Also present were City Council Representative Roy Stewart and the following City Staff: Ron Stombaugh Planner II Gerrie Anderson Secretary Chairman Randy Howell called the meeting to order at 6:01 P.M. NEW BUSINESS 64 11 • • • • • • • • 111 • • -17_3 WIN 4 In • Chairman Randy Howell abstained from the case and Carl Hecht, Vice - Chairman, presided. The first item of new business was for the Board of Zoning Adjustment to consider BZA99-04, submitted by Joe Lipscomb, representing Sue H. Lipscomb, Craig E. Lipscomb and Allan Hurst for property located at 200 South Dooley Street. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.4., Area Regulations, which requires a sixty-five (65) foot lot width, except reverse frontage lots shall be a minimum of ninety-five (95) feet in width. Board of Zoning Adjustment 5/3/99 The applicant requested a 22.5 foot variance to the ninety-five (95) foot reverse frontage requirement. If the Board of Zoning Adjustment approves the request, it would allow a lot width of 72.5 feet. Mr. Stombaugh explained that there was a special condition since the subdivision was originally platted in July 1948 prior to the existence of any zoning regulations within the City of Grapevine. He explained that approximately 7.5 feet of Lot 6R along Wall Street would be dedicated as right-of-way. Mr. Stombaugh explained that property was shifted from Lots 7R and 8R in an attempt to minimize the size of the variance needed for Lot 6R. He explained that a house, donated to the Grapevine Township Revitalization Project, Inc., was planned to be moved to Lot 8R. Joe Lipscomb of 2814 O'Dell Court and applicant, representing his mother, Sue H. Lipscomb, took the Oath of Truth. Mr. Lipscomb explained that the property was platted in 1948 by his grandmother and the variance was being requested in order to eliminate as many nonconformities as possible. With no one else to speak either for or against the request, Dennis Luers made a motion to close the public hearing. Ron Cook seconded the motion which prevailed by the following vote: Ayes- Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Kelso Abstain: Howell Russell Anderson made a motion that there was a special condition since the subdivision was originally platted in July 1948 prior to the existence of any zoning regulations within the City of Grapevine. Ery Meyer seconded the motion which prevailed by the following vote. - Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Kelso Abstain: Howell 0 Board of Zoning Adjustment 5/3/99 BOARD OF ZONING ADJUSTMENT CASE BZA99-10 - 404 AND 408 EAST TEXAS STREET DONALD G. COHOON Chairman Randy Howell abstained from the case and Carl Hecht, Vice - Chairman, presided. The next item of business was for the Board of Zoning Adjustment to consider BZA99-10, submitted by Donald G. Cohoon for property located at 404 and 408 East Texas Street, legally described as the West 62.5 feet of Lot 4, Block 37, and East 62.5 feet of Lot 4, Block 37, City of Grapevine. The following requests were to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.7., Area Regulations which states that only one single-family detached dwelling shall be permitted on each lot or lot of record, as the case may be. The applicant requested a variance to the requirement that only one single family detached dwelling be permitted on each lot of record. If approved, it would allow two existing single family detached dwellings on one platted lot. Mr. Stombaugh explained that there were special conditions, specifically the lot was platted, and both structures were constructed prior to the establishment of any zoning regulations within the City of Grapevine. Don Cohoon, of 408 E. Texas Street, and applicant, took the Oath of Truth and explained that when he had the lot surveyed when he purchased it in 1983, he was never told of the problem of it being one lot. He explained that he would like to build a garage behind 404 and would also like to renovate the house to conform with the historical area. Mr. Stombaugh explained that the City had no record it was replatted. He explained that there was only a record of the original plat. Mr. Hecht explained that one letter of approval and one letter of denial had been received. With no one else to speak either for or against the request, Russell Anderson made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Kelso Abstain: Howell 9 Board of Zoning Adjustment 5/3/99 Dennis Luers made a motion that there were special conditions, specifically the lot was platted in 1913, and both structures were constructed prior to the establishment of any zoning regulations within the City of Grapevine. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays: None Absent: Kelso Abstain: Howell Dennis Luers then made a motion to grant the variance to Section 15.G.7,, Area Regulations allowing two existing single family detached dwellings on one platted lot and they would be replatted to separate parcels when sold. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Luers, Anderson, Cook Nays.- None Absent: Kelso Abstain: Howell BOARD OF ZONING ADJUSTMENT CASE BZA99-11 — 622 BERKLEY DRIVE, RONALD A. AND BETTY GURCZEWSKI The next item of business was for the Board of Zoning Adjustment to consider BZA99-11 submitted by Ronald A. and Betty Gurczewski for property located at 622 Berkley Drive. The following request was to Grapevine Comprehensive Zoning Ordinance 82-71 Section 15.H., Buffer Area Regulations which requires that whenever an "R-7.5" Single Family District development is located adjacent to an existing non- residential district, all principal buildings or structures shall be set back a minimum of 40 feet from the adjacent property line. The applicant requested a variance of thirteen (13) feet to the buffer yard requirement. If approved, it would allow a buffer yard of twenty-seven (27) feet between the existing residential structure on Lot 6 and the property line to the west. Mr. Stombaugh explained that there was a special condition for the requested variance, specifically, the single family residence was an existing structure. He explained that the College Creek subdivision was platted in 1984 and the "R-7.5" Single Family Residential District regulations at that time required the same 40 foot buffer between principal structures and an adjacent non-residential district. He noted that the buffer area was not shown on the plat for the College Creek Subdivision. 