religious sculpture (cross) would be allowed. Mr. Williams explained that Staff found special conditions existed, as the building has an exceptionally deep setback, and is partially obscured by the many trees that were saved during construction. Mr. Williams explained that the cross itself would be set back 113 feet from the property line, and the site lacks visibility due to berms and embankments adjacent to, and along the highway. James Langford of 3404 Harbor Avenue, Dallas, Texas, took the Oath of Truth and commented on the criteria that went into the design and the application for the religious sculpture, but wanted to reserve further comments and introduce Pastor Bruce Perkins of Memorial Baptist Church. Bruce Perkins of 316 Ridge Road, Grapevine, took the Oath of Truth and explained that the proposed 70 foot cross had been planned from the outset of the project. Pastor Perkins explained that he understood the concerns that some of the neighbors had from the development of the property from its natural state. Pastor Perkins explained that they tried to keep the neighbors informed of the plans during their construction process. Pastor Perkins noted that he wanted to present to the Board copies of correspondence that was sent to the neighbors and correspondence the church received from the neighbors. He explained that a letter, dated August 24, 1998, was sent notifying the neighborhood about the variance issue of the cross and to preview the plans. He noted that only one neighbor called. Pastor Perkins explained that the intention was to locate the cross near the highway, away from the neighborhood. Mr. Langford explained that the cross was much less than the height of the light standards on State Highway 121 and 360 and the exit ramp to State Highway 2 Board of Zoning Adjustment 9/14/98 360 creates a large berm, which shields the site. Mr. Langford stressed that it was important to keep the site in its natural state as much as possible and in doing so the buildings were kept away from neighborhoods and many trees were preserved, especially ones fronting the highway. He noted that the proposed 70 foot cross would be seen over the berm. Mr. Langford explained that they feel the proposed location of the cross would be the least intrusive means to mark the site, as the cross would be as far away from the existing homes as possible and closer to the road. Dante C. Veneziale of 2217 Los Robles took the Oath of Truth and explained that he was against the request. Mr. Veneziale explained that the original plans called for the building to be located south on the property. Mr. Veneziale explained that the lights from vehicles traveling along the road shine into his living room and the lights from the parking lot glare into his yard. Todd Wilson of 2309 Los Robles, Grapevine, took the Oath of Truth and explained that he was not in opposition of a cross but opposed to the 70 foot height request. Cynthia Thatcher of 2335 Los Robles, Grapevine, took the Oath of Truth and described the previously serene isolated neighborhood. Ms. Thatcher explained that she has lived on Los Robles for two years and knew the church was going to be constructed but did not realize the impact the construction had on the neighborhood. Ms. Thatcher explained that four commercial air conditioning units were located 20 feet from her back yard and that the glare of the parking lot lights invade her yard. Ms. Thatcher explained that she was not in support of the construction of the cross. Ery Meyer asked if the cross would be illuminated at night and for how long would it be illuminated. Pastor Perkins explained that the cross would be illuminated at night, and the light fixtures would be located 3 Y2 feet from the base, shining straight up the cross. Pastor Perkins said the lights would be on a timer. Mr. Langford noted that the parking lot lights cut off at 11:00 P.M. Ron Cook asked if an auditorium was going to built in the future. Pastor Perkins explained that an auditorium would be built in the future and would be located at a right angle off of the education building toward the west. Mr. Langford spoke and explained the proposed auditorium would be a 2 -story building. Mr. Langford explained that the Board of Zoning Adjustment had already passed the variance for the auditorium, which was a 55 foot height limit. 3 Board of Zoning Adjustment 9/14/98 Mr. Cook asked why the cross could not be constructed at the top of the 55 foot proposed auditorium to meet the 70 foot height. Mr. Langford explained that the cross would be much closer to the neighborhood than locating it next to the highway where it would give the best visual impact. Mr. Langford explained that with the 35 foot height requirement, the cross could not be seen because of a large berm. After further discussion from Pastor Perkins concerning the problem of the church not being visible from the highway and the need for the 70 foot height of the cross, and from neighbors opposing the variance, Ron Cook made a motion to close the public hearing. Ery Meyer seconded the motion, which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Howell Abstain: Bruner Dennis Luers explained that he felt a special condition existed, and was in favor of the request. Ery Meyer made a motion that a special condition does not exist. Ron Cook seconded the motion, which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook Nays: Luers Absent: Howell Abstain: Bruner BOARD OF ZONING ADJUSTMENT CASE BZA98-32 ROY STEWART HOMES INC. 1014 W. COLLEGE STREET The last item of business for the Board of Zoning Adjustment to consider was BZA98-32, submitted by Roy Stewart for property located at 1014 W. College Street, platted as Lot 12, Block 3, Dellwood Estates. The following variance requests were from Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.2., Single Family District Regulations which requires a twenty-five (25) foot rear yard setback. The applicant requested a seventeen (17) foot variance to the rear yard setback. If approved, it would allow an eight (8) foot rear yard setback for the existing residence. Ell Board of Zoning Adjustment 9114198 Section 42.C.3., Supplementary District Regulations which requires detached accessory buildings to be separated from the main residence by ten (10) feet. The applicant requested a seven (7) foot variance. If approved, it would allow a three (3) foot separation between the accessory building and main residence. Section 42.C.3., Supplementary District Regulations which requires a six (6) foot rear yard setback for accessory buildings. The applicant requested a variance of three (3) feet. If approved, it would allow a three (3) foot rear yard setback for the existing storage building. Mr. Williams explained that Staff found a special condition existed for Section 15.G.2, as the house exists, and that no special conditions existed for the two requests to Section 42.C.3., as the accessory building could be relocated so that it would comply with the ordinance. Roy Stewart of 309 Drexel Drive, Grapevine, took the Oath of Truth and explained that the owner, who was also present, was wanting to add a room to the east side of his house. Mr. Stewart noted that the storage building, which was constructed too close to the property line would be moved to the east side of the property line to conform to the ordinance requirements. With no one else to speak either for or against the request, Dennis Luers made a motion to close the public hearing. Ery Meyer seconded the motion, which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Howell Dennis Luers made a motion that a special condition exists for Section 15.G.2., as the house exists, and no special conditions exists for the two requests to Section 42.C.3., as the accessory building could be relocated so that it would comply with the ordinance. Ery Meyer seconded the motion, which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Howell Dennis Luers made a motion to grant the variance to Grapevine Comprehensive Zoning Ordinance 82-73, Section 15.G.2., Single Family District Regulations allowing an eight (8) foot rear yard setback for the existing residence. Ery Meyer made a motion to approve the minutes, with corrections, for the July 6, 1998, meeting. Russell Anderson seconded the motion, which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Howell MISCELLANEOUS REPORTS/DISCUSSION Mr. Williams announced that Eckerds broke ground at the southeast corner of State Highway 121 and Hall Johnson Road and Spring Creek B -B -Q will build next to the Olive Garden on State Highway 114. ADJOURNMENT Ery Meyer made a motion to adjourn. Russell Anderson seconded the motion, which prevailed by the following vote: The meeting was adjourned at 7:05.
