COT WILLIAMS 130,11-1)1 G OFFICIAL/ASSISTANT DIRECTOR DEVECOPMENT SERVICES STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular session, Monday evening, January 3, 2000, at 6:00 P.M., in the Council Chambers, 200 South Main Street, Grapevine, Texas with the following members present: Carl Hecht Chairman Ery Meyer Vice -Chairman Ron Cook Member Kip Bruner 1 st Alternate Jim Kelso 2nd Alternate constituting a quorum with Members Dennis Luers and Russell Anderson absent. Also present were City Council Representative Roy Stewart and the following City Staff: Ron Stombaugh Planner II Gerrie Anderson Secretary CALL TO ORDER Chairman Carl Hecht called the meeting to order at 6:00 P.M. OLD BUSINESS Chairman Carl Hecht moved Case BZA99-25 to the end of the meeting due to the applicant not being present. NEW BUSINESS BOARD OF ZONING ADJUSTMENT CASE BZA 99-27 3211 WINTERGREEN TERRACE, DENNIS R. HRANITZKY The next item was for the Board of Zoning Adjustment to consider BZA99-27, submitted by Dennis R. Hranitzky for property located at 3211 Wintergreen Terrace, platted as Lot 1, Skyline Oaks Subdivision. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 42.C.3., requires detached accessory buildings to be located on the rear one-half of the lot. Board of Zoning Adjustment 01103/2000 The applicant requested a special exception to allow a detached accessory building to be located in the front one-half of the lot. Mr. Stombaugh explained that staff found special conditions due to the lot being unusually large and deep, and furthermore, the proposed structure would be located in the rear one-half of the lot if the lot was the minimum lot depth of 100 feet. Dr. Dennis Hranitzky, applicant, of 3211 Wintergreen Terrace, took the Oath of Truth and explained that he wished to construct a new detached garage for more storage space. He explained that it would be impossible to locate the storage building anywhere else on the property because it would be inaccessible. Chairman Hecht noted that one letter of approval and one letter of denial had been received. With no one else to speak either for or against the request, Kip Bruner made a motion to close the public hearing. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson Ery Meyer made a motion that there were special conditions due to the lot being unusually large and deep, and furthermore, the proposed structure would be located in the rear one-half of the lot if the lot was the minimum lot depth of 100 feet. "T 0 A 0 0 Board of Zoning Adjustment 01/03/2000 Schelling for property located at 1600 W. Northwest Highway, legally described as Tracts 41 and 4C, Abstract 1050, Thomas Mahan Survey. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 27.1.1., PO, Professional Office District Height Regulations which provides that buildings located contiguous to an R-20, R-12.5, or R-7.5 district shall not exceed one story or 20 -feet in height. Mr. Stombaugh explained that the applicant requested a variance to construct 2 - story office buildings not to exceed 30 feet in height, south of the creek as shown on the concept plan. He explained that Staff found special conditions, specifically the "PO" Professional Office District section of the lot was bisected by a creek and drainage easement which inhibited the property owner from developing the site into multiple lots which would allow development of 2 -story office buildings. He explained that the portion of the lot south of the creek at its narrowest was over 200 -feet south of the adjacent single family district. He also explained that with a minimum lot depth of 100 -feet for lots in the "PO" Professional Office District, the area in question had over twice the separation than what was required between 2 -story office buildings and contiguous single family residences. Martin Schelling, applicant, of 601 W. Wall Street, Grapevine, took the Oath of Truth. He explained that the request was to allow the construction of 2 -story office buildings only on the portion south of the creek. He explained that they could go ahead and build 2 -story offices on the south side of the creek if they wished to plat the 20 -acres into multiple lots. He explained though that if the property were platted into multiple lots, they would not have the flexibility in the placement of the buildings, roads and parking lots as if there was just one lot. Mr. Schelling explained that according to the Zoning Ordinance, 13 lots could be platted separately next to the single family lots. He noted that in their proposal the closest building to single family would be 200 feet. He noted that he would only be building one-story office buildings on the north side of the creek, adjacent to the single family. Mr. Schelling added that by allowing the separation between the north side and the south side of the creek, a better product would be provided, more trees would be saved, and more of the natural beauty of the property would be saved. Sabrina Spies of 565 Dove Creek Circle, Grapevine and her Father, Don Spies of 4424 San Carlos, Dallas, took the Oath of Truth. Mr. Spies who spoke in behalf of Sabrina and her husband Richard who was not present, explained they were opposed to the request. Mr. Spies explained that they felt the proposed changes would have negative impact on the values and the privacy of the neighborhood. He stated that he felt a variance should not be granted until more information, showing