0 Board of Zoning Adjustment 5/3/99 Ronald Gurczewski, applicant of 622 Berkley Drive, Grapevine, took the Oath of Truth and explained that he intended to add on to his residence, but needed the variance in order to proceed. With no one else to speak either for or against the request, Dennis Luers made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Kelso Randy Howell noted that one letter of approval had been received. Carl Hecht made a motion that there were special conditions, specifically, the single family residence exists, the College Creek Subdivision was platted in 1984 and the R-7.5, Single Family Residential District regulations at that time required the same 40 foot buffer between principal structures and an adjacent non- residential district, but the 40 foot buffer was not shown on the plat at the time of platting for College Creek. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Kelso Carl Hecht made a motion to grant the variance to Section 15.H., Buffer Area Regulations, allowing a buffer yard of 27 feet between the existing residential structure on Lot 6 and the property line to the west as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Kelso DRIVE,1097"JaXI VIII ''D L. PEMBERTON The next item of new business was for the Board of Zoning Adjustment to consider BZA99-12, submitted by Richard L. Pemberton for 1815 Chris Craft Drive, platted as Lot 20, Shorecrest Acres. The following variance was to Grapevine Comprehensive Zoning Ordinance 82-73: 5 Board of Zoning Adjustment 5/3/99 Section 15.G.2., Area Regulations, which requires a 25 foot rear yard lot depth. Balconies, bay windows, and chimneys are allowed to project into the rear yard no more than two (2) feet. The request was for a variance of four (4) feet. If approved, it would allow a rear yard setback of nineteen (19) feet measured from the bay window to the rear property line as shown on the plot plan. Mr. Stombaugh explained that there was a special condition for the requested variance specifically, the lot was particularly shallow. Richard Pemberton of 1829 Chris Craft Drive, Grapevine, and applicant, took the Oath of Truth and explained that the old lake house had been removed from the lot and he was proposing to build a new residence for the property owner, Mr. Jimmy Janavaris. There was concern from the members whether the requested variance should have been measured from the bay window or from the principal structure. Mr. Stombaugh explained that the window required the greatest variance, and that is why the variance was worded the way it was. However, Mr. Stombaugh recommended that in the motion, the house should be tied to the plot plan drawings. With no one else to speak either for or against the request, Russell Anderson made a motion to close the public hearing. Dennis Luers seconded the motion which prevailed by the following vote: Ayes- Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent- Kelso Dennis Luers made a motion that there was a special condition, specifically that the lot was particularly shallow. Carl Hecht seconded the motion which prevailed by the following vote-, Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays- None Absent-. Kelso Dennis Luers made a motion to grant the variance to Section 15.G.2., Area Regulations allowing a rear yard setback of 19 feet measured from the bay window to the rear property line and 21 feet measured from the principal structure to the rear property line as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: 0 Board of Zoning Adjustment 5/3/99 Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent: Kelso BOARD OF ZONING ADJUSTMENT CASE BZA99-13 — 111 SILVER OAK DRIVE AND 201 SILVER OAK DRIVE, MARTIN W. SCHELLING The last item of new business was for the Board of Zoning Adjustment to consider BZA99-13, submitted by Martin W. Schelling for property located at 111 and 201 Silver Oak Drive, platted as Lot 58, Block 1, and Lot 1, Block 1, Silver Lake Addition. The following requests were to Grapevine Comprehensive Zoning Ordinance 82-73: Section 16.B., "R-5.0" Zero Lot Line District, Accessory Uses, which prohibits accessory structures from being nearer than six (6) feet to the rear property line. If approved, it would allow an accessory structure (subdivision entry feature) nearer than six (6) feet to the rear property line and within the required rear yard as shown on the plot plan. Section 42,C.3., Supplementary District Regulations, Accessory Buildings, which prohibits accessory buildings nearer than six (6) feet to any rear lot line and in the case of corner lots, prohibits accessory buildings within the side yard on the street side of the lot. If approved, it would allow an accessory structure (subdivision entry feature) nearer than six (6) feet to the rear lot line and allow an accessory structure in the side yard on the street side of the lot as shown on the plot plan. Mr. Stombaugh explained that there was a special condition, specifically, that the subdivision entry features while located on private property, do not actually serve as "accessory structures" for the individual owners of the respective lots. He explained that literal compliance with the ordinance would place an undue hardship on the property owners reducing their buildable area. Martin Schelling of 601 W. Wall Street and applicant took the Oath of Truth and explained that the structures would be brick planters with a wall and roof and would be maintained by the homeowner's association. Mr. Stombaugh in response to a question from the Board, stated that the homeowner's on Lots 1 and 58 would be able to have accessory buildings on their lots in addition to the entry features. With no one else to speak either for or against the request, Russell Anderson made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote - 7 Board of Zoning Adjustment 5/3/99 Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays- None Absent: Kelso Russell Anderson made a motion that there were special conditions, specifically, that the subdivision entry features while located on private property, do not actually serve as "accessory structures" for the individual owners of the respective lots, and that literal compliance with the ordinance would place an undue hardship on the property owners reducing their buildable area. Dennis Luers seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent- Kelso Russell Anderson then made a motion to grant the variances to Section 16.B, R- 5.0, Zero Lot Line District, Accessory Uses, allowing an accessory structure (subdivision entry feature) nearer than six (6) feet to the rear property line and within the required rear yard as shown on the plot plan; and to Section 42.C.3., Supplementary District Regulations, Accessory Buildings, allowing an accessory structure (subdivision entry feature) nearer than six (6) feet to the rear lot line and allow an accessory structure in the side yard on the street side of the lot as shown on the plot plan. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Howell, Hecht, Meyer, Luers, Anderson Nays: None Absent- Kelso MINUTES Next the Board of Zoning Adjustment considered the minutes of the March 29, 1999, meeting. Ery Meyer made a motion to approve the minutes of the March 29, 1999, meeting.
