The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, February 7, 2000, at 6:00 P.M., in the Council
Chambers, 200 South Main Street, Grapevine, Texas with the following members
present:

Chairman Carl Hecht called the meeting to order at 6:00 P.M.
OLD BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA 99-28,1600 W. NORTHWEST
HIGHWAY MARTIN SCHELLING
The first item of business was for the Board of Zoning Adjustment to consider
BZA99-28, which was tabled at the January 3, 2000, meeting so the applicant
could meet with the homeowners who live north of the subject property. The
following variance request was to Grapevine Comprehensive Zoning Ordinance
82-73 for property located at 1600 W. Northwest Highway, legally described as
Tracts 41 and 4C, Abstract 1050, Thomas Mahan Survey:
Section 27.1.1, "PO" Professional Office District, Height Regulations which
provides that buildings located contiguous to an "R-20," "R-12.5," or "R-7.5"
district shall not exceed one story or 20 -feet in height.

Mr. Stombaugh explained that the applicant requested a variance to construct 2 -
story office buildings not to exceed 30 feet in height, south of the creek as shown
on the concept plan. He explained that Staff found special conditions,
specifically the "PO" Professional Office District section of the lot was bisected by
a creek and drainage easement which inhibited the property owner from
developing the site into multiple lots which would allow development of 2 -story
office buildings. He explained that the portion of the lot south of the creek at its
narrowest was over 200 -feet south of the adjacent single family district. He also
explained that with a minimum lot depth of 100 -feet for lots in the "PO"
Professional Office District, the area in question had over twice the separation
than what was required between 2 -story office buildings and contiguous single
family residences.
Martin Schelling, applicant of 601 W. Wall Street, Grapevine, took the Oath of
Truth and explained that he had had an opportunity to visit with two of the
neighbors to the north and was able to resolve some questions. He noted that
he showed plans of the property to the neighbors and stated that they expressed
favor of the request.
Chairman Hecht thanked Mr. Schelling for his willingness of having the case
tabled and for meeting with the property owners.
After further discussion, Dennis Luers made a motion to close the public hearing.
Kip Bruner seconded the motion which prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner

Ery Meyer then made a motion that there were special conditions, specifically the
"PO" Professional Office District section of this lot was bisected by a creek and

Ery Meyer then made a motion to approve the request to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 27.1.1, allowing the

the creek as shown on the concept plan. Kip Bruner seconded the motion which
prevailed by the following vote:

NEW BUSINESS
BOARD OF ZONING ADJUSTMENT CASE BZA 99-32,2200 STATE HIGHWAY
121 JAMES R. WORSHAM/BECK ARCHITECTURE
The first item of New Business was for the Board of Zoning Adjustment to
consider BZA99-32, submitted by James R. Worsham with Beck Architecture for
property located at 2200 State Highway 121, platted as Lot 1, Block 1, 121
Corporate Court. The following requests were to Grapevine Comprehensive
Zoning Ordinance 82-73:
Section 25.G.4 Area Regulations which requires that every lot within the "CC"
Community Commercial District shall have two side yards each of which shall be
no less than 20 -feet in width.
The applicant requested a variance of 5 -feet to this requirement along the
southern property line. If approved it would allow a side yard setback of 15 -feet
along the southern property line as shown on the site plan.
Section 53.H.2.b Landscaping Regulations which requires a perimeter landscape
area of at least 10 -feet in width between the edge of a parking area and an
adjacent property line.
The applicant requested a complete variance to this requirement along the
northern property line. If approved it would allow no landscaping between the
parking area and the adjacent northern property line.
Mr. Stombaugh explained that Staff found that there were special conditions for
both of the above requested variances—specifically, the building was an existing
building constructed before the establishment of the current version of the zoning
ordinance Ordinance 82-73, and under the provisions established by Zoning
Ordinance No. 70-10, this building was in compliance.
There were questions from the members concerning parking spaces.
James Worsham, applicant, with Beck Architecture, 7001 Preston Road, Suite
210, Dallas, Texas, took the Oath of Truth and explained that there would not be

any less parking spaces. He said that some spaces might be added along the
east property line.
With no one else to speak regarding the case, Ron Cook made a motion to close
the public hearing. Kip Bruner seconded the motion which prevailed by the
following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner
Nays: None
Absent: Anderson
Dennis Luers then made a motion that there were special conditions, specifically,
the building was existing and was in compliance when originally built. Ery Meyer
seconded the motion which prevailed by the following vote:

Dennis Luers then made a motion to grant the variances to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 25.G.4., allowing a side yard
setback of 15 feet along the southern property line as shown on the site plan,
and to Section 53.H.2.b., allowing no landscaping between the parking area and
the adjacent northern property line. Ery Meyer seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner

Next, the Board of Zoning Adjustment considered BZA99-33, submitted by
Edward Frajer for property located at 2109 Idlewood Drive.
Mr. Williams recommended that the Board withdraw BZA99-33 due to previously
approved variances.

motion which prevailed by the following vote:

BOARD OF ZONING ADJUSTMENT CASE BZA00-01 1733 SILVERSIDE
DRIVE HUGH AND GWEN PATTERSON
Next, the Board of Zoning Adjustment considered Board of Zoning Adjustment
Case BZA00-01, submitted by Hugh and Gwen Patterson for property located at
1733 Silverside Drive, platted as Lot 60, Shorecrest Acres. The following
requests were to Grapevine Comprehensive Zoning Ordinance 82-73:
Section 15.C.1., R-7.5, Single Family District Regulations, which requires a 30 -
foot front building setback.
The applicant requested a 12 -foot variance, resulting in an 18 -foot setback for a
proposed addition as shown on the plot plan.
Staff's recommended condition was that the encroachment be allowed only to the
originally platted 25 -foot building line, resulting in a 5 -foot variance.
Section 15.G.5., R-7.5, Single Family District Regulations which requires a
minimum 100 -foot lot depth.
The applicant requested a special exception to allow an existing lot to continue
as developed with an 85 -foot platted lot depth.
Section 42.D., Supplementary District Regulations which requires a 15 -foot
sideyard building setback.
The applicant requested a 4 -foot variance for a proposed addition and if
approved would allow an 11 -foot setback as shown on the plot plan.
Mr. Williams explained that Staff found there were special conditions for Section
15.C.1., only for an encroachment of 5 -feet, as the property was originally platted
with a 25 -foot front building line, Section 15.G.5., as the lot was existing and
platted with an 85 -foot lot depth, and for Section 42.D., as the lot was originally
platted with a 10 -foot side building line and the proposed addition did not
encroach this platted setback.

Mr. Williams noted that staff recommended the Board take into account all
property owner input when they considered the requests.
Hugh and Gwen Patterson, applicants, of 1733 Silverside Drive, Grapevine, took
the Oath of Truth. Ms. Patterson explained that they wanted to add 600 square
feet to their 700 square foot residence. She said they could not add a second
story due to their house being built on pier and beam. Ms. Patterson also
explained that adding on to the back would present a hardship because of their
back neighbor being just ten feet from the property line. She also added that the
garage and a large pecan tree was located on the south side, therefore,
presenting a hardship of adding on to the south side. Ms. Patterson also added
that the covered porch would not be enclosed.
After further discussion, Kip Bruner made a motion to close the public hearing.

Kip Bruner then made a motion that there were special conditions for Section
15.C.1., for a 12 -foot variance resulting in an 18 -foot front setback, as the lot was
unusually shallow; Section 15.G.5., as the lot was existing and platted with an
85 -foot lot depth; and for Section 42. D., as the lot was originally platted with a 10 -
foot side building line and the proposed addition did not encroach the platted
setback. Ery Meyer seconded the motion which prevailed by the following vote:

Kip Bruner then made a motion to grant the requests to Grapevine
Comprehensive Zoning Ordinance 82-73, Section 15.C.1., allowing an 18 -foot
setback for a proposed addition as shown on the plot plan, Section 15.G.5.,
allowing an existing lot to continue as developed with an 85 -foot platted lot depth,
and Section 42. D., allowing an 11 -foot setback as shown on the plot plan. Ery

The next item was for the Board of Zoning Adjustment to consider BZA00-02
submitted by Mike Ware for property located at 1403 Terrace Drive, platted as
Lot 6, Block 10, Bellaire Addition. The following requests were to Grapevine
Comprehensive Zoning Ordinance 82-73:
Section 42.D., which requires a 30 -foot side building line for reverse frontage
lots.
The applicant requested a 5 -foot variance for a proposed carport. If approved, it
would allow a carport to be constructed with a 25 -foot setback.
Section 43.E.3., which allows the Board of Zoning Adjustment to approve the
remodeling or enlargement of a nonconforming use.
The applicant requested a special exception to allow the addition of a carport to a
residence that did not meet the current 30 -foot front setback requirement.
Mr. Williams explained that Staff found that there were special conditions for
Section 42.D., specifically the lot was originally platted with a 25 -foot side
building line, and to Section 43.E.3., being the house was existing and was
platted with a 25 -foot front building line. He explained that recommendation of
approval was contingent upon input from notified property owners.
Mike Ware, applicant, of 1001 W. Northwest Highway, Grapevine, took the Oath
of Truth and explained that the carport would line up with the side of the house
that faces Hill Street.
Chairman Hecht announced that five letters of approval had been received.
With no one else to speak either for or against the request, Kip Bruner made a
motion to close the public hearing. Ery Meyer seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner

Ron Cook then made a motion that there were special conditions for Section
42.D., specifically the lot was originally platted with a 25 foot side building line,
and to Section 43.E.3, being the house was existing, platted with a 25 -foot front
building line and that the house was not encroaching. Dennis Luers seconded
the motion which prevailed by the following vote:

The next item for the Board of Zoning Adjustment to consider was BZA00-03,
submitted by Steven Bonesio for property located at 307 E. Northwest Highway,
platted as Lot 5A, Starnes Addition.
Ron Stombaugh explained that Staff requested that the case be tabled until the
March 6, 2000, meeting in order to give the applicant time to provide a more
detailed site plan submittal.
Ery Meyer made a motion to close the public hearing. Kip Bruner seconded the
motion which prevailed by the following vote:

2000, meeting.

STAFF REPORTS
Mr. Williams informed the Board that ground had been broken south of the Taco
Bell for Golden Corral.
Mr. Stombaugh announced that two Internet grocery companies were locating in
Grapevine. He said that WebVan would be constructing a 70,000 square foot
building in Westport Business Park and Grocery Works, out of Carrollton, was
looking to locate in the Heritage Industrial Park.
Buy would be locating at the southwest corner c
Highway 114, next to Classic Chevrolet, and Frei
south of Arlington -Grapevine Road and east of
north of Pavestone. Mr. Stombaugh said that
moving from their location on State Highway 182
Avenue, next to Skateland.