elevations, lighting, etc., was presented. KI Board of Zoning Adjustment 01/03/2000 Sharon Grippe of 553 Dove Creek Circle, Grapevine, took the Oath of Truth and explained that she was opposed to the request. She expressed concern about a parking lot being right behind her house and about the lighting coming from the development. Ronnie Dean Painter of 585 Dove Creek Circle, Grapevine, took the Oath of Truth. He noted that he felt the impact on the trees and the creek, from the construction, would be devastating and that the development would have a negative impact on the addition as well as the City of Grapevine. Frank and Janet Colby of 538 Dove Creek Circle, Grapevine, took the Oath of Truth. Mr. Colby explained that they were concerned about drainage and flooding from the creek, and about trees being removed. He also noted that he felt the development would have a negative impact on the neighborhood as well as on the City of Grapevine. Rebecca Crews of 557 Dove Creek Circle, Grapevine, took the Oath of Truth. She was disappointed that the landscape behind her house would be destroyed if the request for 2 -story buildings were approved. Don Harkrider, 561 Dove Creek Circle, Grapevine, took the Oath of Truth and asked Mr. Schelling about the parking on the north side of the property out- numbering the parking on the south side of the creek. Mr. Schelling explained that a concept plan would not have the parking laid out like it would be on a site plan. He explained that parking spaces would accommodate the square footage of the offices and it was not their intent to overpark the area.. Steve Mondloch of 580 Dove Creek Circle, Grapevine, took the Oath of Truth. He said that he felt he needed to know exactly how the development would be laid out. Kathy Tisdale of 589 Dove Creek Circle, Grapevine, took the Oath of Truth and stated that she was opposed to the request. Joe L. Wright of 601 W. Wall Street and owner of the property, took the Oath of Truth and explained that he understood the concerns of the neighbors but felt they were confused about the issues. He also explained that if the variance was denied, setbacks would have to be met and there would not be the flexibility to move buildings and streets. Mr. Stombaugh explained that the applicant would have to meet the lighting standards of the ordinance and also the landscaping requirements. it Board of Zoning Adjustment 01/03/2000 Kip Bruner explained that the case was not before them to change the zoning, that the owner could go ahead and develop the property under the current zoning. Jim Kelso agreed with Kip Bruner that the neighborhood needed to be educated on what the development would look like to ease some concerns. He asked if Mr. Wright could meet with the neighbors before the next Board of Zoning Adjustment meeting. Ron Cook explained that Mr. Wright was not required to show a site plan at the Board of Zoning Adjustment meeting. He made the comment that the community would get a much better product from Mr. Wright than any other developer. In response to Mr. Cook's question regarding the elevation difference, Mr. Schelling explained that the elevation behind Lot 9 and 10 was 620 and the bottom of the creek was 590. Mr. Cook explained that from the north to the south side of the creek, the homeowners would not be able to see the top floor of the buildings south of the creek because of the distance. Mr. Schelling said the two-story buildings would be 10 to 15 feet lower than at their property line. Mr. Hecht announced that five letters of protest were received. Mr. Schelling requested that the case be continued so a meeting with the homeowners could be held. With no one else to speak either for or against the case, Kip Bruner made a motion to table case BZA99-28 until the February 7, 2000 meeting. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson ANTHONY • • JULIA BIRD Next the Board of Zoning Adjustment considered Board of Zoning Adjustment Case BZA99-29, submitted by Anthony J. and Julia L. Bird for property located at 2944 Parr Lane, platted as Lot 1R, Block 1, The Vineyards. The following requests were to Grapevine Comprehensive Zoning Ordinance 82-73: 5 Board of Zoning Adjustment 01/03/2000 Section 42.C.3., requires detached accessory buildings to be located in the rear one-half of the lot. The applicant requested to allow the existing detached accessory building in the front one-half of the lot to be converted to guest quarters. Section 13.13. requires accessory buildings to be setback at least 45 feet from the front building line. The applicant requested an existing accessory building with a 28 foot setback to be allowed to be converted into guest quarters. If approved it would allow a 17 foot variance. Section 13.G.1., requires a front building line of 40 feet. The applicant requested to allow an existing accessory building with a 28 foot front setback to be converted to guest quarters. If approved it would allow a 12 foot variance. Mr. Stombaugh explained that Staff found that there were special conditions for the above listed variances since it was an existing structure with existing variances. He also explained that the Board heard the request in 1997 and since that time, although a building permit was sought, no final inspection was granted and the accessory building had changed from a garage into guest quarters. Anthony Bird, applicant of 2944 Parr Lane, Grapevine, took the Oath of Truth and spoke