The Board of Zoning Adjustment for the City of Grapevine, Texas, met in regular
session, Monday evening, April 3, 2000, at 6:00 P.M., in the Council Chambers,
200 South Main Street, Grapevine, Texas with the following members present:
Carl Hecht
Chairman
Ery Meyer
Vice -Chairman
Dennis Luers

constituting a quorum with Member Russell Anderson absent. Also present was
City Council Representative Roy Stewart and the following City Staff:

Chairman Carl Hecht called the meeting to order at 6:00 P.M.

BOARD OF ZONING ADJUSTMENT CASE BZA00-05 PETER SZPUNER
4324 WINDSWEPT LANE
The first item that the Board of Zoning Adjustment considered was BZA00-05,
submitted by Peter Szpuner for property located at 4324 Windswept Lane, legally
described as Tract 2601, Abstract 2028. The following request was from
Grapevine Comprehensive Zoning Ordinance 82-73:
Section 43.E.3., Nonconforming Uses and Structures which allows the Board to
approve the enlargement of a nonconforming use.
The applicant requested a special exception to build an addition to a single family
dwelling located in a "R-TH", Townhouse District.
Mr. Stombaugh explained that Staff found that there were special conditions,
specifically the structure was built as and had always been used as a single
family residence. He explained that the lot and structure would not violate any

ordinance requirements of the "R-TH", Townhouse Zoning District, or any single
family zoning district.
Peter Szpuner, applicant and property owner, took the Oath of Truth and
explained that the house was built in 1977 and that he needed to add two extra
bedrooms. He noted that he did not live in the house but was working at
rehabilitating the house and cleaning the property.
Chairman Hecht explained that some of the returned property owner response
letters questioned whether the property was being developed as townhouse and
was concerned about what was being done on the northwest part of the property.
Mr. Szpuner explained that he was filling in a pond on the northwest part of the
property and was cleaning up the underbrush and trees.
There was discussion about having the property rezoned to R-7.5, Single Family
which would have to be initiated by the property owner.
Susan Bosco of 708 Windswept Court, Grapevine, Texas, took the Oath of Truth
and explained that she was concerned with Mr. Szpuner installing gates along
the access easement between her property and Mr. Szpuner's property.
Mr. Stombaugh explained that the access easement served as access to Mr.
Szpuner's property and nothing could be constructed that would impede access
to his property.
Mr. Szpuner explained that he installed a gate to secure his property from
vandalism and theft.
With no one else to speak either for or against the request, Dennis Luers made a
motion to close the public hearing. Ery Meyer seconded the motion which
prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
Mr. Stombaugh assured the concerned guests that the only way to the property
was through the access easement and that it was extremely doubtful the City
Council would approve townhomes to be developed on the property.
Chairman Hecht noted that two letters of approval had been received.
Ery Meyer made a motion that special conditions exist, specifically the structure

Ery Meyer then made a motion to grant the request for special exception to build
an addition to a single family dwelling located in a "R-TH", Townhouse District.
Dennis Luers seconded the motion which prevailed by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
MINUTES
Next the Board of Zoning Adjustment considered the minutes of the March 6,
2000, meeting.
Ery Meyer made a motion to approve the minutes of the March 6, 2000, meeting
as written. Dennis Luers seconded the motion which prevailed by the following
vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson
Ery Meyer then amended his motion to approve the minutes of the March 6,
2000, meeting with corrections. Kip Bruner seconded the motion which prevailed
by the following vote:
Ayes: Hecht, Meyer, Luers, Cook, Bruner, Kelso
Nays: None
Absent: Anderson

prevailed by the following vote:
