OF • OFFICIAL STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, October 4, 1999, at 6:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present - Carl Hecht Chairman Ery Meyer Vice -Chairman Russell Anderson Member Ron Cook Member Kip Bruner 1 st Alternate constituting a quorum with Secretary, Dennis Luers and 2nd Alternate, Jim Kelso absent. Also present was the following City Staff: Ron Stombaugh Planner II Gerrie Anderson Secretary CALL TO ORDER Chairman Carl Hecht called the meeting to order at 6:00 P.M. NEW BUSINESS DEBORAH N CHARLES The first item of business was for the Board of Zoning Adjustment to consider BZA99-19 submitted by Deborah and Charles Weems for property located at 607 Redbud Lane, platted as Lot 13, Shorecrest Acres. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.5. Area Regulations which requires a minimum lot depth of 100 -feet in the "R-7.5" Single Family District. The applicant requested a variance of 20 -feet, and if approved, it would allow a lot depth of 80 -feet as shown on the plot plan. Mr. Stombaugh explained that Staff found that there was a special condition, specifically Shorecrest Acres was platted in October 1951, prior to the existence of any zoning regulations within the City. Grapevine adopted its first zoning Board of Zoning Adjustment 10/4/99 ordinance in 1955, the lot was in compliance with all of the other regulations of the "R-7.5" Single Family District, and the lot's orientation to the street necessitates the variance to the lot depth requirement. Mr. Charles Weems, applicant, of 607 Redbud Lane, Grapevine, took the Oath of Truth and explained that the pool would be built in the side yard and not the rear. With no one else to speak regarding the case, Russell Anderson made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso Russell Anderson made a motion that there were special conditions, specifically Shorecrest Acres was platted in October 1951, prior to the existence of any zoning regulations within the City; Grapevine adopted its first zoning ordinance in 1955; the lot was in compliance with all of the other regulations of the "R-7.5" Single Family District; and the lot's orientation to the street necessitates the variance to the lot depth requirement. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso BOARD OF ZONING ADJUSTMENT CASE BZA 99-21,1425 BELLAIRE DRIVE JAMES COVEY The next item was for the Board of Zoning Adjustment to consider BZA99-12, submitted by James Covey for property located at 1425 Bellaire Drive, platted as Lot 6, Block 11, Bellaire Addition. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 15.G.1. Area Regulations which requires a minimum front yard setback of 30 -feet in the "R-7.5" Single Family District. 2 Board of Zoning Adjustment 10/4/99 The applicant requested a variance of 5 -feet to this requirement. If approved, it would allow a front yard setback of 25 -feet as shown on the plot plan. Mr. Stombaugh explained that Staff found special conditions, specifically the Bellaire Addition was platted in February 1953, prior to the existence of any zoning regulations within the City, Grapevine adopted its first zoning ordinance in 1955, the lot complied with all of the other regulations of the "R-7.5" Single Family District, and all of the platted lots within the Bellaire Addition have 25 -foot front yard setbacks. He explained that the applicant proposed to construct a small addition to the existing residence. Mr. James Covey, the applicant, was present to answer any questions. With no one else to speak either for or against the request, Kip Bruner made a motion to close the public hearing. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso After further discussion, Russell Anderson made a motion that there were special conditions, specifically the Bellaire Addition was platted in February 1953, prior to the existence of any zoning regulations within the City, Grapevine adopted its first zoning ordinance in 1955, the lot complied with all of the other regulations of the "R-7.5" Single Family District, and all of the platted lots within the Bellaire Addition have 25 -foot front yard setbacks. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso W Board of Zoning Adjustment 10/4/99 BOARD OF ZONING ADJUSTMENT CASE BZA 99-22 2706 WOODED TRAIL COURT RICHARD OGLE Next the Board of Zoning Adjustment considered BZA99-22 submitted by Richard Ogle for property located at 2706 Wooded Trail Court, platted as Lot 8, Block 1, Western Oaks Addition. The following requests are to Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.4. Supplementary District Regulations which requires that below ground swimming pools be located no nearer than 6 -feet to any rear lot line. The applicant requested a variance of 2 -feet to this requirement. If approved, it would allow a swimming pool within 4 -feet of the rear lot line as shown on the plot plan. Section 42.D. Supplementary District Regulations which requires a minimum side yard setback on corner lots of 15 -feet on the street side of the lot. The applicant requested a variance of 2 -feet to this requirement. If approved, it would allow a side yard setback of 13 -feet on the street side of the lot as shown on the plot plan. Mr. Stombaugh explained that Staff found that there was special conditions, specifically the single family residence and pool are existing structures. He further explained that construction began on the residence in April 1987, and surveying techniques in 1987 as they relate to single family plot plans were not as accurate as today's standards, thus resulting in the discrepancies shown on the new plot plan dated September 1, 1999. Richard Ogle, applicant, of 2737 Kimberly Drive, Grapevine, took the Oath of Truth and explained that the property had been sold and that the pool was constructed a few months after the house had been built. After further discussion, Russell Anderson made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso In response to Mr. Bruner's question concerning the pool plumbing equipment appearing to encroach into the utility easement, Mr. Stombaugh explained that pool plumbing equipment does not meet the definition of a structure and would be allowed in the utility easement. 12 Board of Zoning Adjustment 10/4/99 Ron Cook then made a motion that there were special conditions, specifically the single family residence and pool exist, construction began on the residence in April 1987, and surveying techniques in 1987 as they related to single family plot plans were not as accurate as today's standards, thus resulting in the discrepancies shown on the new plot plan dated September 1, 1999. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso Ery Meyer made a motion to approve the variances to Section 42.C.4., allowing a swimming pool within 4 -feet of the rear lot line as shown on the plot plan, and to Section 42.D., allowing a side yard setback of 13 -feet on the street side of the lot as shown on the plot plan. Russell Anderson seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso C• • ••• ! •' �• OA • DA TILLERY Next, the Board of Zoning Adjustment considered BZA99-23, submitted by Oneda Tillery for property located at 301 N. Dove Road, legally described as Tract 4J, Abstract 1050 of the Thomas Mahan Survey. The following variance was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 43.E.3 Nonconforming Uses and Structures which allows the Board of Zoning Adjustment to approve the remodeling and/or expansion of an existing nonconforming use. The applicant requested a special exception to allow the expansion and remodeling of an existing single family residence and the addition of a detached garage. If approved, it would allow the site to remain as developed and allow the expansion and remodeling of a single family residence and allow the addition of a detached garage. Mr. Stombaugh explained that Staff found that there were special conditions, specifically the single family residences are existing and, prior to the City Rezoning of 1984, were in compliance. Mr. Stombaugh further explained that prior to 1984 the site was zoned "R-1" Single Family District, and during the 1984 City Rezoning, the site was rezoned to "PO" Professional Office District, thus creating the nonconformity. Mr. Stombaugh explained that two single family residences exist on the site, and the applicant proposes a small addition to one Board of Zoning Adjustment 10/4/99 of the single family residences along with the construction of a 1500 square foot detached garage located approximately 50 feet from the main residence. Sandra Bass, representing Ms. Oneda Tillery, of 301 N. Dove Road, Grapevine, took the Oath of Truth and explained that when their builder submitted plans to the Building Inspection Department for an addition, he was advised of the variance. With no one else to speak either for or against the request, Kip Bruner made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner Nays: None Abstain: Anderson Absent: Luers, Kelso There was discussion regarding why the detached garage could not be built closer to the residence. Ms. Bass explained that she was advised to show the detached garage on the drawing of the property so she would not have to come back to the Board when they were ready to build it at a later time. She said that if the garage presented a problem, they would not build the garage. There was discussion regarding the expansion and alteration of a non- conforming use. Ery Meyer made a motion that there was a special condition, specifically the single family residences are existing and, prior to the City Rezoning of 1984, were in compliance, and prior to 1984 the site was zoned "R-1" Single Family District, and during the 1984 City Rezoning, the site was rezoned to "PO" Professional Office District, thus creating the nonconformity. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner Nays: None Abstain: Anderson Absent: Luers, Kelso Ery Meyer then made a motion to approve the request for the special exception to Section 43.E.3., to allow the site to remain as developed and allow the expansion and remodeling of a single family residence and allow the addition of a detached garage. Kip Bruner seconded the motion which prevailed by the following vote: A Board of Zoning Adjustment 1014/99 Ayes: Hecht, Meyer, Cook, Bruner Nays: None Abstain: Anderson Absent: Luers, Kelso MINUTES Next, Chairman Hecht made a motion to table the minutes of the September 13, 1999, meeting until the November 1, 1999, meeting. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Anderson, Cook, Bruner Nays: None Absent: Luers, Kelso ADJOURNMENT With no further discussion, Ron Cook made a motion to adjourn.