about the history of the building. He explained that he wanted to make the building into guest quarters and the only difference would be adding a lavatory and shower. Mr. Bird said that it would not be rented. He explained that in the future the building may be used for his mother or mother-in-law. He stated that he had no intention of renting it or using it for commercial purposes. Mr. Bird said that he had no deadline for completing the job. Mr. Hecht noted that one letter of approval had been received. With no one else to speak either for or against the request, Ron Cook made a motion to close the public hearing. Kip Burner seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson 0 Board of Zoning Adjustment 01/03/2000 Ery Meyer then made a motion that there were special conditions since the structure was existing with existing variances. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson Ery Meyer made a motion to approve the variances to Section 42.C.3., allowing the existing detached accessory building in the front one-half of the lot to be converted to guest quarters; Section 13.B., allowing an existing accessory building with a 28 foot setback to be allowed to be converted into guest quarters, allowing a 17 foot variance; and to Section 13.G.1., allowing an existing accessory building with a 28 foot front setback to be converted to guest quarters, allowing a 12 foot variance. Kip Bruner seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson BOARD OF ZONING ADJUSTMENT CASE BZA 99-30 126 N. SCRIBNER STREET MARLA LOONEY The last item of new business was for the Board of Zoning Adjustment to consider BZA99-30 submitted by Marla Looney for property located at 126 N. Scribner Street, platted as Lot 4, Watson Addition. The following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 54, Masonry Requirements which requires that all buildings or structures in the "HC" Highway Commercial District shall be of exterior fire resistant construction having at least seventy (70) percent of the total exterior walls, excluding doors and windows, constructed of brick, stone, fibre reinforced cementitious board or other masonry material. The applicant requested a total variance to this requirement and if approved would allow the existing structure to remain with no masonry exterior siding. Mr. Stombaugh explained that Staff found that there were special conditions for the above listed variance specifically, the structure was existing with potential historical significance. Marla Looney, applicant, of 2901 Tumbleweed Trail, Grapevine, took the Oath of Truth and explained that she had recently discovered that the structure used to be located at 619 Main Street and was moved in 1962 to its current location. 7 Board of Zoning Adjustment 01/03/2000 She explained that the material on the structure was the original wood siding and that she wanted to keep the structure in its original state. Chairman Hecht announced that one letter of approval had been received. With no one else to speak either for or against the request, Kip Bruner made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson Kip Bruner then made a motion that there were special conditions, specifically, the structure exists with potential historical significance and does not necessarily need to be updated to fall into the masonry requirements. Ery Meyer seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson Kip Bruner made a motion to approve the variance to Section 54, allowing the existing structure to remain with no masonry exterior siding. Ron Stombaugh explained that the case was tabled at the December 6, 1999, meeting due to the applicant not being able to attend. He explained that the following request was to Grapevine Comprehensive Zoning Ordinance 82-73: Section 50.B.3., Screening, which requires all sides of a dumpster be screened by a solid fence or wall, except the side for garbage pickup service. 9 Board of Zoning Adjustment 01/0312000 He explained that the applicant requested a variance to waive the screening requirements for dumpsters and if approved, the screening around the dumpsters would not be required between the buildings on the property. Mr. Stombaugh explained that Staff found there were special conditions, specifically the service area where the dumpsters are located was not visible from any public thoroughfares. Sarah Scallen, representing Weingarten Realty Management, 5800 Preston Road, Dallas, took the Oath of Truth and explained that there were easements on either side of the property and the dumpsters were not visible by dedicated streets. She explained that the dumpsters would be located behind each of the suites, against the walls and would only be seen by the truck drivers. Kip Bruner explained that he felt the building served as the screen. Ron Cook explained that he felt the intent of the ordinance was for the dumpsters to be out of site and felt the applicant did not want to maintain the screening. Ery Meyer also noted that he felt the intent of the ordinance was for the dumpsters to be screened not just from the public but also from the businesses. With no one else to speak either for or against the request, Ron Cook made a motion to close the public hearing. Jim Kelso seconded the motion which prevailed by the following vote: Ayes: Hecht, Meyer, Cook, Bruner, Kelso Nays: None Absent: Luers, Anderson Ron Cook then made a motion that a special condition did not exist.
